Lawyer For Cop Charged In Beating Death Of Homeless Man Claims Officer Didn't Use ENOUGH Force

The trial for two of the three Fullerton police officers charged in the beating death of mentally ill homeless man, Kelly Thomas, has begun. Manuel Ramos, the officer who first approached Kelly Thomas and delivered most of the damage, is facing charges of second-degree murder and involuntary manslaughter. Officer Jay Ciccinelli, who arrived on the scene moments later, is facing charges of involuntary manslaughter and use of excessive force.

Ramos' lawyer, John Barnett, sought to have charges against his client dropped last year, claiming the 10-minute-long ordeal that Thomas suffered through before lapsing into a coma (first, attempting to tell officers he couldn't breathe and, towards the end, crying out for his father) was a direct result of Thomas' reluctance to be further hassled by the officer.

When a "recalcitrant" Thomas did not comply, Ramos was entitled to use force and the threat of force to complete his arrest, Barnett contended in his 80-page motion.

"Rather than use actual force, Officer Ramos employed a lawful, conditional threat, to use force," he wrote. "The death of Kelly Thomas was not the natural and probable consequence of that lawful threat."

The recording shows Ramos relied almost exclusively on "force" rather than the "threat of force." As mentioned earlier, Ramos approached a seated Thomas before the beating commenced and said, "You see these fists? They are getting ready to fuck you up." That, I suppose, would be considered a "threat of force." Ramos wasn't kidding. His fists, along with his nightstick and additional abuse from a handful of other officers, completely "fucked up" Kelly Thomas, leaving him in an irreversible coma. Jay Cicinelli contributed in his own way, beating Thomas' face with the butt end of his Taser. (Cicinelli is captured on Ramos' mic stating that he "smashed [Thomas'] face to hell.")

There's really no questioning what happened. Security camera footage, synched to Ramos' mic, paints a brutally clear picture of how much Thomas went through before his body and mind gave out. Even the coroner's report notes the death wasn't accidental, listing "mechanical suppression of the thorax" as the cause of death. [The recording is 33 minutes long. The "altercation" begins about 15 minutes in. Five minutes later, there are six officers restraining Thomas. Warning: video, especially Thomas' anguished screams, is Not Safe For Life.]

John Barnett is still defending Officer Ramos. He's decided to top his earlier claims that the officer's actions were lawful and appropriate.

Ramos? attorney? told jurors that the officers who beat Thomas on a summer night in 2011 not only didn?t use excessive force in the incident, they ?weren?t using enough force.?

The officers were forced to call for backup because they could not subdue an out-of-control Thomas, John Barnett said. ?They?re losing the fight,? Barnett said.

Watch that tape again (or for the first time) and see whether it appears the cops are "losing the battle." Thomas, who weighed 135 pounds, was subdued by six Fullerton officers. The recording clearly captures him telling officers he can't breathe. Thomas was homeless and suffered from schizophrenia. While he wasn't cooperative with Ramos' instructions before he was beaten, he was still pretty far from being a threat. Last year, Barnett claimed the force was "appropriate." Now, he claims it was "too little." Officer Ramos apparently has no idea how to deploy an appropriate amount of force, despite his training.

Barnett continues:

?This case is not about a homeless, helpless, harmless mentally ill guy, this case is about a man who made choices in his life, bad choices that led to his tragic death,? Barnett said.

No one's arrest should end in death -- no matter what "choices" they've made -- not when six officers are looking to control one person. And for Barnett to claim that somehow choices the mentally ill Thomas made earlier in his life contributed to his death is not only disingenuous, it's genuinely sickening. If that's the case, then bad choices made by Officers Ramos and Cicinelli in their lives led to them being charged with manslaughter and murder.

This isn't about Kelly Thomas' life choices. This is about the choices made by a handful of officers -- choices that resulted in the death of a man whose life, what there was of it, came to a sudden halt because he ran into Officer Ramos and his backup.

The priority of officer's safety is not just higher than the life of a civilian; it completely wipes the latter out of consideration.

This scenario is repeated by police 1000's of times across the landscape of America. Usually the costumed criminals are rewarded with a paid vacation, and unless a camera catches them in the act of murder and assault, their crimes go unpunished. Don't be fooled by this sacrificial arrest and charges. More often than not, police either get off entirely or receive only a small reprimand. These cocksuckers found a vulnerable young man on the street and murdered him. They should be electrocuted to death, slowly, in full public view. Eyewitness Records Santa Ana Officer Shoot, Kill Unarmed Homeless Man Who Called Her 'Bitch'

SANTA ANA (CBSLA.com) ? An eyewitness recorded cellphone video of a Santa Ana police officer shoot and kill an unarmed 22-year-old homeless man at a shopping center earlier this week.

The witness, who wished to remain unidentified, was standing in the parking lot of the Harbor Place Shopping Center on South Harbor Boulevard around 3 p.m. Tuesday when he said he filmed a confrontation in front of Jugo?s La Tropicana between an officer, later identified as a 13-year veteran, and victim Hans Kevin Arellano.

In the military dictatorship of california, people need to start defending themselves yet they dont. this cop who murdered this homeless in a better world would become a code 10-00 because the people would not put up with such crimes against humanity.

As pacifist and afraid of law enforcement people are today, the american revolutionary war could never have happened because people would be so afraid of King George's troops/cops/peace officers that everyone would have bowed the knee in fear and ones who signed the decleration of independence would just been hung and this country would not be independent. Boston Cop Shoves Videographer, Then Threatens to Arrest Him for "Battery On A Police Officer"

Being assaulted by a police officer is grounds for being charged with battery on a police officer, at least according to this Boston police "Sargent" caught on video intimidating and threatening a man for videotaping.

A hefty plainclothes sergeant from the Boston Police Department figured the best way to not be exposed on camera was to physically confront a videographer, shoving him with his belly and pushing him back while threatening to arrest him for felony assault on an officer.

This, of course, is another common practice used by police, ranking right up there with ordering a non-resistant suspect to ?stop resisting? while physically pummeling him.

?You touch me again and I will lock you up for assault and battery on a police officer,? the burly sergeant told the burping videographer.

The sergeant and another plainclothes cop who identified himself as Fabiano told Jay Kelly that he needed to move out of the area because there was a police investigation.

Meanwhile, a shirtless jogger trots right through their investigation while numerous cars also drive through in opposite directions in two lanes.

The level of criminality one has to be comfortable with to boldly threaten to falsely charge someone with a crime while simultaneously committing a crime is almost incomprehensible, yet the cop clearly thinks nothing of it, knowing full well he is being videotaped.

Does anyone out there actually think this man was "served" by these police officers?

Would anyone out there voluntarily pay these men to protect them?

This is the problem with the compulsory monopoly that is the state, there is absolutely no accountability because there is no one to "watch the watchers." When the man asks to speak to the cop's supervisor, he says, "I am the supervisor." While the bald faced liar's word is completely worthless, we'll will know what his "supervisor" and his supervisor's supervisor thinks based on whether or not the cop is fired and charged with intimidation.

Indianapolis "Officer of the Year" Attacks Man in Under 16 Seconds of Conversation

INDIANAPOLIS, IN -- A 60-year old businessman was attacked in the lobby of the JW Marriott hotel only 16 seconds after a police officer had interjected himself into a peaceful dispute regarding hotel services. It was all caught on video, evidence which contradicts the officer's story.

Brian Hudkins was disputing with hotel staff over the fact that unauthorized people had entered his hotel room. He was upset but not in any way aggressive. He even clasped his hands behind his back.

That's when "Officer of the Year" T. Michael Wilson and Brian Hudkins began interacting. Video shows that in only 16 seconds of talking to Hudkins, he inexplicably grabs him by the shoulders and tackles him violently to the ground. Hudkins had his hands behind his back during the entire body-slam maneuver.

Video footage from outside the hotel shows the officer taking Hudkins to the ground for a second time, again without any clear reason for using that level of force on a handcuffed man.

When asked if it looked like excessive force was used, Police Chief Rick Hite said, "It looks like force was used."

Hudkins suffered cuts and bruises, an injured shoulder, was denied medication, and has had his business and reputation suffer because of the incident. He has filed a lawsuit against IMPD.

jeez, cut the terrorist some slack...he waited 16 seconds and didn't even kill the guy or his dog, if he had one.
the female terrorist in the Santa Ana video below only took 5 seconds to kill her victim. This is the kind of shit that prompted the "you can shoot the cops" law that they passed. When will you stop putting up with this kind of treatment? In the end of the video it's mentioned that Hudkins did plead guilty to misdemeanor charges. I guess, this will clear the officer. These ''famous'' cops are really fucking up the name of the good cops.
These cops should be fucking fired. It's a fucking disgrace.

Man Refuses To ID At Texas Border Patrol Checkpoint, Checkpoint Officer Says "Get The F*ck Out of Here" & Waves Him Through

A man driving through a border patrol checkpoint in Texas is asked whether he is an American citizen by a checkpoint agent, the man refuses to answer the question and says he has the right not to.

Despite the checkpoint officer's protestations, the man boldly asserts his rights and doesn't budge, even despite the officer's threats.

Eventually, the checkpoint officer breaks and tells him, "You know what, you look like you're an American."

"Very arrogant..."

"Get the f*ck out of here," the officer tells him.

"Go ahead," he says, finally waving him through.

Shock Video Shows New Jersey Police Officer Deck Woman In Face

An internal investigation has been launched into a viral YouTube video that shows an Elizabeth police officer punching a woman in the face as he tries to break up a melee outside of a nightclub last weekend, officials said today.

The officer will remain on active duty while police investigate a 20-second YouTube clip, said Kelly Vence, a city spokeswoman.

Vence declined the identify the officer, and said the woman who was struck has not spoken to authorities. A police spokesman refused to comment on the incident.

In the clip, which has gained more than 11,000 views since it was posted on March 3, the officer is seen attempting to break up a fracas outside of Envy Night Club on North Broad Street. After walking away from a crowd of roughly 10 to 12 people, the officer grabs hold of a man in a black vest and shoves him to the ground. Once the man falls, a woman wearing a red dress appears to grab the officer?s arm, and he responds by punching her.

[...]Wayne Fisher, a former deputy director of the state Division of Criminal Justice, said the woman appears to have initiated the physical contact, and encouraged residents to wait for the entire story to come out before criticizing the officer.

A spokesman for Attorney General Jeffrey Chiesea declined to comment on the video, but referred to the state?s guidelines on use of force by police, which says officers may use physical force to defend themselves if they feel they are facing a legitimate threat.

I can't tell if she grabbed his arm in an act of "interference," or if the cop was moving to arrest her, at which point she grabbed his arm merely to balance herself and brace herself for his onslaught. Regardless, she sure as hell didn't attack the cop, at most she laid her hand on him, hardly what I would call a "legitimate threat," yet the cop wound up and decked her like his life depended on it.

Cops in Elizabeth New Jersey are douches so this criminal thuggish behavior of this one in the video is of no surprise. Of course most New Jersey citizens don't value freedom and usually are apologists for the police. The officer was trying to handle a whole group without backup. DENVER (CBS4) ? A Denver police officer charged with sexually assaulting a woman he pulled over has been found guilty.

The verdict came in Tuesday afternoon against Hector Paez. He was found guilty of sexual assault, kidnapping and false reporting.

The woman did have a warrant for a probation violation, but after driving her to a secluded area Paez told her there was a way to avoid jail.

A Tempe, Arizona police officer caught hiding evidence in his garage and lying about it will get to keep his job thanks to a ruling by Tempe police chief Tom Ryff.

TEMPE, AZ (CBS5) - An internal investigation revealed a Tempe officer flat out wasn't doing his job. Reports show he knowingly botched 10 cases.

During the investigation, Officer Tony Trow admitted he was taking evidence home and keeping it in his garage. It was also discovered Trow put off writing a murder report for five years.

[...]An internal investigation revealed from September 2004 to March 2012, Trow stored evidence from five cases in his garage to hide his unfinished work. That included case notes, crime scene photos and even original recordings of interviews. The report from that investigation said those items had been tossed together in cardboard boxes.

It was also discovered Trow didn't write nearly a dozen reports, some dating as far back as 2007.

The report showed Trow also didn't bother to turn in the rape kit of a 17-year-old.

Not only should this cop be fired, he should be criminally charged for tampering with evidence.

Caught On Tape: Officer Sucker Punches Inmate In Face, Files Report Claiming 'Self Defense'

40-year-old Rico Palomino, a 12 year veteran corrections officer at the Cook County Jail in Illinois, claimed in his incident report an inmate "turned around abruptly" and grabbed his shirt, for which he had no choice but to act in self defense by striking the inmate with his open palm to "create a safe distance between himself and the detainee," reports NBC Chicago. The trouble is, the incident was caught on tape, and rather than show the officer was responding to being grabbed suddenly, it shows the cop casually walking up to an inmate and suddenly sucker punching him viciously in the face leaving him bleeding profusely from the mouth.

Here's how the incident went down:

Prosecutors said Palomino was working at a desk when an inmate walked by, asking Palomino where officers kept inventoried property because he wanted to get a phone number.

As the inmate continued to walk down a hallway, Palomino followed and told him to return to the lockup area.

"If you don't get back over here, I'm going to f--- you up," prosecutors alleged in a proffer.

A surveillance camera from the hallway recorded Palomino, eight inches taller and 100 pounds heavier than the inmate, striking the detainee, causing him to fall to the floor.

Prosecutors said the inmate was left bleeding from the mouth and required stitches.

The corrections officer is now being charged with a Class 3 felony, he is potentially facing 2-5 years in prison and up to a $25,000 fine. You have to wonder what the punishment would be if the shoe was on the other foot, not to mention if the officer's lies were simply accepted as fact.

Police Officer Killed Victim Of Break-In

Friends, family angry as questions go unanswered; one man charged

Maybe if the police officer had arrived just a minute later, the young man would still be alive.

That?s what the friends and family of Destin Thomas say, after Columbus police confirmed yesterday that it was one of their own officers who shot and killed Thomas while responding to a 911 call he had made on Tuesday morning.

Police gave few details yesterday about what happened between the 21-year-old Thomas and Officer William Kaufman, a 17-year veteran, citing the ongoing investigation.

They said that Kaufman shot Thomas twice, in his hip and chest. Thomas died at the scene.

?The fact that they?re trying to justify it, no apology or nothing, (just saying), ?Oh, we?re just doing what we were trained to do,?? said Thomas? cousin Derek Harris, 24. ?I didn?t know you were trained to kill the person you were supposed to help.?

Caught On Tape: Officer Threatens to Make Up Evidence After Arrest of Innocent Men

SEATTLE -- A Seattle police officer has been caught on tape talking about "making up" evidence while two wrongly arrested men sit in jail. It's the latest shocker uncovered by a KOMO 4 Problem Solver investigation into the Seattle Police Department's vanishing dashcam videos.

Josh Lawson and Christopher Franklin filed a claim against the city Monday for excessive force and wrongful arrest.

The two were arrested at gunpoint on November 16, 2010 and said the incident changed their lives forever.

"I thought I was gonna die," Lawson said about that night.

Franklin said it was "the most terrifying thing I've ever experienced."

Both men said they suffered facial bruises and swelling after one was kicked and the other man-handled into the pavement while being arrested. But then listen to what an officer says on an audio recording after he takes the two to holding cells: "Well, you're going to jail for robbery that's all."

You then hear Franklin ask, "for robbery?" And the officer responds, "Yeah, I'm gonna make stuff up."

Franklin believed him.

"He showed me that he has the power to do whatever he wanted that night," he said. "He has a badge, and all we can do is nothing."

Caught On Tape: Cop Sucker Punches Suspect In Back Of Head, Then Charges Him With "Assaulting A Police Officer"

McLEAN, Va. ? A former Loudoun County sheriff's deputy is facing a federal civil rights lawsuit after a patrol car camera appeared to show him knocking out an unsuspecting target with a blow to the back of the head delivered at a full sprint.

Sterling, Va., resident Carlos Garcia filed the lawsuit last year in U.S. District Court in Alexandria, but papers were served only recently on the defendant, Terry Daniel, who resigned from the Loudoun County Sheriff's Office last year.

Garcia's lawyer, Victor Glasberg, said the video ? which has been posted on YouTube ? is clear and unambiguous evidence of an unprovoked assault. It shows Garcia standing with his hands in the air next to another deputy and his back turned as Daniel approaches rapidly. Garcia collapses immediately after being struck by the deputy.

In the lawsuit, Garcia says the blow knocked him unconscious and has left him with permanent brain damage, including headaches, loss of memory and confusion.

After giving the man brain damage, the cop charged him with assaulting a police officer.

Interestingly, it was Garcia who wound up being charged following the November 2009 incident with assaulting a police officer. Court records show he pleaded guilty to a lesser charge of misdemeanor battery and received a suspended sentence.

Note, the police likely intimidated him into taking a plea deal through threatening him with a felony trial. (See this article, "The Police State Abolishes the Trial" for an explanation of how this scam works.)

In the lawsuit, Glasberg writes that Garcia consistently denied assaulting anyone, but opted to plead guilty to a reduced charge with a suspended sentence to avoid a felony trial. And Glasberg said the criminal allegations are unrelated to the assault Garcia suffered; even if the incident had unfolded as police described, it would have been minutes before Daniel's attack on Garcia, Glasberg said.

You know, if you don't do anything wrong, you have nothing to worry about. After I was arrested, handcuffed they walked me back to the cop car, and threw me on the concrete 4-5 times bloodying my knees. Not the same as getting punched in the back of the head though. This stuff happens all the time. Some police will even kill and cover it up, not to mention plant drugs on people. Sources: Police Officer Who Used Pepper Spray On Protesters To Lose 10 Days Vacation Time

As hundreds of "Occupy Wall Street" protesters marched to the Manhattan District Attorney's office on Tuesday to demand prosecution of alleged police brutality against demonstrators, a police officer who was seen on video using pepper spray on a protester last month was found to have violated city guidelines.

Deputy Inspector Anthony Bologna, seen above, was seen using pepper spray on a crowd during a demonstration on September 24.

An NYPD investigation has found that Bologna violated the department's rules on pepper spray use, and he will lose 10 paid vacation days, sources say.

Citizen Recording Of Police Proves Officer Lied About Arrest

Reason.com alerts us to an LA Times article covering a recent trial in which a private citizen's cellphone video proved officers lied about an arrest, resulting in the acquittal of a young man accused of carrying a concealed firearm.

According to police reports after the arrest:

Deputy Levi Belville testified that he saw Gipson in the side yard run and toss a loaded revolver onto the roof of a detached garage. The deputy said he ordered Gipson to stop and that the suspect walked back to Belville, who then detained him.

However, the cellphone video depicted a very different chain of events:

The footage did not show Gipson running, tossing a gun or walking back to the deputies to be detained. Instead, the grainy video showed deputies arriving and walking past Gipson, who was standing against a wall of the house near the rear of the yard. One of the deputies, Raul Ibarra, returned to Gipson and escorted him to the back of the yard.

This new footage led to a change in the way the officers describe the events. This inconsistency in the officer's testimony led jurors to acquit Gipson of the charges.

Jurors said they did not find Belville's trial testimony credible and believed he changed his account of the arrest after being confronted with the video. They also questioned why a deputy with more than 10 years' experience would walk past a man who had just thrown a gun without immediately detaining him or warning colleagues.

Even as police and governments around the country are fighting the practice of the public recording the actions of the police, stories like this show the power that such recordings have in administering a fair justice system. Without this video, the trial would have been based entirely on the officer's testimony of events rather than on hard evidence.

I will close with a few words from Gipson himself in response to these events, "I never thought an officer would lie."

Kelly Thomas begged for his life from 'menacing' officer, D.A. says

Scared and bleeding, Kelly Thomas begged for his life to no avail as Fullerton police officers beat him and Tasered him in a violent confrontation that led to his death, Orange County Dist. Atty. Tony Rackauckas said at a news conference Wednesday.

Rackauckas gave a painfully detailed narrative of the July 5 events leading up to Thomas' death -? details that he said resulted in second-degree murder and manslaughter charges being filed against two police officers.

Rackauckas said Officer Manuel Ramos put latex gloves on his hands and brandished a fist at Thomas. Then, Rackauckas said, the officer, in a "menacing" manner, threatened Thomas: "These fists are ready to F you up." [...]

"Kelly Thomas was not responding when blows to his face occurred," Rackauckas said, adding, "That is not protecting and serving."
