"Public Authority," Drone Murders, and the Death of the Rule of Law

by William Norman Grigg

In America, wrote Thomas Paine, ?the law is king.? In a totalitarian state, Vladimir Lenin wrote more than a century later, rulers exercise ?power without limit, resting directly on force, restrained by no laws.?

Lenin?s formula was a blunt expression of what is known as the ?public authority justification? for government action. That doctrine, as explained by one legal scholar, holds that ?Deeds which otherwise would be criminal, such as taking or destroying property, taking hold of a person by force and against his will ? or even taking his life, are not crimes if done with proper public authority.?

In other words, government can give itself permission to break the law. This claim is central to the recently-released 2010 Justice Department memorandum defending the Obama administration?s claim that the president can order the summary execution of US citizens through drone strikes. All that is necessary is for the president to designate a targeted citizen as an unlawful combatant. Once this is done, the extra-judicial murder is sanitized by the miracle of ?public authority,? thereby becoming a supposedly lawful exercise of war powers.

This is the doctrine the permitted Barack Obama to authorize the murder of a 16-year-old US citizen ? an act, and a claim, demonstrating that the rule of law is dead.

In fact, every law has an exception exactly for when the act is done with proper public authority. Without that, punishing for any law violations would be impossible. So it applies to the drone strike as well as to less exotic incarcerating a felon, which without this exception would be impossible as well. so there is an exception for child rape?

Lawyer For Cop Charged In Beating Death Of Homeless Man Claims Officer Didn't Use ENOUGH Force

by Tim Cushing

The trial for two of the three Fullerton police officers charged in the beating death of mentally ill homeless man, Kelly Thomas, has begun. Manuel Ramos, the officer who first approached Kelly Thomas and delivered most of the damage, is facing charges of second-degree murder and involuntary manslaughter. Officer Jay Ciccinelli, who arrived on the scene moments later, is facing charges of involuntary manslaughter and use of excessive force.

Ramos' lawyer, John Barnett, sought to have charges against his client dropped last year, claiming the 10-minute-long ordeal that Thomas suffered through before lapsing into a coma (first, attempting to tell officers he couldn't breathe and, towards the end, crying out for his father) was a direct result of Thomas' reluctance to be further hassled by the officer.
When a "recalcitrant" Thomas did not comply, Ramos was entitled to use force and the threat of force to complete his arrest, Barnett contended in his 80-page motion.

"Rather than use actual force, Officer Ramos employed a lawful, conditional threat, to use force," he wrote. "The death of Kelly Thomas was not the natural and probable consequence of that lawful threat."

The recording shows Ramos relied almost exclusively on "force" rather than the "threat of force." As mentioned earlier, Ramos approached a seated Thomas before the beating commenced and said, "You see these fists? They are getting ready to fuck you up." That, I suppose, would be considered a "threat of force." Ramos wasn't kidding. His fists, along with his nightstick and additional abuse from a handful of other officers, completely "fucked up" Kelly Thomas, leaving him in an irreversible coma. Jay Cicinelli contributed in his own way, beating Thomas' face with the butt end of his Taser. (Cicinelli is captured on Ramos' mic stating that he "smashed [Thomas'] face to hell.")

[You can go to this link to see a picture taken by Thomas' father after his son's arrival at the hospital -- but we warn you that it's gruesome.]

There's really no questioning what happened. Security camera footage, synched to Ramos' mic, paints a brutally clear picture of how much Thomas went through before his body and mind gave out. Even the coroner's report notes the death wasn't accidental, listing "mechanical suppression of the thorax" as the cause of death. [The recording is 33 minutes long. The "altercation" begins about 15 minutes in. Five minutes later, there are six officers restraining Thomas. Warning: video, especially Thomas' anguished screams, is Not Safe For Life.]

John Barnett is still defending Officer Ramos. He's decided to top his earlier claims that the officer's actions were lawful and appropriate.

Ramos? attorney? told jurors that the officers who beat Thomas on a summer night in 2011 not only didn?t use excessive force in the incident, they ?weren?t using enough force.?

The officers were forced to call for backup because they could not subdue an out-of-control Thomas, John Barnett said. ?They?re losing the fight,? Barnett said.

Watch that tape again (or for the first time) and see whether it appears the cops are "losing the battle." Thomas, who weighed 135 pounds, was subdued by six Fullerton officers. The recording clearly captures him telling officers he can't breathe. Thomas was homeless and suffered from schizophrenia. While he wasn't cooperative with Ramos' instructions before he was beaten, he was still pretty far from being a threat. Last year, Barnett claimed the force was "appropriate." Now, he claims it was "too little." Officer Ramos apparently has no idea how to deploy an appropriate amount of force, despite his training.

Barnett continues:

?This case is not about a homeless, helpless, harmless mentally ill guy, this case is about a man who made choices in his life, bad choices that led to his tragic death,? Barnett said.
No one's arrest should end in death -- no matter what "choices" they've made -- not when six officers are looking to control one person. And for Barnett to claim that somehow choices the mentally ill Thomas made earlier in his life contributed to his death is not only disingenuous, it's genuinely sickening. If that's the case, then bad choices made by Officers Ramos and Cicinelli in their lives led to them being charged with manslaughter and murder.

This isn't about Kelly Thomas' life choices. This is about the choices made by a handful of officers -- choices that resulted in the death of a man whose life, what there was of it, came to a sudden halt because he ran into Officer Ramos and his backup.

If that was my kid those fuckers would be shiting into bags and eating thru straws or fucking worse and to include them rat fuck lawyers for the the fucking pigs. If I recall correctly, when the cop killed Tarika Wilson, because his comrades shot the dog on the backyard so he thought it's him being shot at, some either attorney, or expert, also testified that cop's only mistake was that he shot not fast enough.

The priority of officer's safety is not just higher than the life of a civilian; it completely wipes the latter out of consideration.

This defense attorney is a scumbag. He needs to be exposed for the POS he andhisclient really are. Retribution against the pig nation is coming... shows the true mentality of many cops and the cop suckers who call them heros which a very few are as most are just zeros proffesionally and personally. sad state of affairs. people actually call these scum fuck assholes heros. what is wrong with americans? completely brainwashed and unable to think for themselves. Jail is to good for these assholes.

time to step America and take your country back from the Nazis.

This scenario is repeated by police 1000's of times across the landscape of America. Usually the costumed criminals are rewarded with a paid vacation, and unless a camera catches them in the act of murder and assault, their crimes go unpunished. Don't be fooled by this sacrificial arrest and charges. More often than not, police either get off entirely or receive only a small reprimand. These cocksuckers found a vulnerable young man on the street and murdered him. They should be electrocuted to death, slowly, in full public view. And those other officers who helped them should be fired, indicted, arrested, tried and sentenced to prison for accessory to murder. too bad Hammurabi's laws aren't still in effect, eye for an eye, death for death..

Georgia teen was stuffed with newspaper after death, family lawyer says

By Elizabeth Chuck, Staff Writer, NBC News

The mysterious death of a Georgia teen has taken a bizarre twist with the revelation that an autopsy of his exhumed remains found his internal organs missing and his body stuffed with newspaper.

The family of Kendrick Johnson, 17, of Valdosta, Ga., was "outraged" and "devastated" by the discovery and believes his death was a murder that is being covered up, a lawyer representing them said Thursday.

Johnson, a three-sport athlete, was found dead on Jan. 11 in a rolled-up wrestling mat in his high school gym. State medical examiners concluded that he accidentally suffocated while trying to retrieve a sneaker.

Perhaps it was a state employee that committed the crime. Seems for sure the school wishes it to disappear. Not handing over video footage lets all sorts of theories arise. With respect to the removal of the young man's internal organs and the subsequent stuffing of his corpse with newspapers, I would suspect the person who performed the first autopsy, or perhaps the person who prepared the body for burial. They both would have had the opportunity to commit this sort of mutilation. There is a black market for human organs, and not all are sold for transplantation into living people.

Pelosi: Willing to "Protect" Syrian Children To Death

by William Norman Grigg

Whenever the ruling elite wants to engage in another bout of humanitarian slaughter, it will have its media auxiliaries soften up the public by barraging it with images of innocent people ? particularly children ? who are suffering and dying. Every ?humanitarian? war makes those images go away. Children are still being mangled and murdered, of course ? but those who control the state-aligned media are no longer interested in showing them.

House Minority Leader Nancy Pelosi recently deployed the ?It?s for the children? trope in a debate that she had ? and lost ? with her five-year-old grandson over the impending war with Syria. Since the child has not yet been processed through the government mind-laundry, he retained both his native intelligence and his natural impatience for obvious evasion. He also displayed a more mature understanding of ethics than his grandmother.

According to Pelosi?s account of the conversation, the child asked her if she favored war in Syria. Seeking refuge in circumlocution, Pelosi tried to brush off the question by replying, ?We?re not talking about war; we?re talking about action.? The child, who apparently knew that the ?action? being discussed would entail killing people, persisted through Pelosi?s persiflage: Did she support war with Syria? Pelosi again tried to deflect the question, this time by turning it back on the child by asking what he would do.

?I think no war,? was his reported reply.

In desperation, Pelosi unleashed the most potent weapon in her rhetorical arsenal ? the ?Bomb-the-children-to-save-the children? argument.

?I said, `Well, I generally agree with that, but you know, they?ve killed hundreds of children there,?? Pelosi recalled in a brief statement to reporters on the White House lawn. ?And he said, `Were these children in the United States?? And I said, `No, but they?re children wherever they are.??

America?s political class is thickly populated with thinly educated people, and in that dismal company Nancy Pelosi?s has always distinguished herself through her sheer stupidity. She is so incurably dense that she shared this story in the belief that it offered a compelling display of wisdom ? rather than the pitiable spectacle of a policymaker losing a debate over geopolitics to her five-year-old grandson.

That child, unlike his famous grandmother, instinctively drilled down to a question she and her comrades cannot answer: Quo warranto? By what supposed authority would the US government make war on Syria to deal with atrocities committed against children living in that country?

Pelosi is famously disdainful of the idea that the U.S. Constitution imposes limits of any kind on federal action. Her platitudinous response to her grandson?s insightful and incisive question seems to assume that the US government has universal jurisdiction over mistreatment of children everywhere. One unspoken corollary is that the same government has unqualified authority to abuse and slaughter children in order to achieve its objectives.

At least for now, Syria seems to be the geographic limit of Pelosi?s exquisite sensitivity regarding the suffering of children overseas. Her concern crested just to the west of Iraq, where more than a million children have died from violence inflicted by the government that has employed Pelosi since 1987.

No recorded examples exist of Pelosi expressing anguish over the hundreds of thousands of Iraqi children who perished in anguish from starvation and disease as a result of the US-inflicted embargo that lasted from 1991 to 2003. Pelosi?s silence about that atrocity tacitly ratifies the assessment of her fellow humanitarian warmonger, Madeleine Albright, who blithely told 60 Minutes that the extermination of a half-million or more Iraqi children was a suitable price to pay in order to ?punish? Saddam Hussein.

Pelosi has likewise been silent about the ongoing horrors experienced by the children of Fallujah, an Iraqi city that was pulverized by the US military in 2004 as retaliation for the killing of a handful of Blackwater mercenaries. That onslaught included widespread use of chemical munitions in the form of white phosphorous rounds and ammunition made with depleted uranium. Those, too, are chemical weapons, unless the relevant sections of the periodic table have been revised to suit the interests of the Exceptional Nation.

The collective punishment of Fallujah for defying the illegal occupation of Iraq was an atrocity of Stalinist magnitude, and that punishment continues today as the city witnesses an unprecedented increase in the rate of pediatric cancer and birth defects, such as spina bifida, heart problems, and inexplicable deformities. Medical researchers believe that this is a result of persistent elevated levels of lead, mercury, and uranium from the onslaught.

A scene from "liberated" Fallujah.

It appears that Fallujah?s victims constitute another exception to Pelosi?s axiom that

?children are children wherever they are.? The same is true of Pakistani, Yemeni, and Afghan children who have been annihilated through US drone strikes. For Pelosi they are small lives, of little consequence.

Not a syllable of condemnation has escaped Pelosi?s lips regarding her president?s murder of 16-year-old Abdulrahman al-Awlaki, who was obliterated by a drone-fired missile just weeks after Mr. Obama murdered his father, Anwar al-Awlaki.

If Abdul al-Awlaki had been a Syrian teenager killed by the government of Bashar al-Assad, Pelosi might have taken notice of the crime. When committed by her Dear Leader, however, such extra-judicial killings are considered commendable by Pelosi, who doesn?t think that the Regime needs even to acknowledge killing U.S. citizens.

?People just want to be protected,? warbled Pelosi when asked about summary execution of US citizens by drone strikes. ?And I saw that when we were fighting them on surveillance, the domestic surveillance. People just want to be protected. [They?ll say] `You go out there and do it. I?ll criticize you, but I want to be protected.??

Pelosi?s logic ? if that word can be tortured into applying here ? dictates that it is sometimes necessary to "fight" Americans to "protect" them -- even if it means "protecting" them to death. That?s a serviceable summation of her position regarding Syria: She?s willing to bomb Syrian children in order to protect them, too. Although Pelosi?s views won?t withstand the scrutiny of her five-year-old grandson, they do display a certain deranged consistency.

Orlando Man is Year's Second Drug War Death

Follow @infolibnews!function(d,s,id){var js,fjs=d.getElementsByTagName(s)[0];if(!d.getElementById(id)){js=d.createElement(s);js.id=id;js.src='//platform.twitter.com/widgets.js';fjs.parentNode.insertBefore(js,fjs);}}(document,'script','twitter-wjs'); by Phillip Smith

One of two men shot by Orlando police inside a home during a drug investigation Wednesday night died Thursday. Karvis Jabbar Gamble, 19, becomes the second person to die in US domestic drug law enforcement activities so far this year.

Police told WKMG TV that five people were in the home when officers knocked on the door and that two of them resisted.

"A subject sitting inside the front room immediately reached for a handgun, pulled it up and started pointing at the officers," said Orlando police sergeant Jim Young. "A second subject inside the house comes running out of a back room. He ignored all officers' commands. He began to reach into his waistband."

Two different police officers opened fire, each striking one of the men. The other man shot by police, Cordaryl Leojermane Wilson, 25, has been charged with possession of MDMA/Ecstasy, possession of cannabis, possession of drug paraphernalia, and resisting arrest without violence.

Police said they recovered three guns, two of which were reported stolen, as well as drugs.

Neighbors told WKMG that they heard as many as five gunshots coming from the home. Relatives said it doubled as a studio for aspiring musicians.

Other witnesses told WKMG there were no guns or drugs at the house, and that police never identified themselves.

"All (the officer) did was open the door. They never said, 'OPD,' or nothing. They just shot him," a man said. "Who really would point a gun at the police? You know what's going to happen."

The two officers who shot their weapons will be placed on administrative leave pending the outcome of a departmental investigation.

At this point, it is unclear whether police were uniformed or undercover and whether they were serving a search warrant or engaging in a "knock and talk" investigation.

Obama Lists His Five Criteria for Death by Drone

by Joe Wolverton, II

President Obama is tearing the shroud of secrecy off his once hush-hush death-by-drone program.

From his interview with Ben Swann, host of Fox 19's?Reality Check, to his sit-down with CNN's chief White House correspondent Jessica Yellin, the kill-list compiler-in-chief is gradually exposing details of the principles he purportedly follows before targeting someone for assassination.

The president may assume that there is little reason to try hiding something that is being publicized daily?-- except in the mainstream media. In fairness, the New York Times has done fine work chronicling the expansion of the use of drones, as well as their involvement in the killing of innocents overseas caught in the blast zone of missiles aimed at alleged militants.

An exception to the official policy of silence on the matter of the death-by-drone program being carried out by the White House and the CIA was made earlier this year. In April the White House's top counterterrorism advisor, John Brennan, admitted for the first time publicly to the government's significant reliance on drones in prosecuting the War on Terror. Brennan said that the remote control killing of suspects on foreign soil who have been charged with no crime whatsoever, is "in full accordance with the law."

Brennan also said the United States "respects national sovereignty and international law."

Speaking with Margaret Sanger at the Council on Foreign Relations (CFR), Brennan defended the president's drone program. "So long as AQAP [al-Qaeda in the Arabian Peninsula] seeks to implement its murderous agenda, we will be a close partner with Yemen in meeting this common threat," he said.

Later in the interview, Brennan said that the president deploys drones to target only "militants" with designs on attacking the United States or its allies abroad. He admitted that American intelligence agents provide tactical support to Yemeni armed forces battling al-Qaeda on the ground.

When asked about the collateral deaths of innocent civilians during these attacks, Brennan responded that American drone pilots "make every effort" to avoid killing innocents. Said Brennan:

Today I'd simply say that all our CT [counterterrorism] efforts in Yemen are conducted in concert with the Yemeni government. When direct action is taken, every effort is made to avoid any civilian casualty. And contrary to conventional wisdom, we see little evidence that these actions are generating widespread anti-American sentiment or recruits for AQAP. In fact, we see the opposite; our Yemeni partners are more eager to work with us. Yemenese citizens who have been freed from the hellish grip of AQAP are more eager, not less, to work with the Yemeni government. In short, targeted strikes against the most senior and most dangerous AQAP terrorists are not the problem; they are part of the solution.

Describing the disregard for innocent human life as part of a "solution" is eerily reminiscent of similar statements made by despicable tyrants in the recent past.

The death toll of innocent people killed by the United States in the Middle East continues to increase. As?The New American reported on September 6, 29 Yemenis were killed by U.S. drones in one week. Many of these had not even tenuous ties to terrorists and were killed simply because they were in the wrong place at the wrong time.

When asked by CNN what process he uses to make the life or death decisions to deploy the drones to kill a "militant," President Obama listed five criteria:

? First, "It has to be a target that is authorized by our laws."

? Second, "It has to be a threat that is serious and not speculative."

? Third, "It has to be a situation in which we can't capture the individual before they move forward on some sort of operational plot against the United States."

? Fourth, "We've got to make sure that in whatever operations we conduct, we are very careful about avoiding civilian casualties."

? And fifth, "That while there is a legal justification for us to try and stop [American citizens] from carrying out plots ... they are subject to the protections of the Constitution and due process."

Examining this list reveals that in none of the deaths authorized by the president has any one of these criteria been met.

Let's take as a test case the remote-control murder of a young American in Yemen. What law authorized the murder of 16-year-old Abdulrahaman al-Awlaki, son of the American cleric Anwar al-Awlaki, who was also killed by Hellfire missiles fired by a Predator drone?

Neither man (both of whom were Americans) was ever charged with a crime or permitted to answer for his alleged crimes before an impartial judge -- a violation of the fifth point provided by the president.

What threat did the younger al-Awlaki pose to the United States? The Obama administration has never informed the country of any wrongdoing by this teenager other than being related to a man who posted anti-American videos on the Internet that allegedly influenced others to commit crimes. This violates the president's first criterion.

Number three above was certainly ignored by the president since no known attempt was ever made to capture this young man and take him into U.S. custody. Of course, that could be because he might actually have ended up in a court of law if he had been apprehended; and President Obama, a former lawyer, knows that trials can be long, messy, and unpredictable. It is much quicker and cleaner just to launch a missile and kill someone without going through the hassle of due process.

Finally, with regard to civilian casualties, not even the White House claims that Abdulraham al-Awlaki was a member of al-Qaeda or any associated organization. He was quite literally killed for being associated with one who was allegedly associated with those allegedly associated with al-Qaeda.

As Tom Junod wrote in Esquire:

But Abdulrahman al-Awlaki wasn't on an American kill list. Nor was he a member of Al-Qaeda in the Arabian Peninsula. Nor was he "an inspiration," as his father styled himself, for those determined to draw American blood; nor had he gone "operational," as American authorities said his father had, in drawing up plots against Americans and American interests.

He was a boy who hadn't seen his father in two years, since his father had gone into hiding. He was a boy who knew his father was on an American kill list and who [sneaked] out of his family's home in the early morning hours of September 4, 2011, to try to find him.

Furthermore, the young man was killed while eating dinner on the side of the road in the company of friends and extended family. So much for the limiting of "civilian" collateral damage. Not only was the target of the nighttime drone attack a civilian, but so were all the boys sitting with him when two American missiles lit up the area and killed them all.

Finally, when Yellin asked Obama if he personally approves the targets of the drone strikes, the president answered, "You know, I can't get too deeply into how these things work, but as I said as commander in chief ultimately I'm responsible for the process that we've set up to make sure that folks who are out to kill Americans, that we are able to disable them before they carry out their plans."

If only all advocates of constitutional due process could nonviolently through the electoral process disable those of both parties -- whether in office or seeking to be elected-- from carrying out their plans to destroy the our constitutionally protected liberty.

Don't Die in 2013: Confiscatory 55% Death Tax Set to Take Effect

The 2001 tax relief bill (EGTRRA), drastically reduced the impact of the death tax over the course of a decade, so that it was eliminated entirely for one year in 2010 ? a good year to die, joked a number of pundits. The bill lowered marginal rates and increased the applicable exclusion amount, but it also included a provision allowing individuals to carry over exclusion dollars that were unused by their spouse at the time of his or her death. This ?portability? measure effectively increased the applicable exclusion for many households, in some instances putting millions of dollars beyond the reach of the federal government.

The death tax rose from the grave at the end of 2010, with a Bush-era top rate of 35% and an applicable exclusion amount of $5 million ($5.12 million in 2012).

In 2013, the death tax will revert to its antiquated, pre-2001 form. The applicable exclusion amount will plummet to $1,000,000, and the top marginal rate will leap twenty points to 55%. A 5% surtax will also return, to be levied on estates between $10 million and $17 million. This raises the top effective rate of the death tax to 60%.

According to research by the Tax Policy Center, if the current death tax expires, then the resulting, stricter exemption threshold will force 114,600 estates to file for the tax in 2013 ? this represents a 13-fold increase from the previous year?s 8,800 estates, and countless wasted hours filling out tax paperwork. Of that cohort, an unfortunate 52,500 will be liable for the tax, way up from 3,300.

Nutritional McCarthyism: Red Meat To Blame for Death, Global Warming, Tsunamis, Mine Collapses, and Terrorist Attacks

by Karen De Coster

Red meat is probably the cause behind?the Congo train derailment and the Yangtze River dolphin extinction, too.

The media, this week, ran the following headlines:

CNN. "Study: Too Much Red Meat May Shorten Lifespan."

LA Times. "Red Meat: What Makes It Unhealthy."

AllVoices.com. "Harvard Study Concludes Red Meat Reduces Average Life."

NY Daily News. "Red meat boosts risk of dying young: study; Just one portion of processed meat boosts death risk by 20%."

New York Times. "Risks: More Red Meat, More Mortality."

And the most comical headline of them all was from Slate: "Study: All Red Meat Linked to Premature Death."

This was undoubtedly the most popular headline of the week for the sound bite lovin', I-read-the-headline-and-that's-all-that-matters crowd. To say that the mainstream media and the blogosphere discovered a new level of idiocy is putting it much too lightly.?There were two types of people hitting the "publish" button on their blogs just a wee bit too prematurely over these headlines - (1) The vegans/vegetarians who may actually know a little something about eating good food, and have a passion for great health, yet are too motivated - perhaps politically - too see through the 40-year facade of the federal dietary sham, and (2) Bloggers who know absolutely nothing about health and wellness, let alone nutrition, and couldn't care less, except they carry a schizophrenic vendetta against people who are passionate about health and wellness and carry the torch for the paleo-primal lifestyle (you know, us nuts who advocate for such atrocities as real food, voluntary trade that is free from the force of the government's criminal agencies, and food freedom).

Many folks sent me the link and asked, "When are you going to blog on this?" For starters, I didn't have the time. But then again, I waited, because I knew the ancestral health community would light up the switchboard of ignorance with a spark of sagacity that would render the media blitz and bozo blogosphere impotent, like farts in the wind. And they didn't disappoint.

This was an observational study, where participants filled out food frequency questionnaires (here is a link to the questionnaire) every four years and lifestyle and medical data questionnaires every two years. Certainly, people are very honest and have a tremendous capacity for remembering what they ate two days ago, let alone a year ago.?First,?there is Robb Wolf, who referred to the red meat scaremongering as "nutritional McCarthyism."?Gary Taubes also commented?on the horrendous science behind the study:

The problem with observational studies like those run by Willett and his colleagues is that they do none of this. That's why it's so frustrating. The hard part of science is left out ?and they skip straight to the endpoint, insisting that their interpretation of the association is the correct one and we should all change our diets accordingly.

In these observational studies, the epidemiologists?establish a cohort of subjects to follow (tens of thousands of nurses and physicians, in this case) and then ask them about what they eat. The fact that they use questionnaires?that are notoriously fallible is almost irrelevant here because the rest of the science is so flawed. Then they follow the subjects for decades --?28 years in this case. Now they have a database of diseases, deaths and foods consumed, and they can draw associations between what these people were eating and the diseases and deaths.

The end result is an association. In the latest report, eating a lot of red meat and processed meat is?associated?with premature death and increased risk of chronic disease. That's what they observed in the cohorts -- the observation.

...An association by itself contains no causal information. There are an infinite number of associations that are not causally related for every association that is, so the fact of the association itself doesn't tell us much.

Taubes calls these observational studies "the equivalent of conventional wisdom-confirmation machines." And then there is Denise Minger, guest writing for Mark Sisson's blog,?who put the entire drama to rest with her relentless pursuit of science?in the midst of a media blitz touting what she calls "ultimately wobbly, imperfect, and tragically inconclusive observational data."?Denise notes that this was a "garden-variety observational study, not an actual experiment where people change something specific they're doing and thus make it possible to determine cause and effect." Yet the researchers drew absolute conclusions from their disturbingly unscientific study.?Says Denise:
The lead researcher Frank Hu?claimed the study?"provides clear evidence that regular consumption of red meat, especially processed meat, contributes substantially to premature death," despite the fact that the study is innately incapable of providing such evidence. It's as if someone?pulled a Campbell?on us. Only an actual experiment,?with controls and manipulated variables, could start confirming causation.
There are a couple of other thrashings worth mentioning, and?the most notable of those is from Zoe Harcombe. She does a deep dive on the data and points out seven fatal flaws of the study, with one of them being the following:
As I always consider conflict of interest, it would be remiss of me to end without noting that one of the authors (if not more) is known to be vegetarian and speaks at vegetarian conferences[ii] and the invited 'peer' review of the article has been done by none other than the man who claims the credit for having turned ex-President Clinton into a vegan -- Dean Ornish.[iii]
The?Caveman Doctor also published a nice piece?on how the study was fraught with error and bias.

Medical and legal experts launch new call for an inquest into the death of Dr David Kelly

*** Amid new calls for an inquest into the death of WMD expert Dr Kelly, certain sections of the media are promoting suggestions that Iraqi agents could have been responsible, citing an official source at a UN agency with known links to US/UK intelligence agencies. However, an operation by Iraqi agents is extremely unlikely, and would not explain why it was made to look like suicide. If Iraqi agents were responsible, this also does not explain why the spurious suicide conclusion was reached by the Hutton inquiry, or why the UK authorities actively concealed evidence and staged a cover-up. ***

New call for Dr David Kelly inquest

A group of experts have renewed calls for a formal inquest into the death of government scientist Dr David Kelly.

They say the official cause of death - a haemorrhage - was "extremely unlikely" in the light of new evidence.

The claim comes in a letter from eight senior figures, including a coroner, published in the Times newspaper.

Dr Kelly's body was found in 2003 near his Oxfordshire home after he was exposed as the source of a BBC story on the grounds for going to war in Iraq.

Instead of a coroner's inquest, then Prime Minister Tony Blair asked Lord Hutton to conduct an investigation, which found Dr Kelly committed suicide.

Lord Hutton's inquiry found the 59-year-old died from blood loss after slashing his wrist with a blunt gardening knife.

The letter's signatories include a former coroner, Michael Powers, a former deputy coroner, Margaret Bloom, and Julian Bion, a professor of intensive care medicine.

They say Lord Hutton's conclusion is unsafe. They argue that a severed ulnar artery, the wound found to Dr Kelly's wrist, was unlikely to be life-threatening unless an individual had a blood-clotting deficiency.

"Insufficient blood would have been lost to threaten life," they write.

"Absent a quantitative assessment of the blood lost and of the blood remaining in the great vessels, the conclusion that death occurred as a consequence of haemorrhage is unsafe."

Obama's Very Real Death Panel

by Anthony Gregory

It?s official. The American dystopia is here. Obama administration officials admit that the CIA assassination program that snuffed out Anwar al-Awlaki last Friday is guided by a secret panel that decides who lives and dies. According to Reuters:

American militants like Anwar al-Awlaki are placed on a kill or capture list by a secretive panel of senior government officials, which then informs the president of its decisions, according to officials.

There is no public record of the operations or decisions of the panel, which is a subset of the White House's National Security Council, several current and former officials said. Neither is there any law establishing its existence or setting out the rules by which it is supposed to operate.

Let that sink in. The U.S. presidency, supposed leader of the free world, has a clandestine committee that chooses American citizens to assassinate. This from the administration that promised unprecedented transparency and a ratcheting back of Bush-era civil liberties abuses. This from the president who vowed to restore habeas corpus and subject executive war powers to judicial scrutiny. This from the Nobel Peace Prize laureate.

What?s more striking, however, is the deafening silence. Sure, the ACLU opposes all this, as do a smattering of public voices. Yet it seems for everyone expressing proportional concern about this, there are a thousand leftist protesters whining about the top one percent, and a thousand conservatives whining about the leftist protesters.

How fitting that the presidency that Tea Partiers accused of planning to convene death panels to handle health care rationing has openly admitted to having created such a panel whose declared purpose is not simply to withhold socialized medical resources, but to direct the cold-blooded murder of citizens who are sufficiently bothersome enemies of the regime. Yet in a majestic irony, many of the conservatives who feared Obama?s life-and-death bureaucracies are cheering on his most explicit and frightening seizure of dictatorial power in all his presidency, and perhaps one of the greatest of all presidential power grabs in the sweep of U.S. history.

Meanwhile, Obama?s millions of supporters still think the idea that this man is a fascist, a tyrant, a threat to liberty, is hysterical hate speech and itself a danger to American democracy. Yet Barack Obama appears dedicated to out-Bushing Bush when it comes to shredding the Bill of Rights and sticking his middle finger at the very idea that he ought to be accountable to anything but his own power.

Make no mistake. We are witnessing a defining moment in America?s transformation into a totalitarian nation. Not because the murder of al-Alwaki, or even the death panel that sealed his fate, is some sort of anomaly in terms of morality or even presidential power. The U.S. presidency has already sentenced millions to death with its wars, its sanctions, its bombings, its terrorism, its covert ops, its torture chambers. The nukings of Hiroshima and Nagasaki, to take a couple of famous examples, long ago revealed the awesome and murderous power of the Oval Office, whether or not these bombings were as "illegal" as the offing of al-Alwaki. And the families of thousands of innocent Afghans and Pakistanis killed in drone strikes had no doubts about Obama?s imperial touch, even before this latest atrocity.

But the circumstances surrounding this particular hit job, and the death panel behind it, deserve more than a footnote. There is the brazenness of it all ? the audacity, as a younger Obama might say ? of the administration just coming clean about its mysterious council that serves as judge and jury behind closed doors. There is the frank admission of its existence with all else being kept secret. There is also the precision ? the fact that this program is one focused on offing political enemies, rather than just bombing neighborhoods in an ad hoc attempt to weaken another government in a war. There is also the open-ended nature of this conflict, a war on terrorism that can last even longer than the clash with the USSR, a war whose immortality seems even more possible now that Barack the law professor is in charge, rather than George the rancher.

Taken together, this is just the kind of creepy atmosphere befitting of a total state, a Communist or fascist government or a nightmarish bureaucracy contrived in the mind of a Cold War-era novelist imagining what America would look like in the 21st century after taking one too many wrong turns. It is almost as if the administration is trying to preempt the conspiracy-minded by giving them something that would be unbelievable only fifteen years ago, but is today easily taken for granted because of course the president has a secret death panel that deliberates on the secret, unchecked executions of American citizens, to be conducted by robots flying in the sky.

Needless to say, anyone who defends this, especially if given the opportunity to think through the implications, is surely no friend of liberty, whether they be fair-weather "civil libertarian" liberals who would rather cheer for their president than wake up and smell the fascism, or conservatives who claim to distrust government except when it exercises the most lethal powers in the most lawless way imaginable. We must recognize that the movement for freedom and against true oppression is clearly no majority, regardless of what Tea Party Republicans and Wall Street occupiers might say.

There is a more fundamental lesson to be learned, however, and one to remember for the ages: This is the nature of the state. It is, by its institutional nature, always and everywhere seeking to expand power in any way it can. To claim and practice the power to kill on its own unreviewable prerogative is simply the fulfillment of its very design. At times of crisis, especially concerning national security, states almost always tend toward aggrandizement toward their realization as totalitarian entities.

For all who find Obama?s death panel frightening ? and all of us should ? let us remember that this is simply what governments do when they can get away with it. We are only now seeing the American state achieving its maturity. At the founding of the Federal Government, the Framers unleashed a monster that could never easily be restrained, even creating a presidency with all too much power over military affairs. Then came Jackson, Polk, Lincoln, Wilson, Roosevelt, Truman, LBJ, Nixon, Bush and Obama, each one building on the horrible precedents of past American despots, each reaching further toward the ideal of a completely unencumbered presidential hand, one that could snap its fingers and order death to anyone anywhere on the globe.

There is a silver lining, however, albeit one circumscribing a large and dark cloud indeed. A government can develop and come of age, but it is a mortal institution. As it grows it puts strain on the public ideology it requires to live, wrecks the economy it feeds on, and alienates the allies that allow it to be a global empire. To be a total state is the dream of all regimes, but it is an unsustainable reality, and certainly so at the size the U.S. government has become. The more the U.S. presidency and American nation-state morph into an Orwellian version of themselves, the closer they will come to finally expose themselves as being no different from the tyrannies that have enslaved mankind for millennia. For generations much of the world has been under the spell of the lie of American democracy, the propaganda that the brutality of power politics can be tempered through elections and an eloquent piece of parchment. We can hope that the day this great lie is universally seen as a tragic joke, the true significance of Obama?s CIA death panel will be remembered.

Is is become official. The US government has just declared WAR on American citizens. The time is come folks. The time to "throw off such a government and provide new guards for our future security".

Jonathan Turley wisely noted, "Anyone who believes there are two parties in Washington DC is a fool. "

reuters, they want you to know.

government is a declaration of war, division of people.

tony blair was openly introducing star chambers, you set up a judicial system but to put in big fast turns one needs to usurp that process. sometimes it is done in circular loops eg asbos, since 1984 it was written into the judical process (PACE 1984) and it became the normal judicial process visible to me early this century, ie the british courts are star chambers.
http://www.williambowles.info/ini/ini-0356.html

dictatorships, ie police states are not someting you can sell as in 'do you want some'. there is something called due process, it is a blind alley for the lifecyle of the dictatorship, due process is what is due to the dictatorship which is everything and what is done maintains that line and march or the dictatorship becomes subject to reality and potentially the division of people collapses. sometimes they say 'due process of law', same game of cheat, the laws are the scribblings or mutterings of the dictatorship.

what is being shown is though not new except that is being shown and largely as a simulation. at the same time as this the overt war machine is being deconstructed.

nonsense isn't it?

what often happens, to maintain power they have a revolution, change of the guard. it used to be public programming for british people, tourists still watch the changing of the guard at buck house. when people watch presentations of history they can be distracted into not noticing they are living it, passive in their own lives.

if i asked people if they could do better than obama, that is a question some would perhaps regard as stupid. to step from public to state is to cross over a mirror, everything now reversed. there is a lot more than that if one is an 'actor of history', everything changes, everyone pulling you in different directions and the scripts you are given in this ceremonial role are protected by guards that keep you and people seperated, you and the script joined.

then of course there are the terrible things that are done to you that you are deemed ready to fool people on the world stage, public interference is typically minor by comparison.

likely the more people see the less they would want the task, the less they would even believe in the role. there is though behind that role a man who is in prison.

imagine what it is like having as part of your forced agenda, hurting tens of millions of people in your own country. people have someone to hate, that feeds to security, everyone loses.

Cheering for state-imposed death

Glenn Greenwald

At last night's GOP debate, Texas Gov. Rick Perry was asked by Brian Williams about the 234 executions of death row inmates over which Perry has presided?-- "more than any Governor in modern times"-- and the mere mention by Williams of this morose record triggered an outburst of cheering and applause from the audience:

This episode is creepy and disgusting, though as both Ta-Nehisi Coates and Dahlia Lithwick point out, it's hardly surprising for a country which long considered public hangings a form of entertainment and in which support for the death penalty is mandated orthodoxy for national politicians in both parties. ?Still, even for those who believe in the death penalty, it should be a very somber and sober affair for the state, with regimented premeditation, to end the life of a human being no matter the crimes committed.? Wildly cheering the execution of human beings as though one's favorite football team just scored a touchdown is primitive, twisted and base.? ?

Family Sues School District In Student's Death

SAN ANTONIO -- At just 14, Derek Lopez was shot and killed last November.

The shooter was a Northside Independent School District police officer, who said he saw Lopez fighting with another student and began chasing him.

Now months later, that is all that remains clear.

"It was literally one punch thrown, that was it," Lopez's lawyer, Wallace Brylak, said.

Cops increasingly under siege after homeless death

By GILLIAN FLACCUS, GREG RISLING - Associated Press

FULLERTON, Calif. (AP) ? Until last month, the most pressing issues in this quiet Southern California suburb were whether to build homes on rolling hills north of the city, how best to preserve a historic movie theater and a downtown bar scene that got a little too popular for its own good.

Now, the historic city that's home to five colleges and a vibrant nightlife is the target of international outrage after a mentally ill homeless man died following a violent fight with six police officers that was captured on camera. In the video, 37-year-old Kelly Thomas, who suffered from schizophrenia, can be heard crying out for his father over the zapping sound of a stun gun.

The incident last month has ensnared Fullerton in an ever-widening array of state and federal investigations, resignations and rowdy protests ? and things promise to get worse for the city before they get better. The acting police chief last week ordered an internal investigation into an unrelated, but volatile confrontation last year after reviewing cell phone footage that appears to contradict sworn testimony given by police officers in court.
