NJ Man Arrested for Refusing to Hand Over Camera as "Evidence" After Cop Veers Off Road

A New Jersey man was arrested Thursday after refusing to hand over his video camera to a cop, who insisted he needed it as ?evidence,? even though case law makes it very clear that citizens do not have to give up their footage unless their camera was used in the commission of a crime.

You would think a detective from the prosecutor?s office would know better.

But then again, cops make up their own laws when trying to protect their own.

After all, the so-called evidence demanded by detective Dave Margentino from the Ocean County Prosecutor?s Office involved a fellow cop who had veered off the road in a single-car accident, needing to be airlifted to the hospital.

Andrew Flinchbaugh, 23, was video recording the aftermath of the accident, standing well out the way of police and rescue officials, recording the victim being loaded onto the copter as well as the copter taking off.

After about 30 minutes, just as he was about to make his way back to his car, Margentino walked up and demanded his camera, telling him, ?I?m not going to negotiate.?

Typical thug behavior that has become so prevalent in law enforcement these days.

After ten minutes of Flinchbaugh refusing to succumb to his demands, offering to allow the detective to copy his footage, even providing identification though he was not legally obliged, Margentino arrested him.

Once jailed, Flinchbaugh never gave them consent to search his camera and they never asked, but when they returned the camera upon release a few hours later, it appeared as if they had scrolled through his footage, which is illegal to do without a search warrant.

Damn the Evidence, Just Arrest that 11-Year Old!

The parents of an 11-year-old Canfield girl cleared of false rape charges is suing the city, police department and investigators for $5 million, alleging investigators pursued the case because of political connections even after they learned the accusations were false.

The parents alleged in a lawsuit filed Tuesday in U.S. Northern District Court in Youngstown that Canfield Police Chief Chuck Colucci pressured investigators and juvenile prosecutors to pursue the case against the girl despite investigators believing that her three accusers were lying to get her in trouble.

Colucci ?in turn applied political pressure to Detective McGivern, demonstrating to McGivern that this prosecution was a personal priority of the chief?s that would affect McGivern?s career at the Canfield Police Department if he did not listen to? him.

The suit says police questioned the girl April 20, 2012 for about five hours without food, water or rest. ?

The girl was arrested April 24, rape charges were filed against the girl and she was taken to the Juvenile Detention Center ?without her parents even having a chance to say goodbye,? the suit alleges.

One of the accusers later told police they conspired to lie during the investigation, yet the case against the girl continued the suit says.

Arizona Police Officer Caught Hiding Evidence In His Garage, Lying About It -- Keeps Job

A Tempe, Arizona police officer caught hiding evidence in his garage and lying about it will get to keep his job thanks to a ruling by Tempe police chief Tom Ryff.

TEMPE, AZ (CBS5) - An internal investigation revealed a Tempe officer flat out wasn't doing his job. Reports show he knowingly botched 10 cases.

During the investigation, Officer Tony Trow admitted he was taking evidence home and keeping it in his garage. It was also discovered Trow put off writing a murder report for five years.

[...]An internal investigation revealed from September 2004 to March 2012, Trow stored evidence from five cases in his garage to hide his unfinished work. That included case notes, crime scene photos and even original recordings of interviews. The report from that investigation said those items had been tossed together in cardboard boxes.

It was also discovered Trow didn't write nearly a dozen reports, some dating as far back as 2007.

The report showed Trow also didn't bother to turn in the rape kit of a 17-year-old.

Not only should this cop be fired, he should be criminally charged for tampering with evidence.

Dark Knight Shooting: More Evidence The Government Can't Protect You

Libertarians are frequently demonized and accused of supporting a state of lawlessness where everyone must "fend for themselves."

In fact, it's statism which creates a situation of lawlessness and "anarchy," in the negative sense of the word, because rather than people have full knowledge they must fend for themselves, they think the government will protect them. A task which, like keeping health insurance prices low, keeping drugs and weapons out of prisons, "managing" the economy, etc., the government fails at miserably. I believe such a failure was on display with today's Dark Knight shooting.

Just a few days ago there was a widely covered story when a 71-year-old man shot some robbers who entered an internet cafe armed with guns:

Fortunately, the older gentleman had a gun and was able to defend himself and everyone else from the armed robbers. One 71-year-old man did what the government could not. Imagine if such a situation occurred today at this Dark Knight shooting! If only one person had a gun the chances that Colorado shooter James Holmes would have been killed and more people would have survived would have been exponentially greater. The more people who had weapons, the easier it would have been to kill him.

Was no one armed? Are guns even allowed in the theatre? I'm not familiar with Colorado's gun laws, but any laws restricting what people are "permitted" to own by their rulers in the government are too many. Even if they had no restrictions on gun ownership (they do), the implicit false sense of protection the government gives people leaves people more exposed to danger because they assume "the government will protect them" and they do not have to "fend for themselves."

Of course, there was no police there to protect the people above in the internet cafe, nor was there any police to protect those during the Dark Knight shooting. As anyone who follows this site knows, the police generally act as revenue collection agencies for the state, violating people's rights just like armed robbers, rather than act to protect people from criminals, they act to protect the criminal state from the people.

The "government," or the people who call themselves "the government," are more likely to violate your rights than any random criminal, yet for the most part it's entirely illegal to defend yourself against government robbery and any state sanctioned "use of force."

To depend on these people for "protection" is foolish to the extreme, those who believe such nonsense put us all in danger.

Compare the facial expression of the "Batman Shooter" taken after his arrest, with the facial expression of the "Tucson Shooter" who nearly killed a Congresswoman. they appear remarkably similar - a strange wide-open, but glazed look to the eyes, a satisfied smirk, etc.

One might conclude that both were given the same drugs, whatever those could be, in a form of mind control more commonly associated with an intelligence agency, some of which happen to have university programs for recruiting students.

And even more strange is that Congress has the U.N. Small Arms Control Treaty under consideration and before this shooting, they lacked several votes for it to be enacted into law.

Operation "Fast and Furious" may have been the original false-flag operation to convince Congress to enact the U.N. gun confiscation treaty, but it failed, so perhaps this mass shooting is "Plan B" from the intel community.

This staged event/drill was a fraud/hoax. Watch the interviews, look at the photos, use your common sense. The same people and photos over and over again. Umm he was wearing a full bulletproof set up so had someone had a gun and was able to use it, the chances of it being that helpful in a tear gassed room are slim to none.

Police Arrest Woman For Filming Them, Take Phone Out Of Her Bra, Claim That It Must Be Kept As 'Evidence'

In the comments to our story last week about false arrests for filming police, someone pointed to yet another such story of a woman who was arrested for filming the police. Even worst, the police confiscated her phone -- which she had shoved into her bra -- and then have refused to return it, claiming that it's now "evidence" of a crime.

If there's any "good" news in this story, it's that the police chief immediately ordered an investigation into the officer who did this, and noted that it's legal to film police. Still, the details of what happened seem pretty crazy. As reported by the New Haven Independent (linked above):

?Stop filming right now!? Rubino ordered her.

?No this is my civil right,? she recalled saying. Gondola said she?s ?always on all these news sites? reading about recent cases in which cops got in trouble for snatching cameras from citizens.

?Well, I have to right to review it,? Rubino allegedly told her.

Gondola claimed she remained ?very quiet and calm? and ?pressed play? to show him the video. ?But I didn?t let him touch my phone.?

Rubino?s response, according to Gondola: ?It?s evidence of a crime. You need to give it to me right now.?

Her response to his response: ?I?m not giving you the phone.?

His next response: ?If you don?t give me the phone, you?re getting arrested.?

So Gondola slipped the phone into her bra. Rubino ?twisted my hand hard behind me and put the cuffs on me. Really tight. My wrists are black and blue,? she said.

Rubino next ordered a female officer to pat her down and commanded, ?I want that phone out of her bra.? The woman removed the phone. Rubino ?put it in his pocket,? Gondola said.

The article, written a few days later, notes that later on she demanded the phone back, and was once again told that it was "evidence" and that the only way she can get her phone back is to wait until she goes to court, and asks the judge to return the phone. At the very least, it sounds like she will be without her phone for well over a week. In these days, when phones are pretty central to a lot of people's lives, that can be a pretty big hardship... all for doing something perfectly legal: filming the police on duty.

'Crystal clear' evidence that MTA worker didn*t try to run down cop

Lawyer says video footage shows John Hockenjos was wrongly arrested by NYPD

A police officer's claim that a Brooklyn man nearly ran him over is undercut by video footage that?s ?crystal clear? proof of a false arrest, a defense lawyer charged Friday.

MTA engineer John Hockenjos was collared and charged with a felony Sunday after Officer Diego Palacios claimed in a court document that the suspect's car almost smacked into him.

"Defendant did drive a four-door sedan at a high rate of speed into a driveway" causing the cop "to jump out of the way to avoid being hit by defendant's vehicle," according to the sworn criminal complaint.

But a night-vision surveillance camera that captured the incident - which happened at Hockenjos's Sheepshead Bay driveway - shows the car slowly pulls up near the officer, who does not move an inch.

Caught On Tape: Officer Threatens to Make Up Evidence After Arrest of Innocent Men

SEATTLE -- A Seattle police officer has been caught on tape talking about "making up" evidence while two wrongly arrested men sit in jail. It's the latest shocker uncovered by a KOMO 4 Problem Solver investigation into the Seattle Police Department's vanishing dashcam videos.

Josh Lawson and Christopher Franklin filed a claim against the city Monday for excessive force and wrongful arrest.

The two were arrested at gunpoint on November 16, 2010 and said the incident changed their lives forever.

"I thought I was gonna die," Lawson said about that night.

Franklin said it was "the most terrifying thing I've ever experienced."

Both men said they suffered facial bruises and swelling after one was kicked and the other man-handled into the pavement while being arrested. But then listen to what an officer says on an audio recording after he takes the two to holding cells: "Well, you're going to jail for robbery that's all."

You then hear Franklin ask, "for robbery?" And the officer responds, "Yeah, I'm gonna make stuff up."

Franklin believed him.

"He showed me that he has the power to do whatever he wanted that night," he said. "He has a badge, and all we can do is nothing."

The officer should have been fired, no just reprimanded. They were exonerated, meaning they did nothing wrong. The Sargent also needs to be fired. They are CLEARLY NOT PUBLIC SERVANTS any longer!!!! Fear fear fear. Obey obey obey.
