Legalize Drunk Driving

Most people have been there: a few drinks at a restaurant or bar and then into the car to get home. Am I over the legal limit? Hard to say. Is my driving impaired? It doesn't seem to be. But what if I get stopped? Will I lose my license, go to jail, and be disgraced in front of the community? It's a frightening prospect.

What's especially strange about this is the reason I fear. My arrest and punishment would not be for driving recklessly or for endangering other drivers. It would be because I failed a test of something that is not materially related to my actual driving.

The law is arbitrary and shifts with the political season. The perpetrators can't really be sure if they are over or under the limit. And we all have vast experience with people who drink surprising amounts of liquor and drive all the time, but never get in accidents and do not seem to be driving in an unsafe way.

Then there are the frequent cases in which cops arrest people for DUI who are stopped for something else, like a burned-out tail light. I've known of people who have been arrested in their own driveways, having gotten home safely and harmed no one. They are arrested and imprisoned, a humiliating and terrible experience for anyone to go through.

Clearly, this DUI enforcement has been a boon to the police but has it really curbed drunk driving? You might consider staking out your local bar, following how much people drink, and observing how many get in cars after. I'll just state what most everyone knows but hardly anyone says: drinking and driving is a national sport in the U.S. In the vast, vast majority of cases, no harm is done.

Murray Rothbard once told me that he thought drunk driving should be legal. I was stunned and shocked that anyone would say such a thing. But over time, I began to see his point. It is not outrageous at all.

He was exactly right.

With laws against DUI, what's being criminalized? Not reckless driving as such. Not aggression against anyone. What's being criminalized is the chemical make up of the blood in your body. That itself should be no crime. To make having a certain blood content illegal is essentially totalitarian.

But you say that drinking is associated with bad driving. Well, enforce the laws against reckless driving. Many more people drink and drive than drive recklessly. Some people drive even more safely after a few drinks, correcting for their delayed responses. We do this all the time, e.g. after a workout, when we are sleepy, when we are angry, whatever. Human beings adapt with rationality.

And you know what happens on New Year's some other holiday. People always say "be careful, there are lots of drunk drivers out there." Just the prospect alone makes everyone drive more defensively.

Regardless, the law has no business criminalizing associated peaceful behaviors rather than real crimes against person and property.

For example, grudges are associated with murder in the sense that a vast number of murderers are carrying a grudge. Do we make grudges illegal? That would be crazy and unenforceable, even if there were some chemical way to measure what constitutes a grudge. But we make driving under the influence illegal though it is roughly the same thing. It targets an associated condition rather than the crime itself.

Laws against drunk driving have vastly expanded police power and done nothing to stop the practice. The best prevention against unsafe driving from drinking has been provided privately: friends, services offered by bars and restaurants, community interest groups, etc. This is the humane and rational way societies deal with social risks. The police have only messed up this process by adding a coercive element that targets liberty rather than crime.

And we can see where this is heading. Texting is now illegal in most places. So is talking on the phone. Maybe talking itself should be illegal. Some communities are talking about banning eating. All of this is a distraction from the real issue.

As Radley Balko has said:

If our ultimate goals are to reduce driver impairment and maximize highway safety, we should be punishing reckless driving. It shouldn't matter if it's caused by alcohol, sleep deprivation, prescription medication, text messaging, or road rage. If lawmakers want to stick it to dangerous drivers who threaten everyone else on the road, they can dial up the civil and criminal liability for reckless driving, especially in cases that result in injury or property damage.

Doing away with the specific charge of drunk driving sounds radical at first blush, but it would put the focus back on impairment, where it belongs. It might repair some of the civil-liberties damage done by the invasive powers the government says it needs to catch and convict drunk drivers. If the offense were reckless driving rather than drunk driving, for example, repeated swerving over the median line would be enough to justify the charge. There would be no need for a cop to jam a needle in your arm alongside a busy highway.

Scrapping the DWI offense in favor of better enforcement of reckless driving laws would also bring some logical consistency to our laws, which treat a driver with a BAC of 0.08 much more harshly than, say, a driver distracted by his kids or a cell phone call, despite similar levels of impairment. The punishable act should be violating road rules or causing an accident, not the factors that led to those offenses. Singling out alcohol impairment for extra punishment isn't about making the roads safer. It's about a lingering hostility toward demon rum.

As I understand, the major force promoting DUI punishments is MADD, Mothers Against Drunk Driving. It's so powerful that Google put MADD as the 1st hit as soon as I typed word "mothers", think about it. From what I heard, political pressure by MADD far exceeds anything that could be subject of the logic and common sense. MADD is famous for spending basically nothing on actually pushing their cause and almost everything on "expenses," aka salaries etc.

It took almost a month, but the young punk cop who tasered a 76-year-old man for questioning his questionable traffic stop has finally been fired, the Victoria Advocate reports.

The cop, 23-year-old Nathanial Robinson suspected 76-year-old Pete Vasquez of driving a vehicle with expired tags. In fact, Vasquez was driving a new car, all of which are exempt from having fresh tags, which Vasquez pointed out at the time he was stopped. Rather than check the law, Robinson responded by violently attacking and tasing his elder, throwing him to the ground and tasing him twice before placing him under arrest.

While the police chief criticized Robinson's actions at the time and said they would investigate, no details nor follow up was released until just yesterday. Here's an excerpt from their press release, which you can read in full here:

Chief Craig has announced the findings of the internal affairs investigation regarding Officer Nathaniel Robinson. Chief Craig has determined based on the evidence, that Officer Robinson violated three areas of policy and sustained allegations regarding violations of the following departmental policies.

1) Policy 0.216 - Conduct and Performance, Section 2.15
2) Policy 03.03 - Use of Force Section 1
3) Policy 0.0305- Arrest without a Warrant Section 3

Based on the findings of the administrative investigation, Nathaniel Robinson?s employment with the Victoria Police Department has been terminated.

Kudos to the police chief for doing what's right, including for faulting the officer for his false arrest.

Frankly, I find it abhorrent the mere idea a 23-year-old young punk could think a badge and a gun gives him the right to boss around a 76-year-old man because he has "expired tags."

It reminds me of a story about the late Steve Jobs. Jobs would buy a new car every six months to take advantage of a California law which makes you exempt from having to have a license plate for six months. Ever since I heard that story, I've thought about how any young punk rookie cop could pull over the great Steve Jobs and potentially put him through hell for not having a license plate, despite being entirely in the wrong.

The late H. L. Mencken believed government as an institution was a conspiracy devised by inferior human beings to rule over their betters. As he wrote back in the year 1919,

"All government, in its essence, is a conspiracy against the superior man: its one permanent object is to oppress him and cripple him. If it be aristocratic in organization, then it seeks to protect the man who is superior only in law against the man who is superior in fact; if it be democratic, then it seeks to protect the man who is inferior in every way against both."

As one who chronicles stories of government abuse, which is mostly carried out by low-grade morons such as officer Robinson, this strikes me as accurate.

Of course, in the case above, there's a good chance Robinson will be rehired, with back pay, once his moron protection agency, a.k.a. the police union, files an appeal to get him his job back.

Link 173190As the young cop obviously recently went through his education and training process to be qualified as a cop, we must conclude the cop knew his legal limitations, and the citizen's civil rights. Whenever a cop willfully violates a citizen's civil rights, he is no longer protected by 'qualified immunity' and is exposed to be personally liable. His insurance company would raise his premium, just like a driver who has been at fault in an accident. This cop is recently graduated and I can guarantee he was briefed upon Supreme Court case Castle Rock v. Gonzales. In 2005 the SC ruled that it is NOT the duty of police to serve and protect. This court ruling is probably the underlying cause of the upward incidents of violence against the public. New cops know they will never be held accountable for harm, destruction of property or death when they dish it out. However, what happened here was there were too many crimes and gross ignorance of the law and firing the cop is probably a City decision to attempt to lessen the upcoming consequences when this man sues the cop and the City. Cop Fired After Driving Away From Fatal Shooting, Neglecting Duties to Spend Time With Her Cop Boyfriend

SAN ANTONIO, Texas - San Antonio Police officer Serena Botello has been fired and her appeal rejected after an investigation showed she went derelict on her duties 23 times in two months, often to spend time with a fellow SAPD officer who appears to be her live-in boyfriend.

In one case last March, rather than respond to a 911 call to help a 35-year-old man who shot himself in the head, Botello drove away despite being under a mile away and the closest officer to the scene.

Family members of the man said he died at the hospital hours later. Questions over how the case was handled lead SAPD to conduct an investigation into Botello's actions. After looking at GPS records from her vehicle, they determined she had spent over 36 hours from March 21 to May 15 "neglecting her duties."

Investigators found Botello spent some of this time with another SAPD officer, whom they later determined she was living with.

Botello's termination papers noted she violated SAPD's regulations concerning ?relationships with co-workers,? ?alertness required of members,? and ?on-duty activities.?

Botello had been issued two separate suspensions in December 2012, one for 20 days, and another for 30 days. KENS 5 reports a source familiar with her service records said at least one of those suspensions was for "failure to respond," yet she wasn't fired at the time and was allowed to keep her job.

The United States Of America used to stand for something across the world, something good, something people aspired to, something people looked up to, a true democracy. Sober Woman Framed With 'Drunk Driving' Charges After Cop Crashes Into Her Vehicle

The victim of a horrible accident was charged with OWI to cover for a deputy's faulty driving.

MILWAUKEE, WI ? A young woman had her neck broken in four places after her vehicle was T-boned by a police officer who blew through a stop sign.? Even though she was completely sober, the police charged with drunk driving and tried to shift the blame onto her instead of the party at fault.? When evidence surfaced that showed her innocence, it was hidden and ignored.? The deputy responsible was never punished.

Terrible Crash

Tanya Helena Weyker, 25, had never been accused of a crime, nor had she even so much as had a speeding ticket.? Her life changed forever the night of February 20, 2013, when her Toyota Camry was slammed by a Milwaukee County Sheriff?s deputy and was sent spinning into a tree.

?I was just driving straight and he hit me,? remembered Weyker in an interview with WITI.? ?It was just a miracle I wasn?t paralyzed.?

Deputy Joseph Quiles had broadsided her, mangling the vehicle and causing her life-threatening injuries.? The crash was so violent that it broke her neck in four places.?? Her passenger suffered a ruptured spleen.

Ms. Weyker was in critical condition, yet the responding deputies did not miss the opportunity to manufacture reasons to ruin her life and lock her in jail.? Quiles?s colleagues used Weyker?s ?glassy? eyes as evidence of drunk driving, along with the claim of a ?light odor? of alcohol.

"I explained to him my eyes were red and glassy because I was crying," Ms. Weyker explained.? "They made me into this criminal."

On the police report filed by Deputy Scott Griffin, the alleged ?victim? was recorded as fellow deputy Joseph Quiles.? The report claimed that Weyker made conflicting statements and did its best to make her look like a criminal.

Charges and Injuries

To go with her terrible injuries, Ms. Weyker was slammed with 5 crimes:
Unreasonable and Imprudent SpeedOperating While IntoxicatedOperating with PAC >= 0.08 < 0.10Causing Injury While Operating While IntoxicatedCausing Injury While Operating with PAC alcoholWeyker miraculously survived the ordeal, but she had a tough recovery ahead of her.? A month after the crash, Weyker was in desperate shape.? She had drifted down to an incredibly low body weight of 76 pounds on her 5?6? frame.?? She was so weak that doctors said she required a feeding tube.

Her condition was complicated by the fact that she was a cancer survivor since the age of 3 years old.? As a child, doctors gave her so many doses of radiation that her spine began to curve, so they inserted metal rods into her back to keep it straight.? She had been living with these rods for many years at the time of the crash.

Unable to work, crippled, and drowning in medical bills approaching $1 million ? Ms. Weyker also had to pay for legal services to defend herself from the Milwaukee County Sheriff?s Department.

What?s worse, the case wasn?t being dropped, even though the evidence was clearly on her side.? The night of the crash, Weyker was in no condition to give a field sobriety test, but her blood was drawn during hospitalization.? The test results came back proving that she had absolutely no alcohol in her system.

Justice Served?

It is unlikely that such treatment would have occurred to the victim of any other crash that did not involve a police officer.? With no tangible evidence for the charges, the Milwaukee County Sheriff?s deputy pushed the blame onto his victim to ?protect himself and his department,? according to Ms. Weyker.

Deputy Quiles himself was found to have changed his story.? In his official police report, he claimed to have made a complete stop at the stop sign.? Yet a surveillance video captured from the nearby airport showed that Quiles rolled right through it, striking Weyker?s vehicle.

The department obtained the surveillance video only days after the crash ? but it was kept hidden from Ms. Weyker and her attorney.?? Instead of revealing the evidence and dropping the manufactured charges against her, the department sent her threatening letters demanding money to pay for the accident.

Fortunately, the district attorney declined to pursue the charges against Ms. Weyker.? The Milwaukee County Sheriff?s Office seems to have an unaddressed integrity problem.

In a later internal investigation, Deputy Quiles was recorded admitting his own fault in the crash.? Despite this admission ? contradicting his original report ? he is still listed as an active deputy with the department, WITI News discovered.? He was never fired or officially disciplined for the fraudulent report that caused Ms. Weyker so much agony.

Federal Court Rules Stiff Driving Posture Is Suspicious Behavior

A panel of judges unanimously ruled that having hands at "ten-and-two" is suspicious enough to stop drivers inside the USA.

NEW MEXICO ? A federal appeals court has ruled that driving one?s hands at the ?ten-and-two position? is reason enough to pull someone over for further investigation.? No traffic laws have to actually be broken? Additionally, the court ruled that facial acne is reason enough to suspect the driver is a drug smuggler.

The incident took place on April 18, 2012, at roughly 7:45 p.m.? A border patrol agent driving down Highway 80 saw a white Ford F-150 heading the opposite direction.? This took place roughly 40 miles north of the U.S./Mexico border ? well inside the United States.

Although the truck was witnessed breaking no traffic laws,?Border Patrol Agent Joshua Semmerling claimed he noticed several things that drew his suspicions ? while passing the truck at 60 miles per hour.

First was the driver?s upright posture.? The female driver was sitting up straight with her hands properly located on the upper part of the steering wheel.? This was viewed as suspicious activity.

Secondly, the agent claimed that the truck?s tinted windows were suspicious.? It remains unclear how the agent saw driver?s posture through the ?suspicious? tint.

Lastly was the truck?s rear license plate ? which the agent claims to have observed in his rear-view mirror while traveling at a high rate of speed in the opposite direction.? He claimed that he noticed it was from out-of-state, another suspicious characteristic.

The agent decided to make a U-turn and stop the truck.

The driver identified herself as Cindy Lee Westhoven of Tucson, Arizona.? Agent Semmerling then used his keen crime-detecting skills to justify a search of her truck.?? He saw that Mrs. Westhoven had ?acne? on her face and claimed that it was grounds for suspecting her to be a methamphetamine user.

Mrs. Westhoven had already proven she was a U.S. citizen.? She had no warrants and had broken no laws, yet Agent Semmerling claimed that he believed she might be smuggling illegal aliens and/or drugs.?? When she refused to consent to a search, the agent used a drug K9 to sniff her truck.? The dog turned up a small amount of cannabis.? Westhoven was arrested.

Later in court, Westhoven?s defense tried to overturn the arrest due to the shaky ground which the stop was performed upon.? Her attorney argued that the evidence was obtained illegally.?? She was unsuccessful.

?Driving stiffly, having tinted windows, slowing down when seeing law enforcement, and driving in an out-of-the-way area may be innocent conduct by themselves,? Judge Scott M. Matheson, Jr., wrote for the appellate panel. ?But when taken together along with driving a vehicle with out-of-state plates in a mountainous smuggling corridor 40-45 miles away from the border, we conclude Agent Semmerling had reasonable suspicion Ms. Westhoven was involved in smuggling activity.?

The 3-judge panel on the Tenth Circuit U.S. Court of Appeals unanimously upheld the search, and rejected Westhoven?s motion to suppress the evidence.

The acceptance of such flimsy suspicions in court is the practical acceptance of zero need for any real indication of a crime occurring before any American can be stopped and searched by federal agents.

Judges are not weighing up the probability that a law has been broken , they are RULING the citizen & DICTATING what rights you do or do not have REGARDLESS OF THE CONSTITUTION.

Boarder patrol checkstops as far up as the middle of the boarder states.

So the only thing you do is stop citizens while the Hispanic Officers allow Hispanic illegals to sneak right in.

AND if we pushed all these agents down to the boarder, illegals wouldn't be getting in to need those checkpoints.

It's intentional misuse of manpower to pretend we're doing boarder patrol while keeping them as far from the boarder as plausibly believable.

Currently the paranoid drug users and smugglers are now buying pimple cream, keeping the window tint off, learning how to drive like a slacker, and using the main roads. The only suspicious thing was probably that he knows all the local junkies, and they didn't use his friendly neighborhood drug plantation gang to acquire their junk. And with all due respect, are we sure it wasn't something thrown in there, or planted evidence? No we don't. If we quit arresting people for cannabis the police could focus on serious crime.

Cop Filmed Playing Poker On In-Car Computer Driving During Rush Hour On Unplowed Road

The new year brought some 40,000 news laws into effect throughout the United States. In Chicago, one of those laws was a ban on using a cell phone while driving. The studies which showed such bans may lead to more accidents because people hide their phones below eye level rather than stop using them were ignored in place of political hysteria and the demand to "do something."

Incidentally, the people tasked with enforcing such a cell phone ban have dashmounted computers with huge LCD monitors in their patrol cars. As you can see in this video just posted to YouTube, some use these in-car computers to play online poker while driving in rush hour traffic on unplowed roads during the "polar vortex."

Cops engaged in such "typing while driving" incidents regularly crash into people while casually using their in-car computer. Here's a local news report out of Arlington, Texas showing it's an epidemic. Nonetheless, cops are explicitly exempt from all these distracted driving laws.

Trooper Fired For Cavity Searching Women In Bikinis Driving Back From Beach Reinstated, 'Was Just Following Orders'

Trooper Jennie Bui was just "following the orders of a senior officer" when she inserted her fingers into two womens' privates in two outrageously invasive body cavity searches on the side of the highway, so Texas Department of Public Safety Director Steven McCraw gave her her job back.

While "I was just following orders" was found to be an indefensible position during the Nuremberg Trials after World War II, when it comes to the Texas DPS, knowing you will blindly follow any order no matter how criminal makes you more than qualified for the job.

Department of Public Safety Director Steven McCraw reinstated a female officer who was sued and placed before a grand jury after she conducted a body cavity search on two females stopped for speeding.

McCraw pointed out that the Brazoria County grand jury declined to take action against Trooper Jennie Bui. The trooper was fired in June after ?an extensive investigation? into the incident.

But McCraw said Bui was relatively inexperienced and was following the orders of a senior officer, Nathaniel Turner, who was initially suspended but since has been fired.

[...]?While the actions of Trooper Bui constitute misconduct, I believe her actions are mitigated such that she should not be terminated from the agency,? McCraw said.

He further said that, "Turner's conduct was unacceptable, and violated DPS policy and was outside any authorized training provided to Trooper Turner by DPS.?

I Feel sorry for the American people. It seems that the U.S. Gov't can use, ' I was just following orders, I didn't know it was against the law and It's a matter of national security, ' as a reason to commit crime. Nobody else can do that, why do you think you can get away with it. Good luck American people, you're going to need it. Nazis were "just following orders", too I am going to start using statist excuses in my daily life. "Citizen safety" will become part of my repertoire. "Based on my training and experience" will also be a key factor. Just think of the difference we could make if we all became a Citizen Peace Patrol armed with handguns and cameras streaming to Youtube and researched citizen arrest laws... Every time we observed police officers violate the law we could film them and effect a citizen's arrest. Oh, probably wise to keep some cash at home for bail money, but if enough of us did this it would make a difference.

Cop Shot Himself While Driving, Let Car Crash Into Oncoming Traffic

A Bladensburg police officer who died after a collision in Anne Arundel County had shot himself while driving, the Maryland medical examiner determined.

Officer Brian Johnson died from a gunshot wound to the upper body, and his death was a suicide, Anne Arundel County police officials said Monday, citing findings by the medical examiner's office in Baltimore.

The incident occurred about 9 a.m. Saturday on Route 100 near Catherine Avenue in Pasadena. Johnson shot himself while he was alone in his marked police vehicle, and his cruiser crossed the median and collided into a vehicle that was traveling in the opposite direction, police said.

Anne Arundel County police spokesman Justin Mulcahy said that "it's unusual" for someone to commit suicide while in a moving vehicle.

The driver of the vehicle that Johnson crashed into was treated at the scene and released. While police were investigating the incident, part of westbound Route 100 was completely closed for a few hours, and traffic on eastbound Route 100 was reduced to one lane.

Initially, it was thought he had experienced a "medical emergency" such as a heart attack. Fortunately, his victim escaped with his life.

North Carolina: Driving While Nervous is Not a Crime

The second-highest court in North Carolina last week ruled police had no business stopping a car because its occupants appeared to be driving while nervous. On April 15, 2011, a pair of Sampson County sheriff's deputies were running a speed trap on Interstate 40 when they noticed a green minivan. Corporal Bass and Pope each testified the vehicle slowed from 73 MPH to 65 MPH in the 70 MPH zone and that the driver and passenger stared straight ahead and "appeared nervous" as they passed.

The officers pulled out and caught up to the minivan. When the patrol car pulled along side, the minivan occupants did not make eye contact. The deputies claimed they saw the vehicle cross the fog line and was driving slowly, so they pulled it over for "unsafe movement." A dashcam video of the incident shows no crossing of the fog line or other evidence of unsafe driving.

Gina Canty, the driver, was given a warning. She also consented to a search that uncovered a revolver and a rifle in a suitcase belonging to the passenger, her ex-husband Nathaniel Canty. A Sampson County Superior Court judge found Nathaniel Canty guilty of being a felon in possession of a firearm. On appeal, a three-judge panel began poking holes in the police account of events.

"We find it hard to believe that these officers could tell Ms. Canty and defendant were 'nervous' as they passed by the officers on the highway and as the officers momentarily rode alongside them," Judge Cheri Beasley wrote for the court.

The judges also dismissed the idea that the minivan's slowing after seeing a patrol car running a speed trap.

"The reduction in speed standing alone could be explained a number of different ways, including normal apprehension many people feel when approaching a law enforcement officer," Judge Beasley wrote. "Nervousness, failure to make eye contact with law enforcement, and a relatively small reduction in speed is 'conduct falling within the broad range of what can be described as normal driving behavior... Based on the totality of the circumstances, these officers lacked reasonable suspicion to initiate the traffic stop that resulted in the search and seizure of the weapons in this case."

The judges declared the lawyer in this case should have filed a motion to suppress the evidence gathered during the traffic stop. Because the defense counsel was "ineffective," the three-judge panel ordered a new trial in which the motion to suppress would likely succeed.

Apparently, 99% of Mr. Sherlock Holmes' findings would also be ruled "insufficient". If police officers was able to _correctly_ detect the crime just by momentarily looking at the passing vehicle, they only can be commended for their skill.

Why would someone consent to the search of the vehicle, is totally different question. Especially knowing that illegal items will be found. First they allow search, then they scramble to suppress what was found. Wouldn't it be easier to simply say "No, I don't consent"?

Drug Sentences Driving Federal Prison Population Growth, Government Report Finds

In a report released Wednesday, the Government Accountability Office (GAO) found that growth in the federal prison population is outstripping the Bureau of Prisons' (BOP) rated capacity to house prisoners and that the bulge in federal prisoners is largely attributable to drug prisoners and longer sentences for them. That growing inmate overcrowding negatively affects inmates, staff, and BOP infrastructure, the GAO said.

The federal prison population increased 9.5% from Fiscal Year 2006 through FY 2011, exceeding a 7% increase in rated capacity. Although BOP increased the number of available beds by 8,300 during that period by opening five new facilities (and closing four minimum security camps), the number of prisons where overcrowding is occurring increased from 36% to 39%, with BOP forecasting overcrowding increasing to encompass 45% of prisons through 2018.

The drug war and harsh federal drug sentencing are the main drivers of the swelling federal prison population. The GAO reported that 48% of federal prisoners were drug offenders last year, and that the average sentence length for federal drug prisoners is now 2 ? times longer than before federal anti-drug legislation passed in the mid-1980s.There are also now more than 100,000 federal drug prisoners, more than the total number of federal prisoners as recently as 20 years ago.

The negative effects of federal prison overcrowding include "increased use of double and triple bunking, waiting lists for education and drug treatment programs, limited meaningful work opportunities, and increased inmate-to-staff ratios," the report found. All of those "contribute to increased inmate misconduct, which negatively affects the safety and security of inmates and staff." The report also noted that "BOP officials and union representatives voiced concerns about a serious incident [read: riot] occurring."

For this report, the GAO also examined prison populations in five states and actions those states have taken to reduce populations. It found that the states "have modified criminal statutes and sentencing, relocated inmates to local facilities, and provided inmates with additional opportunities for early release," the report found.

Noting that the BOP does not have the authority to modify sentences or sentencing, it nevertheless identified possible means for Congress to address federal prison overcrowding. It could reduce inmate populations by reforming sentencing laws or it could increase capacity by building more prisons, or some combination of the two.

Or it could remove drug control from the ambit of criminal justice altogether and treat the use and distribution of currently illegal drugs as a public health problem.

Marijuana Sobriety Checkpoints: New Legislation to Outlaw Driving While Stoned

Some will swear that marijuana has merit for motorists. Others fear impairment of any kind, at any level. We're pretty terrified of teen drivers, especially those with cell phones and hangovers, but we'll leave it to the government to intervene on this great debate.

Under a bill introduced last month by a SoCal assemblywoman, driving while stoned would result in an automatic DUI offense.

The proposed bill would tag this "offense" onto the section of the Vehicle Code that addresses drunk driving. The new section states that any level of "cannabinoids or synthetic cannabinoid compound" found in a driver's blood or urine, up to three hours after a traffic stop, would equate to a DUI, according to AB 2552, which was introduced by Assemblywoman Norma Torres (D-Pomona).

However,cannabinoids remain in the body for days or weeks after consumption, according to California NORML. If passed, Torres' bill would essentially criminalize outright operation of a motor vehicle by any marijuana user. So hopefully tokers know enough beer-drinkers skilled enough to stay under 0.08 to designated-drive them to work.

CLEARWATER, Fla. - The new law that requires proof of citizenship to get or renew your driver's license is an inconvenience to some of us, but one man in Pinellas County says it's a violation of his rights.

Adrian Wyllie, radio talk show host and chairman of the Libertarian Party of Florida refuses to provide the paperwork necessary to renew his expired license. He also refuses to stop driving.

"I believe I am in the position of right and the state needs to be corrected," said Wyllie.

Specifically, Wyllie opposes the federal Real ID Act that requires anyone getting or renewing a driver's license to provide proof of citizenship, address and social security number. In some cases, divorce papers and marriage licenses must be shown. Wyllie believes it violates his constitutional right against unreasonable search and seizure.
