New York Family Left Homeless After Police Rip Down Walls to Serve DWI Warrant

"She really has lost all the stability in her life in one fell swoop," a local pastor explained of the widow.

DANBY, NY ? A family has been left homeless after law enforcement agencies destroyed their entire house in the process of serving a warrant for a man for driving while intoxicated.

The home of David and Melissa Cady was condemned after armored police vehicles plowed through several walls while attempting to get 36-year-old Mr. Cady to surrender. A bench warrant had been issued after Mr. Cady missed a court appearance August 26, 2014, regarding his DWI conviction. On December 30th, 2014, a SWAT team moved in to make the arrest.

With the home at 127 Hornbrook Road surrounded, Melissa and the two children peacefully exited upon request. But David Cady did not, and police spent extensive resources to perform a lengthy standoff, resulting in his death.

?I?ve known him for like 12 years,? said friend and neighbor Dave McCarthy to the Ithaca Journal. ?He?s been a good neighbor, he?s got a wife, two nice kids, a dog.?

Police cordoned off roughly 20 other homes while besieging the Cady residence. Neighbors were not allowed to return after leaving their homes on the 1.7-mile stretch of restricted roadway.

Police suspected Mr. Cady was armed. On the evening of December 30th, police say that a single shot was fired. It was the only shot of the entire standoff.

After this shot, Mr. Cady stopped communicating with police. Police proceeded to break down the walls to with armored vehicles to ?restrict his movement,? and shot teargas into the house until 61 hours had passed, when they finally realized their suspect had died from an apparent self-inflicted gunshot wound.

Soon after, Danby Code Enforcement declared the home to be unlivable and condemned the property.

Resident Kory Watkins uploaded a video of the the Cady?s former house, which now features gaping holes and mounds of debris scattered across the yard.

Watkins captioned the video: ?All for a warrant. A violation of Probation for a D.W.I. and it took over 150 officers from over 18 agencies and military vehicles with more than 50 bombs of tear gas to end this like this?UNNECESSARY!?

The stunning turn of events left Mrs. Cady and her two children with no father and no home.

?She [Mrs. Cady] really has lost all the stability in her life in one fell swoop,? explained Pastor Ed Enstine of Danby Federated Church. ?She's basically lived her own life and worked and doesn't take handouts very easily, but in this case she's basically back to square 1 ? square 0, at this point.?

In a showing of charity, Pastor Enstine is organizing a fundraiser to help get the Cady family back on their feet. See details below.

The Ithaca Journal reported that over a dozen agencies were involved with the standoff, including Ithaca Police Department, Cornell University Police, Ithaca College Public Safety, Ithaca Fire Department, New York State Police, New York State Park Police, Cayuga County Sheriff?s Office, Pennsylvania State Police, Syracuse Police Department, Elmira Police Department, Broome County Sheriff?s Office, Onondaga County Sheriff?s Office, and Tompkins County Office of Emergency Management.

The straw that broke the camel's back. I bet they all went for a drink after. Lawyer For Cop Charged In Beating Death Of Homeless Man Claims Officer Didn't Use ENOUGH Force

The trial for two of the three Fullerton police officers charged in the beating death of mentally ill homeless man, Kelly Thomas, has begun. Manuel Ramos, the officer who first approached Kelly Thomas and delivered most of the damage, is facing charges of second-degree murder and involuntary manslaughter. Officer Jay Ciccinelli, who arrived on the scene moments later, is facing charges of involuntary manslaughter and use of excessive force.

Ramos' lawyer, John Barnett, sought to have charges against his client dropped last year, claiming the 10-minute-long ordeal that Thomas suffered through before lapsing into a coma (first, attempting to tell officers he couldn't breathe and, towards the end, crying out for his father) was a direct result of Thomas' reluctance to be further hassled by the officer.

When a "recalcitrant" Thomas did not comply, Ramos was entitled to use force and the threat of force to complete his arrest, Barnett contended in his 80-page motion.

"Rather than use actual force, Officer Ramos employed a lawful, conditional threat, to use force," he wrote. "The death of Kelly Thomas was not the natural and probable consequence of that lawful threat."

The recording shows Ramos relied almost exclusively on "force" rather than the "threat of force." As mentioned earlier, Ramos approached a seated Thomas before the beating commenced and said, "You see these fists? They are getting ready to fuck you up." That, I suppose, would be considered a "threat of force." Ramos wasn't kidding. His fists, along with his nightstick and additional abuse from a handful of other officers, completely "fucked up" Kelly Thomas, leaving him in an irreversible coma. Jay Cicinelli contributed in his own way, beating Thomas' face with the butt end of his Taser. (Cicinelli is captured on Ramos' mic stating that he "smashed [Thomas'] face to hell.")

There's really no questioning what happened. Security camera footage, synched to Ramos' mic, paints a brutally clear picture of how much Thomas went through before his body and mind gave out. Even the coroner's report notes the death wasn't accidental, listing "mechanical suppression of the thorax" as the cause of death. [The recording is 33 minutes long. The "altercation" begins about 15 minutes in. Five minutes later, there are six officers restraining Thomas. Warning: video, especially Thomas' anguished screams, is Not Safe For Life.]

John Barnett is still defending Officer Ramos. He's decided to top his earlier claims that the officer's actions were lawful and appropriate.

Ramos? attorney? told jurors that the officers who beat Thomas on a summer night in 2011 not only didn?t use excessive force in the incident, they ?weren?t using enough force.?

The officers were forced to call for backup because they could not subdue an out-of-control Thomas, John Barnett said. ?They?re losing the fight,? Barnett said.

Watch that tape again (or for the first time) and see whether it appears the cops are "losing the battle." Thomas, who weighed 135 pounds, was subdued by six Fullerton officers. The recording clearly captures him telling officers he can't breathe. Thomas was homeless and suffered from schizophrenia. While he wasn't cooperative with Ramos' instructions before he was beaten, he was still pretty far from being a threat. Last year, Barnett claimed the force was "appropriate." Now, he claims it was "too little." Officer Ramos apparently has no idea how to deploy an appropriate amount of force, despite his training.

Barnett continues:

?This case is not about a homeless, helpless, harmless mentally ill guy, this case is about a man who made choices in his life, bad choices that led to his tragic death,? Barnett said.

No one's arrest should end in death -- no matter what "choices" they've made -- not when six officers are looking to control one person. And for Barnett to claim that somehow choices the mentally ill Thomas made earlier in his life contributed to his death is not only disingenuous, it's genuinely sickening. If that's the case, then bad choices made by Officers Ramos and Cicinelli in their lives led to them being charged with manslaughter and murder.

This isn't about Kelly Thomas' life choices. This is about the choices made by a handful of officers -- choices that resulted in the death of a man whose life, what there was of it, came to a sudden halt because he ran into Officer Ramos and his backup.

This scenario is repeated by police 1000's of times across the landscape of America. Usually the costumed criminals are rewarded with a paid vacation, and unless a camera catches them in the act of murder and assault, their crimes go unpunished. Don't be fooled by this sacrificial arrest and charges. More often than not, police either get off entirely or receive only a small reprimand. These cocksuckers found a vulnerable young man on the street and murdered him. They should be electrocuted to death, slowly, in full public view. They don't respect you, your civil rights or your human rights. If police unlawfully attack you, you have the right to defend yourself and return fire yet no one ever does. In the military dictatorship of california, people need to start defending themselves yet they dont. this cop who murdered this homeless in a better world would become a code 10-00 because the people would not put up with such crimes against humanity.

As pacifist and afraid of law enforcement people are today, the american revolutionary war could never have happened because people would be so afraid of King George's troops/cops/peace officers that everyone would have bowed the knee in fear and ones who signed the decleration of independence would just been hung and this country would not be independent. Boy Whose Hot Dog Cart Was Shut Down by the City of Holland Now Homeless

Mayor says city took action after restaurants asked for "protection" from 13-year-old entrepreneur with disabled parents.

HOLLAND, Mich. ? Several weeks after a city zoning officer shut down his hot dog business, 13-year-old Nathan Duszynski and his parents are homeless.

The family was hoping Nathan?s hot dog cart could help them through a difficult time. Nathan?s mother, Lynette Johnson, suffers from epilepsy and his stepfather, Doug Johnson, has multiple sclerosis. Their illnesses have restricted them from finding permanent, full-time work.

The family receives about $1,300 a month in disability payments, Medicaid and food assistance. The three are having a hard time staying together. MLive confirms what the Mackinac Center learned Thursday ? Nathan and his mother are staying at the Holland Rescue Mission.

"Nate and I are now in a shelter," Lynette Johnson said. "Doug can't stay with us because he takes prescription narcotics to deal with his pain and the shelter does not allow him with those kinds of drugs."

She said the situation has been stressful on the family. Lynette is afraid to be away from her husband in case she has a seizure.

Nathan wanted to help out his family by selling hot dogs from a cart he bought with money he saved. He worked out an arrangement with the owner of a local sporting goods store to sell hot dogs in the parking lot. The owner of the store thought it would be a great way to attract customers and even offered Nathan a sales commission if he got people to rent his motorized bicycles.

The city of Holland, however, shut down the business 10 minutes after it opened, informing Nathan it was in the city?s commercial district where food carts not connected to downtown brick-and-motor restaurants are prohibited. The Mackinac Center?s coverage of the issue has drawn national attention.

Last week, Nathan and his family made an appeal to the Holland City Council. Mayor Kurt Dykstra defended the city?s ordinance, saying it was to protect downtown restaurant owners, who asked that the "success of the downtown district not be infringed upon by those who don't share in the costs of maintaining the attractiveness of that space."

Police Chase Over Drugs Ends With Man Crashing Into Schoolbus Full Of Homeless Children

A Shreveport man who fled from police, ended up crashing his vehicle into a bus full of homeless children, fortunately the children all survived with only minor injuries. The man says he is innocent, which is a bit ridiculous if you watch the video, but the real problem here is this chase could have been avoided if we were not living in a prohibitionist police state.

Via Shreveport Times:

Police say Smith crashed his Ford pickup into the side of the bus after leading officers on a June 5 high-speed chase that started at DiamondJacks Casino in Bossier City and ended with the crash at Murphy Street and Portland Avenue. Bossier City Street Crimes Interdiction Unit attempted to stop Smith near the casino, and that's when he fled. Smith was a suspect in a cocaine distribution operation, police say.

The accident sent 15 children, ranging in age from 4 to 16, to area hospitals. All the children, most of whom were homeless, were later released from the hospital with minor injuries.

The fact of the matter is more innocent people are harmed as a result of prohibition than are harmed as a result of the drugs themselves. Despite prohibition, drugs are still in massive abundance, and in fact they're hugely profitable to distribute specifically because of prohibition. To incarcerate someone over a drug crime not only denies that individual their personal freedoms, but it's done at massive cost to taxpayers as well, who have to foot the bill for these people to be jailed to the tune of $30,000 a year.

Wouldn't it be better to just let people smoke their drugs in peace?

Cops increasingly under siege after homeless death

FULLERTON, Calif. (AP) ? Until last month, the most pressing issues in this quiet Southern California suburb were whether to build homes on rolling hills north of the city, how best to preserve a historic movie theater and a downtown bar scene that got a little too popular for its own good.

Now, the historic city that's home to five colleges and a vibrant nightlife is the target of international outrage after a mentally ill homeless man died following a violent fight with six police officers that was captured on camera. In the video, 37-year-old Kelly Thomas, who suffered from schizophrenia, can be heard crying out for his father over the zapping sound of a stun gun.

The incident last month has ensnared Fullerton in an ever-widening array of state and federal investigations, resignations and rowdy protests ? and things promise to get worse for the city before they get better. The acting police chief last week ordered an internal investigation into an unrelated, but volatile confrontation last year after reviewing cell phone footage that appears to contradict sworn testimony given by police officers in court.
