Police 'Sorry' They Raided Wrong Home & Terrorized Innocent Children

A Framingham family was awakened Thursday by police breaking down their front door and forcing everyone to the ground at gunpoint after they conducted a drug raid at the wrong house.
Framingham and State Police were conducting a multi-jurisdictional drug investigation when the mistake occurred around 6 a.m. Thursday.
"They had me down on the hallway upstairs, my daughter was coming out of the shower, she didn't have [any] clothes on, they make her get down, my kids are on the floor," said Michelle McClain, whose apartment was raided.
She has five kids between four and 18 years old. Some, she says, have behavioral problems, making it hard for them to understand what happened.
"They were asking me 'why are they here, why are they doing this, what did we do?'", said McClain.
After police acknowledged their mistake they proceeded to raid the next door apartment and make an arrest. A Sergeant later returned to McClain to apologize. The town manager did as well.
"We acknowledge the mistake, we feel remorse and we offered an apology," said Town Manager Bob Halpin.

Framingham police killed an innocent grandfather in a similar raid three years ago.

Kids Traumatized, Have Nightmares After Cops Raid Wrong House

A Michigan SWAT team provided a small family fresh inspiration for nightmares after they broke down the door to the wrong home and turned the place upside down looking for drugs.

Police in Kalamazoo apologized for mistaking Jeremy Handley?s home for that of an armed drug dealer, and hoped giving his children stuffed animals would make up for the terror-filled night.

Handley, his wife Becky and his two children were home last Thursday when he heard sounds making him believe his home was being burglarized. His kids ran to hide in a closet, hoping the thieves wouldn?t find them.

?I thought it was somebody either trying to rob us, or hurt us,? Handley recounted to CBS affiliate WWMT.

He says police entered through the back door and ordered him and his wife to the floor, handcuffing and searching them.

?He had me sprawl out right here on the floor, and then he had me put my hands behind my back,? Handley said, pointing to the area in his home where police held him at gunpoint.

Handley?s kids were also ferreted out of the closet, claiming they "were staying quiet, because we thought they were bad guys coming in."

The Handleys were cuffed and interrogated for three hours, while police rummaged through their belongings looking for controlled substances, Federal Reserve notes and firearms. ?Every drawer, every cabinet, every piece of paper,? Handley says of the SWAT team?s thorough search.

Police were apparently more thorough during their search, rather than prior. When all was said and done, they realized it was their mistake, as they were looking for the tenant who used to rent the Handley?s home about a year ago, a man by the name of Chum.

?Do you know this Chum guy?? police asked, to which Handley replied, "No, I would never recognize him if I were to see him in the street."

The whole menacing affair badly traumatized the Handley children, leaving them emotionally scarred and with recurring nightmares. ?One dream was about Chum coming in our house with a gun, saying get on the ground,? Handley?s daughter told WWMT. ?It made me sad and scared."

Police raids on wrong houses are occurring with such frequency that one wonders whether the raids are being carried out as a means of intimidating the public, or if their intelligence can really be so bad as to cause this many frequent mistakes.

Just last week, we highlighted a SWAT raid in Bakersfield, Cali., where police also battered down the door to the wrong house and ordered a half-naked young mother to the ground as she was about to jump in the shower. They stormed apartment "A," but were supposed to have been at "B."

Two days prior, we also reported on a raid that took place in Richmond, Virginia, in which police terrorized a 75-year-old grandmother, binding her hands with twist ties and telling her she was under arrest as they searched her home for drugs. In that case, police were supposed to be at apartment "E," but went to "G" instead.

Despite their traumatic scare, the Handleys are lucky no one got hurt.

Back in 2012, we exposed a bungled early morning SWAT raid on a wrong home in Billings, Montana, that left a 12-year-old girl badly burned by a flashbang grenade. "A simple knock on the door and I would've let them in," the girl's mother Jackie Fasching told the Billings Gazette.

Judge Scolds Jury for Getting the Verdict "Wrong"

COLUMBUS (Carol Luper/Ken Hines) -- A Franklin County judge may be subjected to disciplinary measures after chastising a jury for reaching a not guilty verdict in an assault trial.
Judge Amy Salerno expressed her dissatisfaction with a jury's verdict in open court at the conclusion of a recent trial, according to four jurors, who complained about the incident to Franklin County Administrative Judge James Green.
"The judge came off the bench, and she indicated she thought they had gotten the verdict wrong," Judge Green said.
"They were further told, 99 percent of the time, the jury gets it right. It's now 98 percent. They brought that percentage down by getting it wrong."
One of the jurors who spoke to Judge Green was visibly upset while describing the actions of Salerno, who also stated that she was not done with the defendant that had been acquitted.
"They reported to me [that] she made a comment to them, it was okay because she would have another chance to get this defendant because he had other charges pending," he said.

Idiot Austin Cop Drives the Wrong Way Down a One Way Road

While the Peaceful Streets Project was out filming cops in the early morning hours of April 28th, 2013, we saw a cop turn onto a one-way road, driving the wrong way. We do not know if he did so to try to suck us onto the road so that they could ticket us, or if he did it because he is a low level moron.

Wrong Legislative Thought Of The Day: An Email Tax To Save The Post Office

There have been questions for quite some time now as to whether or not the traditional US postal system can survive the digital era. Frankly, the outlook isn't good, what with email replacing the sending of letters in large part and the postal service losing billions of dollars each year. The postal service itself tried to fight what I guess they thought was just a hip email trend by reminding everyone how terrible email is and how great letters are, or something. Sadly, it appears that campaign made little headway and the US mail system continues to look for a savior.

That's where Gordon Wozniak, Berkeley City Councilman and bad-idea generator, hopes to enter into the equation with his monumentally dumb idea of micro-taxing email, a service everyone uses, to fund the postal system, which nobody cares about.

Wozniak told the council: "There should be something like a bit tax. I mean a bit tax could be a cent per gigabit and they would still make, probably, billions of dollars a year? And there should be, also, a very tiny tax on email," perhaps one-hundredth of a cent. He said this would discourage spam and not have much impact on the typical Internet user. Wozniak went on to suggest a sales tax on internet transactions that could help, in part, fund "vital functions that the post office serves."

Let's set aside for a moment that the proliferation of spam blocking software and appliances has mostly erased spam emails for anyone interested. If Wozniak wants to propose tax law, he should at least familiarize himself with the relevant laws on the books, including the Internet Tax Nondiscrimination Act, which bans internet taxes entirely. Seems like kind of a big roadblock, no? Fortunately, Wozniak's idea is not only dumb, but it's also completely unworkable, as noted by Harvard Law School's Jonathan Zittrain:

"To the extent that the cheap flow of flat rate first class mail has positive effects for society at large, the insistence that the Post Office be revenue-neutral may not make sense," Zittrain said. "Taxing email as an alternative, however, is a terrible idea: bad in theory and truly unworkable in practice. There have been proposals to see fees imposed on email by service providers ? or recipients themselves ? as a way of minimizing spam, but to impose an external tax on it when there are ready substitutes (Facebook messaging, anyone?), and when collection would be a nightmare, seems a non-starter. There is no reason to tax electronic mail users in particular to save the Post Office, any more than it would make sense to tax coffee drinkers to do it."

In response, Wozniak said that despite not being an expert on internet taxes (wut?), he still thinks the idea deserves to be considered because "many billions of emails are sent every day [and] an email tax could raise substantial sums." By the way, he delivered that statement...wait for it...via email.

Well, I'm not a bad-idea tax expert, but since there are so many bad ideas generated every day, we could solve every financial crisis everywhere by taxing the hell out of bad ideas. Let's start with yours, Mr. Wozniak. After all, the postal service needs you.

Police Raid Wrong House, Kill Family Dog & Make Children Sit With Its Bloody Corpse

There are times when, despite the potential seriousness of a crime, a little compassion is in order for those and their families, for children cannot be held responsible for the crimes of their parents.

They especially should not be made to suffer if their parents are actually innocent of any crimes.

So it's with no small helping of disdain we bring you the story of a wrongly accused suspect whose family was made to suffer needlessly because a St. Paul, Minn., storm-trooper drug task force kicked in the wrong door.

According to a lawsuit filed in federal court in Minneapolis, members of the St. Paul Police Dept. drug unit broke down the door to the home of lead plaintiff Roberto Franco and shot the family dog before handcuffing all nine occupants - including three children - who were then forced "to sit next to the carcass of their dead and bloody pet for more than an hour." The suit states the anti-drug team continued to search Franco's property even after realizing they raided the wrong house.

It used to be, in America, that you were innocent until proven guilty. Even taking into consideration the dangerous nature of police work, the very act of storming someone's home to make an arrest presumes guilt more than it recognizes a potential danger, making goofs like kicking in the wrong door all the more heinous.

Adding insult to injury by cuffing kids and making them sit next to the family's dead dog is just despicable. You can't make this stuff up.

Try next door

The suit, filed against the officers of the Dakota County Drug Task Force, the St. Paul Police Department, and a federal Drug Enforcement Agency officer who was along for the ride apparently, claims essentially that the task force raided the wrong house, noting that the squad should have gone next door.

Lead plaintiff Franco, in the suit, said Officer Shawn Scovill, who led the raid, "provided false information to a Minnesota District Court judge in order to obtain a search warrant."

"Defendant Scovill lied when he informed the District Court judge who reviewed Scovill's search warrant application that Scovill had obtained information from the confidential informant that the plaintiffs' home was the properly targeted house and that the address and the identity of the individuals who resided therein were the plaintiffs," it says.

The complaint says the suspect named in the warrant is one Rafael Ybarra; Franco wasn't named in the search warrant at all, nor was anyone else living in the home, making the resultant hour-long search of his premises even more difficult to understand.

Officers charged with 'brutalizing' the family

"There was never a mention of the plaintiff, Roberto Franco, in any documents related to the raid search warrant," says the complaint, adding that Franco "had never been discussed or considered a suspect by law enforcement, Scovill, or any of the defendants directly or indirectly involved in the raid, relative to any alleged involvement by Franco in any distribution of contraband prior to the wrong house raid.

Officers burst through Franco's door on the night of July 13, 2010. The complaint said the team acted "negligently" in "raiding the wrong home," charging officers with "brutalizing" all of the home's occupants.

The complaint goes on to say that another plaintiff, Analese Franco, "was forced, virtually naked, from her bed onto the floor at gunpoint by officers," who breached the home "at gun and rifle point."

"Each plaintiff was forced to the floor at gun and rifle point and handcuffed behind their backs," the complaint says. "Defendants shot and killed the family dog and forced the handcuffed children to sit next to the carcass of their dead and bloody pet for more than an hour while defendants continued to search the plaintiffs' home."

The suit seeks $30 million in compensation for civil rights violations and punitive damages.

Family Says Police Raid Was Wrong & Vile from Top to Bottom

MINNEAPOLIS (CN) - After breaking down doors and shooting the family dog, a drug task force forced handcuffed children "to sit next to the carcass of their dead and bloody pet for more than an hour," and kept searching even after they knew they were raiding the wrong house, the family claims in Federal Court.

All nine occupants of the home, including three children, sued the officers, the state and Ramsey County in Federal Court.

Defendants include members of the Dakota County Drug Task Force, the St. Paul Police force, and a DEA agent.

Lead plaintiff Roberto Franco claims the task force raided the wrong house: that they should have gone next door.

Franco claims that Task Force Officer Shawn Scovill, who orchestrated the raid, "provided false information to a Minnesota District Court judge in order to obtain a search warrant. Defendant Scovill lied when he informed the District Court judge who reviewed Scovill's search warrant application that Scovill had obtained information from the confidential informant that the plaintiffs' home was the properly targeted house and that the address and the identity of the individuals who resided therein were the plaintiffs."

The complaint adds: The search warrant specifically named Rafael Ybarra as the intended target suspect. Plaintiff Roberto Franco was not named in the search warrant, nor was any person who lived in the raided house named in the search warrant.

Obama is Wrong about the Hoover Dam

In his famous "you didn't build it" speech, President Obama cited the Internet, fire departments, the GI Bill, the Golden Gate Bridge and the Hoover Dam as examples of government action that helps business owners.

Each needs addressing, but let's start with the Hoover Dam.

The president is riffing off of Rachel Maddow's MSNBC commercial in which the TV pundit dressed in her best black T-shirt and hoodie, points up at Hoover Dam and says words to the effect that the dam reminds us that an individual can't build a dam ? or a company, for that matter. It takes a country to build projects of this magnitude.

Having a soft spot for environmentalism, it's surprising Maddow embraces the concrete monster. At the time, Hoover described the dam as ?the greatest engineering work of its character attempted by the hand of man.?

The massive structure cost $49 million (or $736 million in inflation-adjusted dollars) and measures over 726 feet in height and more than 1,200 feet in length. It took five years and 4,360,000 cubic yards of concrete to build, and was finished two years ahead of schedule. About 16,000 people worked on constructing the dam, with over 100 losing their lives in the process.

There's nothing new about government throwing taxpayer money around to create jobs. The Romans constructed aqueducts in small towns, industrial sites and large cities from France to Istanbul.

To construct the aqueduct of Segovia, Spain, Romans stacked massive bricklike granite blocks into a structure that reached a height of over 93 feet. Although no one knows for sure, it?s estimated that the aqueduct was constructed sometime during the reign of either Emperor Vespasian or Nerva to transport water from the Fuente Fria River over 10 miles from the city. The aqueduct has 167 arches and reaches its height at the Plaza del Azoguejo.

The impressive Roman structure only serves to attract tourists to the city of 55,000 today. When I visited two years ago, our guide, Jerry, told us Segovia?s population did not warrant such an expenditure when it was built. ?The Romans primarily built the aqueduct as a show of power.?

Just as the Keynesian policies of the New Deal tried to cheat the laws of economics, government?s damming of the Colorado River attempted to cheat Mother Nature by bringing water to the desert southwest ? water that just isn?t and never was there.

The great Western explorer John Wesley Powell was booed out of the room when he told the Irrigation Congress, ?Gentlemen, you are piling up a heritage of conflict and litigation over water rights, for there is not sufficient water to supply the land.?

But 75 years ago, when the dam was nearly completed, FDR proclaimed during his dedication speech that millions of present and future residents of the Southwest could count on ?a just, safe and permanent system of water rights.? The turbulent Colorado River that vacillated between droughts and floods would be tamed and become ?a great national possession,? and be counted on for irrigation to support a human migration seeking mild winters and new opportunities.

?The nation took him at his word,? writes Michael Hiltzik, author of Colossus: Hoover Dam and the Making of the American Century. ?Since that dedication year, the population of the seven states of the basin has swelled by about 45 million. Much of this growth has been fueled by the dam and its precious bounties of water and electrical power.?

As Hiltzik points out, the dam?s water promise gunned the growth of Southern California cities and attracted farmers to the West to grow water-intensive crops like cotton, despite the lack of normal rainfall required to support this kind of agriculture.

Just as government stimulus programs and artificially low interest rates that promise to spur growth and make up for the lack of private investment never work, Hoover?s promise that his dam would, as Hiltzik writes, ?provide all the water their states could conceivably need to fulfill their dreams of irrigation, industrial development and urban growth? is literally drying up.

The water level at Lake Mead is down nearly 100 feet from its high water mark, revealing a white ?bathtub ring.? According to Wikipedia, the lake's water volume is just slightly half the amount the lake could hold at its maximum.

Now that millions have migrated to the Southwest and private industry has invested millions of dollars, Hoover's and FDR?s promises have confined those living and doing business in the West ?in the straitjacket of an ever-intensifying water shortage,? notes Hiltzik. And while Interior Secretary Gale Norton claimed to have stilled the ?conflict on the river? back in 2003 with the signing of two dozen agreements transferring water rights between various Indian tribes, cities and governments, the battle for water will rage on. The supply will never catch up with the demand.

After the 10-year drought, an additional intake pipeline into the diminishing Lake Mead is being installed. Almost 90% of the drinking water for Las Vegas comes from the lake. The new intake pipeline, officially known as Intake No. 3, ?will reach deeper into the reservoir to protect the valley?s water supply, should the lake shrink low enough to shut down one of the two shallower straws,? reports the Las Vegas Review-Journal.

The project targets 2014 for completion. "This new intake tunnel is 3 miles under Lake Mead, and then there is a tap of the lake about 3 miles out. I like to say it's as if you've got your bathtub full of water, and now we are putting the drain into it while it's full," says Vegas Tunnel Constructors (VTC) Vice President of Operations Jim McDonald.

The contract amount started at $447 million, but the cost has risen by over $100 million since the project began. The tunnel, after excavated for the pipeline, unexpectedly filled with water three times in the project's first six months.

Last month, excavation was delayed again when a VTC worker was killed 600 feet below ground when one of the tunnel segments was jarred loose, and pressurized grout was discharged, striking two of the workers.

Those in government never learn. They can?t print prosperity, and more water won?t magically appear if they dam a river. While the man on the street believes government infallible, politicians and bureaucrats cannot calculate the economic profits and losses of government interventions. Governments will forever fight over scarce water, and private use is increasingly being restricted by local ordinances.

?The spending for nonproductive public works, for the bureaucracy and for the Army led to excessive taxation, inflation and the ruin of the essential middle class and its leaders,? H.J. Haskell wrote in his book The New Deal in Old Rome, destroying the men French historian Leon Homo called ?the general staff of civilization.?

The New Deal dam project that Obama and Maddow are so proud of provided a few thousand jobs 80 years ago, but has spurred migration, farming and development that is likely unsustainable and may ultimately be, like the aqueduct in Segovia, just a giant tourist attraction. This is something future tourist guides will call "an example of American government power."

New Poll: Almost Everyone Thinks It's Wrong to Jail People for Pot

Via NORML, check out this new data from an Angus Reid Public Opinion poll.

Majorities of respondents in the three countries (Britain 56%, Canada 68%, United States 74%) welcome the concept of using alternative penalties?such as fines, probation or community service?rather than prison for non-violent offenders. At least seven-in-ten Britons (70%), Americans (74%) and Canadians (78%) believe personal marijuana use should be dealt with through alternative penalties.

?And yet I keep hearing people justifying Obama's medical marijuana crackdown on the grounds that voters will be impressed by his toughness. How much more evidence do we need that huge majorities support less punitive marijuana policies? It's time to bury the antiquated, idiotic myth that the public supports tough drug laws. It's false and it's been false for a very long time.

While at the Nashville Fair I saw 2 police officers catch a kid smoking a joint behind a truck... they gave him a lecture about the legality of the act... took his bag of weed and ground it into a mud puddle and let him go. I thought that was better than flooding the courts with what I considered a non crime.

Video Shows Sheriff Attacking A Deaf-Mute Throat Cancer Survivor Who Accidentally Entered Courthouse Through Wrong Door

The Calgary Sun reports:

Video showing a sheriff?s ?unjustified? and ?excessive? force on a mute, deaf man in a Red Deer courthouse has now been released.
On Dec. 9, cancer survivor Bill Berry, 52, was paying a traffic ticket when a sheriff told him he didn?t go through the proper security screening, as he had come in through an exit door.
Berry, who is deaf, mute and breathes through his neck with a tube, tried to signal that he couldn?t hear or speak, at which point the sheriff became more forceful and tried to carry him out.
Berry collapsed to the ground and his stoma tube fell out.
He was unable to breathe until other sheriffs noticed and reinserted it.
A probe conducted by the Solicitor General Office?s Law Enforcement and Oversight Professional Standards Unit, found the sheriff, identified as Thomas Bounds, was fine to advise Berry of his error but was unlawful in physically confronting him ?without hesitation.?
The report calls Bounds? use and level of force ?unjustified? and ?excessive?.
It also included an interview with Bounds, who said he tried telling Berry to go through security and he responded ?non-verbally by aggressively waving his arms, at which time I took control of him.?
Bounds went on to say a wristlock was ineffective so he ended up carrying Berry to the exit, adding he believed Berry?s actions posed a potential risk to people in the courthouse and he had to use force.

Surprisingly, the Canadian government actually fired him and they say he's "no longer a peace officer."

Here in America, he'd be looking at a raise.

FBI Uses Chainsaw To Tear Door Down In Terrifying Raid -- On Wrong Apartment

In a scene straight out of a horror film, the FBI used a chainsaw to tear down a woman's door in a terrifying drug raid, all on the wrong apartment. The innocent mother was ordered to the ground, all while her 3-yr-old daughter screamed in horror in another room. Her puppy dog who was next to her urinated itself out of fear and the mother lay still soaked in her urine, too terrified to move lest risk being killed.

This was the outcome of an FBI raid which had been in the works for two years, yet the FBI got the wrong house and terrorized an innocent 3-yr-old girl, her mother, and their puppy in the process.

CBS reports:

FITCHBURG (CBS) ? It?s going to be a while before things get back to normal for Judy Sanchez and her three-year-old daughter.
[...]At 6:04 last Thursday morning, just before Sanchez? alarm was set to go off, she heard a pounding outside her second floor apartment.
?I just happened to glance over and saw this huge chainsaw ripping down the side of my door,? she explains. ?And I was freaking out. I didn?t know what was going on.?

How is this different from the acts of the gestapo? This was all done over the consumption of meaningless plant products people consume for personal enjoyment. At least with the Nazi's, they thought Jewish people were some evil devils out to destroy the world, the FBI is doing this all over some inanimate plant substances.

Meanwhile, how many other people had their doors chainsawed down? Is it not just as horrible the mortal terror those people suffered because they happened to be "guilty" of the "crime" of consuming and trading plant matter?

What was this another non-crime, statute enforcement issue? Probably they just wanted to test out their "Tactical Chain Saw". There is a reason all their stuff is black. Who's next?"

What a bunch of fucking jackboots. You know, they do limit the IQs of these guys. Used to, they wanted the best and brightest. Now, however, they find that the most aggressive people have lower IQs, so the supreme court says its not discriminatory to hire people based on IQ scores, especially if there is an UPPER limit. Looks like the FBI is fully buying into that.

Eventually, the people will wake up. When they do, I'll be laughing my ass off, "Hahahahaha! Look at those jackboots scatter! Hahahaha! Where's your fucking tactical chain saw now you crooked bastards???!!!"

Get ready! Its coming. When it does, just watch how fast those SOBs try to strip off those uniforms. Once the corporation stops supporting them. Big Bastard (It used to be Big Brother, but now we've found out he's not really even related.) is the only thing that protects them. They have no courage of their own.

And, of course, any legal action taken against these guys will be dismissed as they were using 'lawful force' in pursuit of a 'criminal' - despite the fact that they obviously had no clue who or what they were really after or where it was.

There Is An Evil 1%, But Everyone Is Getting Its Identity Wrong

The "occupy" protest movement is thriving off the claim that the 99% are being exploited by the 1%, and there is truth in what they say. But they have the identities of the groups wrong. They imagine that it is the 1% of highest wealth holders who are the problem. In fact, that 1% includes some of the smartest, most innovative people in the country ? the people who invent, market, and distribute material blessings to the whole population. They also own the capital that sustains productivity and growth.

But there is another 1% out there, those who do live parasitically off the population and exploit the 99%. Moreover, there is a long intellectual tradition, dating back to the late middle ages that draws attention to the strange reality that a tiny minority lives off the productive labor of the overwhelming majority.

I?m speaking of the State, which even today is made up of a tiny sliver of the population, but is the direct cause of all the impoverishing wars, inflation, taxes, regimentation, and social conflict. This 1% is the direct cause of the violence, the censorship, the unemployment, and vast amounts of poverty, too.

Look at the numbers, rounding from latest data. The U.S. population is 307 million. There are about 20 million government employees at all levels, which makes 6.5%. But 6.2 million of these people are public school teachers, whom I think we can say are not really the ruling elite. That takes us down to 4.4%.

We can knock of another half million who work for the post office, and probably the same who work for various service department bureaus. Probably another million do not work in any enforcement arm of the State, and there?s also the amazing labor-pool fluff that comes with any government work. Local governments do not cause nation-wide problems (usually), and the same might be said of the 50 states. The real problem is at the federal level (8.5 million), from which we can subtract fluff, drones, and service workers.

In the end, we end up with about 3 million people who constitute what is commonly called the State. For short, we can just call these people the 1%.

The 1% do not generate any wealth of their own. Everything they have they get by taking from others under the cover of law. They live at our expense. Without us, the State as an institution would die.

Here we come to the core of the issue. What is the State and what does it do? There is vast confusion about this issue, insofar as it is talked about at all. For hundreds of years, people have imagined that the State might be an organic institution that develops naturally out of some social contract. Or perhaps the State is our benefactor because it provides services we could not otherwise provide for ourselves.

In classrooms and in political discussions, there is very little if any honest talk about what the State is and what it does. But in the libertarian tradition, matters are much clearer. From Bastiat to Rothbard, the answer has been before our eyes. The State is the only institution in society that is permitted by law to use aggressive force against person and property.

Let?s understand through a simple example. Let?s say you go into a restaurant and hate the wallpaper. You can complain and try to persuade the owner to change it. If he doesn?t change it, you can decide not to go back. But if you break in, take money out of the cash register, buy paint, and cover the wallpaper yourself, you will be charged with criminal wrongdoing and perhaps go to jail. Everyone in society agrees that you did the wrong thing.

But the State is different. If it doesn?t like the wallpaper, it can pass a law (or maybe even not that) and send a memo. It can mandate a change. It doesn?t have to do the repainting. The State can make you repaint the place. If you refuse, you are guilty of criminal wrongdoing.

Same goals, different means, two very different sets of criminals. The State is the institution that essentially redefines criminal wrongdoing to make itself exempt from the law that governs everyone else.

It is the same with every tax, every regulation, every mandate, and every single word of the federal code. It all represents coercion. Even in the area of money and banking, it is the State that created and sustains the Fed and the dollar because it forcibly limits competition in money and banking, preventing people from making gold or silver money, or innovating in other ways. And in some ways, this is the most dreadful intervention of all, because it allows the State to destroy our money on a whim.

The State is everybody?s enemy. Why don?t the protesters get this? Because they are victims of propaganda by the State, doled out in public school, that attempts to blame all human suffering on private parties and free enterprise. They do not comprehend that the real enemy is the institution that brainwashes them to think they way they do.

They are right that society is rife with conflicts, and that the contest is wildly lopsided. It is indeed the 99% vs. the 1%. They?re just wrong about the identity of the enemy.

You got it wrong Mr. Rockwell. A six grader has a better understanding of the world surrounding him than the one reflected in your article. FAIL! This posits that the "1%" named by Rockwell are independent: yet the richest 1% spends hundreds of millions annually on lobbying that ensures Rockwell's 1% do their bidding. The OWS have the right target. It is obvious if Rockwell's 1% ever stopped complying with the richest 1%'s wishes, they'd be shown the door via the elimination of their campaign backing and replaced by more biddable (n.p.i.) servants.

Wrong Medicine for a Sick Economy

"Middle-class families shouldn't pay higher taxes than millionaires and billionaires," repeatedly proclaims President Obama, arguing for his proposed $1.5 trillion tax increase over the next 10 years. "That's pretty straightforward. It's hard to argue against that."

In fact, Mr. Obama's statement is anything but straightforward.

Seeking to reverse his declining poll numbers, especially among his increasingly disillusioned base, Obama is attempting to give the impression that America's millionaires and billionaires are paying lower taxes than their secretaries.

IRS data for 2008, however, the latest year for which the numbers are available, show that those who earned more than $1 million in adjusted gross income paid an average federal income tax rate of 23.3 percent.

For those earning $100,000 to $200,000 in 2008, the average federal income tax rate paid was just about half as much, 12.7 percent. For those with adjusted gross incomes from $30,000 to $50,000 ? a millionaire's secretary, for instance ? the average federal income tax rate paid was 7.2 percent, less than a third of the rate paid by those earning $1 million and over.

Obama is echoing a recent column in the New York Times in which billionaire Warren Buffett wrote that the federal income tax rate he paid was lower than the rate paid by employees in his office.

"Warren Buffett's secretary shouldn't pay a higher tax rate than Warren Buffett," Obama responded. "There is no justification for it. It is wrong that in the United States of America, a teacher or a nurse or a construction worker who earns $50,000 should pay higher tax rates than somebody pulling in $50 million."

Again, the Buffett analysis is less than straightforward. For those in the top income brackets, a disproportionate share of income is from dividends, capital gains, and other investments ? income that is taxed at 15 percent. IRS data show that taxpayers with more than $1 million in yearly income get only 33 percent of their income from wages and salaries.

An honest portrayal would acknowledge that dividends and capital gains are double taxed, first as corporate profits at the highest corporate income tax rate in the industrialized world, 35 percent, and then again as individual income when dividends are distributed or stock is sold.

The total tax rate on capital gains is "closer to 45 percent than 15 percent" stated a Wall Street Journal editorial on September 20.

In fact, the tax hit on capital gains is higher than the Journal states because capital gains are not indexed for inflation, producing taxes that are levied on illusory gains. The stock seller is taxed not only on real gains in purchasing power, but also on phantom gains attributable to inflation.

On the overall tax burden, Obama is arguing that the rich should start paying their "fair share." He doesn't mention that the latest IRS data, for 2008, show the top 1 percent of US income earners paying 38 percent of all federal income taxes, the top 10 percent paying 70 percent, and the top half of income earners paying 97 percent of total federal income taxes.

Also unacknowledged by this White House is how President Kennedy's cut in the top marginal income tax rate produced an immediate increase in federal revenues, or how President Reagan's cut in the top marginal income tax rate was followed by a drop in the unemployment rate in the 1980s from 9.7 percent to 5.3 percent.

President Obama's prescription for revenue growth and job growth moves in exactly the opposite direction.

Marc Faber Explains How Even The "Greatest Bear On Earth" Gets It Wrong

Marc Faber was on Bloomberg TV dispensing his traditional sarcastic and sardonic wit in copious quantities. Among the traditional topics touched upon are stocks and specifically trading ranges, "I think a lot of people will say the markets formed a double low and we have some technical indicators that are going to turn positive, so we could rally around 1,250, but as I said before, for me, we reached a high on May 2, 2011. 1,370 on the S&P--that we will not go through", on Operation Twist part 1 (already announced) and part 2 (coming): "To some extent we are in midst of QE3 already, because by announcing the Fed will keep zero interest rates until the middle of 2013, they basically encourage financial institutions to borrow short-term and to buy 10-year Treasuries" on a contrarian outlook on stocks: "I am the greatest bear on earth, but if you compare Treasury bond yields and equities, equities look reasonably attractive", on why Insider "buying" just as we have said repeatedly, is far too much ado about nothing: "Compared to all the selling in the last six months the buying is relatively muted" and lastly, like a gracious loser, Faber admits he was wrong and Rosenberg was right "David Rosenberg was right and I was wrong. The 30-Year has not made a new low. The low in December 2008 was 2.53%. Now we're around 3.4%"... although with a caveat: "Basically we have an artificial market." Alas, no strategic observations on what particular precious metal one's girlfriend would appreciate the most in the current gold-platinum parity environment.

Faber on whether this is the market rally he's been expecting:

"We had rally from the low on the ninth of August at 1,101 on the S&P to almost 1,200. Then we came right down again. Basically we did not make new lows. And now I think we can rally again for a while."

Faber on how long his view of the market is:

"I think a lot of people will say the markets formed a double low and we have some technical indicators that are going to turn positive, so we could rally around 1,250, but as I said before, for me, we reached a high on May 2, 2011. 1,370 on the S&P--that we will not go through. My view is you have a lot of people with strategies that are very bullish. They have a year-end target of around 1,400-1,450 on the S&P. Then you have the super bear. I think both camps will be disappointed."

On why the markets won't come back down again to the lows that were hit in 2009:

"On fundamentals one could make the case that we could go lower to around March 2009 lows at 666 on the S&P. But I think we have to be realistic that if the market dropped here another 10% or 15%, there would be for sure another quantitative easing move and other measures taken to support asset prices."

On what we'll hear from Bernanke on Friday and whether there will be a selloff of Treasures after that:

"I think what [Bernanke] will say is that they are monitoring the situation, and they will take 'appropriate measures' when they are required. To some extent we are in midst of QE3 already, because by announcing the Fed will keep zero interest rates until the middle of 2013, they basically encourage financial institutions to borrow short-term and to buy 10-year Treasuries."

On how uncertainty on a global level is affecting the markets:

"What I see extremely well is the stock market has traced out a major high between November of last year and June of this year and then fell sharply with very strong momentum and conviction very rapidly by close to 20%. I think that is a very important signal that we should not overlook. I think new highs are practically out of the question for the next six months to one year. We will likely move lower, but as I said, I do not think we will have a complete collapse."

On why he's not more bearish:

"I agree with you. I am the greatest bear on earth, but if you compare Treasury bond yields and equities, equities look reasonably attractive. I think we will have zero and below zero interest rates for the next 10 years. In other words, inflation adjusted to keep money in cash. Finally, the mood is so negative right now as a contrarian, you do not take a huge short position when people are as bearish as they are right now and when insider buying has picked up as much. I am as bearish as the greatest bear is. It is just that I do not believe stocks will implode."

On insider buying:

"The insider buying has picked up, but there is still a lot of insider selling. Compared to all the selling in the last six months the buying is relatively muted. The insiders in general are a group of people against whom I would not bet against necessarily. All I am saying is I am very bearish. I think we will have inflation. I think the Treasury market is a disaster waiting to happen. I think the economy will slow down. They're going to print money and we will go to war at some stage somewhere. So, you are probably better off in equities than in bonds. My favorite investment remains gold. As it happens the gold price is coming down, and I hope it will drop $100 or $200. Not necessarily a prediction. I think we will go down in a correction because there has been too much enthusiasm recently."

Faber commenting on Gary Schilling's bet against copper:

"I have known Gary Schilling since 1970 when we worked together. He has been a frequent bear about commodities and about copper. I happen to think copper is likely to come down, but I would not bet too heavily on it, because it takes a long time to bring on additional copper mines. Unless the Chinese economy collapses, the demand for copper will stay relatively high. If the Chinese economy collapses and Jim Chanos is right, then you want to be short not only copper, but short everything."

Faber where the 10-Year will go:

"I would like to remind you that the 10-year has made a new low. [Gluskin Sheff economist] David Rosenberg was right and I was wrong. The 30-Year has not made a new low. The low in December 2008 was 2.53%. Now we're around 3.4%. Basically we have an artificial market. The Fed has said we guarantee next to zero interest rates for the next two years. Banks and financial institutions are pouring into the 10-year because of the low rates at the present time. "
