Cops Punish Checkpoint Refusenik By Jailing Him For 19 Days On Charges Later Dropped

We've posted a lot of videos of checkpoint refusals gone right, but never forgot, when dealing with government agents you're dealing with people who are borderline illiterate and almost never know the specifics of the laws they're tasked to enforce (nor do they care to learn them). Such irrational crazies can, and do, frequently do irrational and crazy things, which this case from Reason illustrates perfectly.

You've probably seen them before: internal border checkpoint refusals, now a popular YouTube genre. Some are funny. Others are hostile. But for Greg Rosenberg, a naturalized U.S. citizen who speaks accented English, an encounter with South Texas border patrol resulted in weeks of jail time without a single charge being prosecuted.

Rosenberg immigrated to America 10 years ago from Armenia. Memories and family stories of Soviet rule in his country of origin infused him with strong political beliefs and a reverence for individual rights.

"Back then [in Soviet-controlled Armenia], if you complained about the government, they took you to Siberia," says Rosenberg.

So perhaps it's no surprise that Rosenberg is a checkpoint protester. As a long-haul trucker, he has to drive through these all the time. After all, there are about 170 of them scattered across the United States. And keep in mind, these checkpoints aren't on an actual border. They just have to be within 100 miles of one. The ACLU estimates that roughly two-thirds of the nation's population lives within this 100-mile zone.

Rosenberg's ordeal began in the border town of Laredo, TX. He and his friend pulled onto I-35 North at around midnight on September 26 in a truck carrying a load of Xerox machines destined for Ft. Worth. But only 29 miles north of the border, they'd encounter the Laredo North Border Patrol Station. And Greg would undergo a checkpoint interrogation like he'd never experienced before.

"They arrested me for what I looked like, but they pressed the charges because of my beliefs," says Rosenberg.

Florida Man Arrested after Video Recording Deputies Mishandling Checkpoint

A Florida man who regularly video records DUI checkpoints to ensure police are operating in compliance of the law was arrested Friday night, moments after he had recorded Hillsborough County deputies falling out of compliance, which he believes may have been to wave a fellow cop through the checkpoint without having to be checked for sobriety.

Even if there was no cop in the car that was allowed to pass through, it created enough of an inconsistency from the predetermined protocol to make all the other stops from?that night unconstitutional.

And that is probably why they wanted him removed.

Wally Sullivan, 59, ?was stripped of his camera and handcuffed , then transported to the sheriff?s office where he was fingerprinted and released within an hour.

They kept his camera as ?evidence,? even though they had no legal right to do so considering he is not being accused of using his camera in the commission of a crime.

They didn?t realize he had another camera in a pouch around his neck, which is from where the posted videos come from; the top video being the shortened version, the bottom video the extended version, well worth the 30 minutes.

Man Refuses To ID At Texas Border Patrol Checkpoint, Checkpoint Officer Says "Get The F*ck Out of Here" & Waves Him Through

A man driving through a border patrol checkpoint in Texas is asked whether he is an American citizen by a checkpoint agent, the man refuses to answer the question and says he has the right not to.

Despite the checkpoint officer's protestations, the man boldly asserts his rights and doesn't budge, even despite the officer's threats.

Eventually, the checkpoint officer breaks and tells him, "You know what, you look like you're an American."

"Very arrogant..."

"Get the f*ck out of here," the officer tells him.

"Go ahead," he says, finally waving him through.

Whichever political party you affiliate with or whoever you are, just remember your rights.

Discrimination is often the outcome of these warrantless stops. While they have the right to stop you, you have the right to stop them.

I know I didn't have to answer any questions, but answering some is usually ok.

Could be actually even shorter. Instead of launching the discussion whether I "don't have to answer" or I do, simply "no comment" to every his question. Less room for any further discussion. ...and "see ya, asshole" as good-bye. Why didn't you ask him if the 14th amendment was legally ratified? That would send his head spinning. here in east san diego county the b.p. say they have the right to know everything about you,travels,etc.,and believe they have right to entry of any area at any time within 25 miles of anything bordering oceans or other countries.we have a big problem. BP is correct, san diegan. 100 miles from all borders in the US do not have 4th amendment rights. Check the Dept. Of Homeland Security website. how can a human being be "illegal" on planet earth?

borders, citizens, (CON)stitutions, belong to imperialists, not, free people.

if pieces of paper, with ink on them, can grant rights.... i'll just right a bunch up, and free the world.

people gravitate towards others who are similar to themselves. if the imperialists weren't trying to control this entire god-damned planet, there'd be no need for borders. people would naturally disband from the constructs, then, regroup with others who are suited to their own ideals.
instead, we live in a humongous concentration camp, while being told that we are "free."
