Police Use Battering Ram, Tasers During Raid On 'Young Looking People With Beer'

A birthday party turns into a nightmare when beverage cops violently show up to a private residence.

DAMASCUS, MD ? Police performed a violent raid on a birthday party based on a suspicion of ?young looking people with beer,? then dubiously confiscated guests? cell phones when they were used to record the police.

The incident occurred on January 4th,? 2014, at the home of George and Cathy Magas.? The couple?s son, Nicholas, was turning twenty-one years old, and he was allowed to invite a number of his friends to the home for a party.? Both his parents were present.

During the party, the crowd opted to order pizza.? Things went downhill when the delivery driver took it upon himself to pass a tip about the party to a friend ? Officer Finch of the Montgomery County Police Department.

?Hey man not sure if you're working but if you're not busy there I just delivered a pizza to a party at 9*** Damascus rd and saw some young looking people with beer,? the pizza-delivering snitch wrote in a text message.

Officer Finch then relayed the information to members of the county?s ?Alcohol Initiatives Section? to investigate.? Subsequently, MCPD Officer Jeremy Smalley and Montgomery County Sheriff?s Deputy John Durham arrived together to scope out the party.

Having no other information besides the text message tip, the two beverage cops drove past the residence and ?observed numerous vehicles? and could ?hear the sounds of a party,? according to charging documents.? They claimed to witness some males urinate behind a detached garage.? Having no evidence to stand on, the officers assumed that the party contained underage drinking and called for reinforcements.

THE PROBLEM WITH ASSUMING

The investigation was flimsy from the start.? Officer Smalley and Deputy Durham made multiple unsubstantiated assumptions and fabrications of fact.? Just by observing individuals carrying ?red Solo style cups,? they surmised that the party-goers (1) were consuming alcohol and (2) ?appeared to be under the age of 21.?

These assumptions were used as probable cause that a crime was being committed ? underage consumption of alcohol.

The police were challenged on their remarkable ability to verify the ages of the guests just by looking at them.? This was not an insignificant detail, because anyone above the age of 21 would not have been breaking any laws.

When asked how he could tell the difference between a 20-year-old and a 21-year-old, Deputy Durham later testified, ?The loudness, just the way they presented themselves, was consistent with being under 21? They kind of exaggerate their movements, like ?hey look at me?"? rather than adults standing around drinking.?? Durham conceded that ?It's not 100 percent.?

DISPERSING THE PARTY

Filled with assumptions, Officer Smalley and Deputy Durham approached the basement stairwell and were met by one of the younger residents of the home, Marc Magas.? According to the police report, Marc was ?very cooperative? and inclined to grant them access to the inside of the home.? However, that idea was nixed when his mother, Cathy Magas, allegedly said, ?We have dealt with you guys before, and I don?t want you coming in the house.?

At that point, police were close enough to see cases of beer and a keg.? Despite having no verified proof of anyone?s age, police entered and began to pick up cases of beer and haul them to the top of the steps outside the home.? This confiscation of property was met with angry shouts from homeowner George Magas.? Backup units had arrived and helped to seize the beverages.

According to the police report, 21-year-old Nicholas Magas exited the basement door and attempted to retrieve his property by picking up a case of beer.? The report says that Officer Smalley grabbed him, but Nicholas ?attempted to pull away.?

The events that followed were chaotic and have been described through conflicting reports.

Police reported that Officer Smalley was ?pulled? into the doorway and residents slammed his arms in the door.? A struggle ensued, and police alleged that homeowner George Magas assaulted three officers, and that he even tried to take Deputy Durham?s weapon from its holster.? Eric Magas became involved, and police claimed that he too assaulted an officer.

?Deputy Durham then struck Eric Magas in an attempt to change his behavior,? the report states.? Eric was tased by police on the steps.? Cathy Magas attempted to render aid to her son, and in doing so, police claimed she elbowed a deputy.

Meanwhile, George Magas was outside being forcefully subdued by police with tasers, as his guests filmed with their cell phone cameras.

The footage ?shows police dragging the homeowner out of his house, handcuffing him and repeatedly tasing him while he offers little to no resistance,? according to Montgomery County Sentinel editorialist Brian Karem, who was allowed to see the video.

George, Cathy, Nicholas, and Eric Magas were arrested.? George and Eric had to be transported to the hospital for their injuries.

BATTERING RAM

Some time after the Magas family was arrested, there were reportedly a number of guests still inside the house, which the ?Alcohol Initiatives Section? intended to search and arrest.

Police deployed a battering ram and broke down the basement door, then rounded up the remaining terrified guests, ranging in age from 18 to 21.

Records showed that the police did obtain a search warrant to enter the home. However, it was not obtained until 5 hours after the initial contact with the Magas family, and did not bear any mention to the multiple assaults that the police officers had supposedly sustained in the course of the initial arrests.

According to the officers, their stated goal this dramatic use of force was to ?stop the party and make sure everyone gets home safely.?

AFTERMATH

The four family members were nailed with a multitude of charges which could have resulted prison time for each of them.
George Magas, 55, was charged with attempting to remove a firearm from the possession of a deputy sheriff, attempting to incite a riot, three counts of second degree assault, obstructing and hindering a police officer, and 22 counts of furnishing alcohol to a minor.Cathy Magas was charged with second degree assault, obstructing and hindering a police officer and 22 counts of furnishing alcohol to a minor.Nicholas Magas, 21, was charged with attempting to incite a riot, obstructing and hindering a police officer, and 22 counts of furnishing alcohol to a minor.Eric Magas, 18, was charged with second degree assault, attempting to incite a riot, obstructing and hindering a police officer, 22 counts of furnishing alcohol a minor, possession of a fake ID, possessing more than one driver's license, knowingly and fraudulently obtaining a license by misrepresentation, and three counts of possessing a fictitious license.An additional twenty-two adults were cited for underage consumption of alcohol, despite evidence that some of those cited did not even have anything to drink. Several guests had their cell phones confiscated after videoing the police getting physical with members of the Magas family.

?I don't know why the police acted in the manner in which they did, including taking the phones of those who were in the home,? family attorney Rene Sandler told The Montgomery County Sentinel.

After having their family name dragged through the mud and forced to hire attorneys to defend themselves, the Magas family caught a break when their case came before Montgomery County Circuit Court Judge Steven Salant.? The Magas family contested that their Fourth Amendment rights had been violated, and that police had no lawful justification to be on their curtilage, snooping around in the rear of the house.?? The judge agreed.

?I do find an unlawful invasion of the defendants? property? the defendants were entitled to an expectation of privacy in the area officers went in the back of the house,? Judge Salant said following a suppression hearing. He cast doubts on the officers? probable cause statement and called some of the police testimony ?not true.?

Judge Salant was incredulous that the raid was performed legally.? The search warrant wasn?t obtained until five hours after police arrived on scene, and left out key details which the police later used as the basis of criminal charges against the family. Critics have doubted that the warrant was obtained prior to entering the home.

In November 2014, Judge Salant threw out most of the prosecution?s evidence obtained during the raid ? including several guests? cell phones ? and said the police had violated the Magus's civil rights.

FOLLOW-UP:

As of late 2014, the state was still considering ?a myriad of options, including appeal,? according to Maryland state?s attorney's office spokesperson Ramon Korionoff.

Officer Jeremy Smalley, nor Deputy John Durham, nor any other officer who participated in the sloppy investigation and dubious search have received any form of public discipline or legal consequences as of this writing.

A truly free society would never tolerate this form of harassment on private citizens for drinking beverages of their choice. Americans need to stir up a demand for repealing draconian alcohol laws and pressure law enforcers to stop wasting tax resources on such oppressive endeavors.

Woman Says DHS Forced Her to Strip Naked at Gunpoint During Terrifying Dawn Raid


"Two hours of pure hell" as SWAT team trashes home

Kari Edwards said she and her boyfriend were forced to strip naked at gunpoint during a terrifying Department of Homeland Security dawn raid on their Florida home which lasted for two hours.

The incident began on June 10 at 6:16am when numerous armed SWAT team members, accompanied by a helicopter overhead, arrived in an armored vehicle at the couple?s address before smashing in the door and deafening their pet cat with flash bang smoke grenades.

"They busted in like I was a terrorist or something," Edwards told the Tea Party News Network, adding, "[An officer] demanded that I drop the towel I was covering my naked body with before snatching it off me physically and throwing me to the ground."

Having been previously employed by the federal agency herself, Edwards noted that some of the men were DHS agents, although when quizzed as to who they were and why they were conducting the raid, the men only responded by saying that they were ?police,? while calling Edwards ?stupid? and ?retarded? for asking the question.

"While I lay naked, I was cuffed so tightly I could not feel my hands. For no reason, at gunpoint," Edwards said. "[Agents] refused to cover me, no matter how many times I asked."

According to Edwards? boyfriend, one of the agents then proceeded to ogle his naked girlfriend up and down like a piece of candy.

?They spent about 2 hours trashing my house, even smashing clear glass shower doors and a vintage statue,? writes Edwards on her YouTube channel. ?My boyfriend, who is asthmatic, started having trouble breathing due to the lingering smoke created by the flash bang grenade.?

After trashing her home for two hours, Edwards said the SWAT team eventually handed her a warrant signed by Jonathan Goodman, a federal magistrate judge for the U.S. District Court for the Southern District of Florida, which authorized the agents to search for computers and electronics, although Edwards claims police seemed uninterested in the couple?s electronics and did not seize any items despite raising the suspicion of child pornography.

Surveillance camera footage of the incident shows armed agents surrounding the property. Edwards says the clip is brief because the agents ripped out her surveillance DVR while claiming that they couldn?t be recorded.

Edwards summed up her experience by describing the incident as ?two hours of pure hell.? The couple have filed a complaint with the ACLU.

While the details of the incident remain unconfirmed, the story will heighten concerns that the DHS is turning into a ?standing army? emblematic of a militarized police state.

NYPD Arrest Man for Video Recording Cops during Traffic Stop, Claiming Phone Could have been Gun

New York City police arrested a man for video recording them with an iPhone, using the laughable old lie that the phone could have been a gun, even going as far as claiming an NYPD cop had been shot by a kid with his phone.

Not only has there never been a single reported instance of a phone being used as a gun in the United States, the only evidence that it ever existed appears in a Youtube video out of Europe using a bulky, outdated phone large enough to contain four bullets.

Nevertheless, Will Paybarah ended up spending 13 hours in jail on charges of ?resisting arrest, obstruction of justice, and criminal mischief.

Long Island officers caught on video violently striking driver during traffic stop



WESTBURY (WABC) -- Two Nassau County police officers are under investigation after video surfaced that showed them violently striking a driver during a traffic stop.

Now, Kyle Howell, a 20-year-old drug suspect facing multiple charges, is filing a lawsuit against the officers.

The Westbury man says he has been repeatedly pulled over by cops, these two in particular.

The videotaped incident took place on April 25, when the officers pulled him over for having a cracked windshield. A nearby surveillance camera was rolling as the officers began to punch and knee him.

Cop Filmed Playing Poker On In-Car Computer Driving During Rush Hour On Unplowed Road

The new year brought some 40,000 news laws into effect throughout the United States. In Chicago, one of those laws was a ban on using a cell phone while driving. The studies which showed such bans may lead to more accidents because people hide their phones below eye level rather than stop using them were ignored in place of political hysteria and the demand to "do something."

Incidentally, the people tasked with enforcing such a cell phone ban have dashmounted computers with huge LCD monitors in their patrol cars. As you can see in this video just posted to YouTube, some use these in-car computers to play online poker while driving in rush hour traffic on unplowed roads during the "polar vortex."

Cops engaged in such "typing while driving" incidents regularly crash into people while casually using their in-car computer. Here's a local news report out of Arlington, Texas showing it's an epidemic. Nonetheless, cops are explicitly exempt from all these distracted driving laws.

"40,000 new laws...."

here we go again..... "if a tree falls in the forest, and, nobody is there to hear it, does it make a sound?"

telling people that the government has written-up 40,000 new "RULES" ("laws" are inherent), I would liken to the age-old question I've quoted above. Perhaps, the government should be asking: "if there's nobody left who believes in 'government,' does it exist?"

wow, from 10 commandants, to a simple (CON)stitution, to 40,000 fake-believe laws in 2014..... i'll call "b/s" if no one else has the b@ll$ to.

Police Shoot Toothless 16-Year-Old Family Dog During No-Knock Raid



RABUN, AL ? A family feels violated after their home was subject to an unannounced, no-knock raid and their gentle family dog was shot by a deputy.

The all too familiar scenario played out in Alabama as it has thousands of other times throughout the country.?? Deputies intruded into a family residence with no knock, no announcement, and no permission.? The family pet, curious and scared, approached the unwelcome strangers to investigate.? The family pet was shot, and deputies? justified their shoot with claims that the family disputes.

Such was the experience of the Fretwells who live on Stacey Drive in Rabun, Alabama.? On Friday, November 22nd, their aging family companion was shot by a Baldwin County deputy who had entered their home without permission.

?She?s gentle, she has a caring soul, she wouldn?t hurt anything and she never has, we?ve never had this problem ever,? said homeowner Angel Fretwell.

The Fretwells? dog, Belle, is 16 years old, can barely get around, and has lost all of her teeth.

Upon hearing the four strangers in her home she approached deputies.? They claim they had to shoot Belle for fear of their lives when she allegedly came after them.? But the family disputes that claim.? The Fretwells claim that Belle ran before she was shot in the shoulder.

After shooting their pet, deputies wouldn?t let the family care for her for over 1 hour.

They claim to have been searching for a relative of the Fretwells, who was not in the home.

Veterinarians say that Belle has a chance to survive, but will lose her leg and require a $1,000.00 surgery.

Between the use of no-knock raids on family residences and the cowardly shooting of family pets, concerned citizens have a lot to address with the Baldwin County Sheriff?s Office.? Only citizen activism can curb aggressive police tactics and acquire accountability.

?They have to be cautious,? Fretwell said to WPMI Local 15 News.? ?I just think that maybe if they would have announced themselves or give it some kind of warning or anything at that point I think it would?ve helped this situation a lot.?

i don't know why anyone tolerates a no-knock raid,

i don't know why anyone tolerates a roadside cavity search,

i don't know why anyone tolerates having an M4 pointed in their face,

i only know that we are sinning by tolerating it, and will continue to suffer for our sins.

people don't shoot creeps because they are afraid of earthly death, and that is the sin; don't fear earthly death, be willing to give up your earthly life to fight back when evil attacks, everywhere and anywhere it attacks.

you need to know this:

- their souls are already sold to satan, you can not help them

- this is a challenge to YOUR SOUL, YOURS still has a chance to be saved; yes Jesus did die for our sins, and as He said to the prostitute after forgiving her, "go and sin no more", once you believe in Jesus you need to be willing to behave as such, that doesn't mean you'll be perfect but it means you should constantly prepare your mind, heart, and soul, to do the dangerous things when the challenge is put to you.

Pray for courage to stand up against evil and die by evil's hand.
if a challenge comes up and you cowered in fear as Peter denied Christ 3 times, then afterwards repent of this and prepare to not make that same sin the next time. God gives you chances to redeem yourself, but you must prepare your heart/mind/soul or you will fail again.

To police:
your "job" is not to "follow orders", your "job" is to "follow the law", and you are not doing that and you know it. every single one of you is on such thin ice or else you are utterly lost already and nothing you do now will save you. to the rare few who are still on that thin ice - God sees all, God will be Judging you, it is not "sovereign citizens" or such you need to fear, it is GOD that you need to fear.

Someone - anyone - please fight back against home invasions by thugs in costumes. Fighting back is exactly the missing piece the thugs need in order to shoot the whole family. Look what happened when there was manhunt for Dorner - they were opening fire at the cars at the highway, and it was all "justified".

We live in democratic society, and what needs to happen next is public officials losing or seriously risking their political careers.

Two Texas women stopped for allegedly throwing a cigarette butt out of their window were subject to a TSA-style act of sexual molestation by a female police officer who conducted a "roadside body cavity search" on them, The Dallas Morning News reports.

Two Irving women are suing two state troopers and the head of their department in federal court, alleging they were subjected to an illegal and humiliating ?roadside body cavity search? during a traffic stop.

Angel Dobbs, 38, and her niece, Ashley Dobbs, 24, said the search occurred on State Highway 161 in or near Irving on the night of July 13.

They claim that a female trooper, Kelley Helleson, used her fingers to search their anuses and vaginas ? using the same latex glove ? while on the side of the road in full view of passing vehicles.

They said David Farrell, a state trooper, had called Helleson to the scene after stopping the women?s vehicle and questioning them about marijuana. Farrell told them he stopped them after seeing them throw cigarette butts out of the window, according to the lawsuit.

He asked for the search because he said the women were ?acting weird,? the suit said.

Farrell searched their vehicle for marijuana but didn?t find any, they said. He then tried to ?morph this situation into a DWI investigation,? the lawsuit said. Angel Dobbs passed a roadside sobriety test and the women were given warnings for littering, the suit said.

[...]Palmer said the Texas Rangers investigated his clients? complaints but no action was taken against the troopers.

Palmer said the searches were basically a ?sexual assault? on the side of the road.

?No one?s ever seen the likes of this,? he said. ?We can?t let them get away with it.?

Cop 'In A Rage' Allegedly Rips Woman's Hair From Scalp During Altercation At Bar




SALISBURY ? Witnesses said Methuen police officer Shawn Tardif was "in a rage" when he grabbed a 25-year-old woman attending a bachelorette party, forced her to the floor and then dragged her by the hair in a bar brawl Saturday night.

It took two security guards to get Tardif off the woman and Tardif punched one of the guards in the mouth, according to a Salisbury police report.

The woman allegedly assaulted, identified as Nicole Morrison, showed police a "clump of hair" Tardif allegedly ripped from her scalp during the 11:20 p.m. altercation at the Surfside 5 bar and restaurant at 23 Broadway, the police report said.

[...]Morrison told Leavitt she was grabbed from behind by the neck, ripped to the ground "and pulled from side to side while being dragged by her hair and she showed me a clump of hair in her hand," he wrote. Morrison also said she got her bracelet tangled in Tardif's glasses and one of her earrings was ripped out.

Two security guards jumped in to break it up and Tardif punched one of them in the face, witnesses told Leavitt.

"During this altercation, it was reported that Tardif was dragging Morrison across the dance floor and was described as being 'in a rage,'" Leavitt wrote.

[...]As he was booked, Leavitt said Tardif told him he "was reacting to his wife getting grabbed" and denied any other wrongdoing and damaging the DJ equipment. He also said he wanted to file charges against Morrison because his glasses and gold chain were broken, Leavitt wrote in his report.

TSA agents to staff UK airports during Olympics

Agents of the U.S. Transportation Security Administration will be stationed at British airports during the Summer Olympic Games, British media reported Tuesday ? the latest indication that authorities are scrambling to shore up security before the games open in 11 days.

Sky News, citing security sources, reported that the agents would begin arriving at Heathrow and other major UK airports next week.

Kurt Haskell Exposes Government False Flag Operation During Underwear Bomber Sentencing

Every victim of a crime in Michigan is entitled to make a statement in open court regarding the impact of the crime on their life. The statement is limited to the victim?s physical, emotional and financial well being as it relates to the crime. Keep that in mind as you read my statement. Below is a copy of the victim impact statement I gave today at the Underwear Bomber sentencing hearing. When reading my statement, keep in mind that I am a practicing attorney in the State of Michigan. In addition, I regularly practice in the Court the hearings are taking place at and therefore, I am somewhat limited as to what I can say. We were limited to 5 minutes each.

I wish to thank the Court for allowing me these 5 minutes to make my statement. My references to the government in this statement refer to the Federal Government excluding this Court and the prosecution. On Christmas Day 2009, my wife and I were returning from an African safari and had a connecting flight through Amsterdam. As we waited for our flight, we sat on the floor next to the boarding gate. What I witnessed while sitting there and subsequent events have changed my life forever. While I sat there, I witnessed Umar dressed in jeans and a white t-shirt, being escorted around security by a man in a tan suit who spoke perfect American English and who aided Umar in boarding without a passport. The airline gate worker initially refused Umar boarding until the man in the tan suit intervened. The event meant nothing to me at the time. Little did I know that Umar would try to kill me a few hours later as our flight approached Detroit. The final 10 minutes of our flight after the attack were the worst minutes of my life. During those 10 minutes I sat paralyzed in fear. Unfortunately, what happened next has had an even greater impact on my life and has saddened me further.

When we landed, I was shocked that our plane taxied up to the gate. I was further shocked that we were forced to sit on the plane for 20 minutes with powder from the so called bomb all over the cabin. The officers that boarded the plane did nothing to ensure our safety and did not check for accomplices or other explosive devices. Several passengers trampled through parts of the bomb as they exited the plane. We were then taken into the terminal with our unchecked carry on bags. Again, there was no concern for our safety even though Umar told the officers that there was another bomb on board as he exited the plane. I wondered why nobody was concerned about our safety, accomplices or other bombs and the lack of concern worried me greatly. I immediately told the FBI my story in order to help catch the accomplice I had seen in Amsterdam. It soon became obvious that the FBI wasn?t interested in what I had to say, which upset me further. For one month the government refused to admit the existence of the man in the tan suit before changing course and admitting his existence in an ABC News article on January 22, 2010. That was the last time the government talked about this man. The video that would prove the truth of my account has never been released. I continue to be emotionally upset that the video has not been released. The Dutch police, meanwhile, in this article (show article), also confirmed that Umar did not show his passport in Amsterdam which also meant that he didn?t go through security as both are in the same line in Amsterdam. It upsets me that the government refuses to admit this fact.

I became further saddened from this case, when Patrick Kennedy of the State Department during Congressional hearings, admitted that Umar was a known terrorist, was being followed, and the U.S. allowed him into the U.S. so that it could catch Umar?s accomplices. I was once again shocked and saddened when Michael Leiter of the National Counter terrorism Center admitted during these same hearings that intentionally letting terrorists into the U.S. was a frequent practice of the U.S. Government. I cannot fully explain my sadness, disappointment and fear when I realized that my government allowed an attack on me intentionally.

During this time, I questioned if my country intentionally put a known terrorist onto my flight with a live bomb. I had many sleepless nights over this issue. My answer came shortly thereafter. In late 2010, the FBI admitted to giving out intentionally defective bombs to the Portland Christmas Tree Bomber,the Wrigley Field Bomber and several others. Further, Mr. Chambers was quoted in the Free Press on January 11, 2011 when he indicated that the government?s own explosives experts had indicated that Umar?s bomb was impossibly defective. I wondered how that could be. Certainly, I thought, Al Qaeda wouldn?t go through all of the trouble to plan such an attack only to provide the terrorist with an impossibly defective bomb.

I attended nearly all of the pretrial hearings. At the hearing on January 28, 2011, I was greatly disappointed by the prosecution?s request to block evidence from Mr. Chambers ?as it could then be able to be obtained by third parties, who could use it in a civil suit against the government?. It really bothered me that the government apparently was admitting to wrongdoing of some kind as it admitted that it was concerned it would be sued. It further upset me to know that the government was putting its own interests ahead of those of the passengers.

When I attended the jury selection hearings, I questioned why versions of the same two questions kept coming up, those being:

1. Do you think you?ll be able to tell whether something is actually a bomb? and"? 2. Do you realize that sometimes the media doesn?t always tell the truth?

I continued to be greatly saddened at this point as I felt the truth continued to be hidden.

When Umar listed me as his only witness, I was happy to testify, not on his behalf, but on behalf of the truth. I never expected to testify, as my eyewitness account would have been too damaging to the myth that the government and media are putting forward. A mere 5 days after I was announced as a witness, there was an inexplicable guilty plea which exasperated me as I no longer would be testifying.

In closing I will just say that regardless of how the media and government try to shape the public perception of this case, I am convinced that Umar was given an intentionally defective bomb by a U.S. Government agent and placed on our flight without showing a passport or going through security, to stage a false terrorist attack to be used to implement various government policies.

The effect this matter has had on my life has been astounding and due to this case, I will never trust the government in any matter, ever.

In regards to sentencing, nothing I?ve said excuses the fact that Umar tried to kill me. He has waived his valid claim to the entrapment defense. Umar, you are not a great Muslim martyr, you are merely a ?Patsy?. I ask the court to impose the mandatory sentence.

95-yr-old woman dying of leukemia asked to remove adult diaper during TSA search

Jean Weber of Destin filed a complaint with the Department of Homeland Security after her 95-year-old mother was detained and extensively searched last Saturday while trying to board a plane to fly to Michigan to be with family members during the final stages of her battle with leukemia.

Her mother, who was in a wheelchair, was asked to remove an adult diaper in order to complete a pat-down search.
