Syracuse Police Taser a Disabled Man for Standing on a Bus

SYRACUSE, NY -- Police used a taser to electric shock a disabled man because he was standing on a bus, as he always does. The man prefers standing because of his spinal injuries, which make it uncomfortable for him to sit.

Brad Hulett says he did not want to lose the price of his bus fair, but he also couldn't comply with the request to sit. He says that standing is common on the buses and happens every day. He does it every day. However this day he believes he was singled out because of the way he looks. Hulett suffers extensive disabilities stemming from injuries caused by being struck by a train years ago. He also had open heart surgery recently and feared that police tasers would harm his heart. He is suing because of excessive use of force.

Until the officers can be sued for their actions, they will continue to have a God complex. Police academies should also be sued for creating public dictators instead of public servants. Suing the City is suing the taxpayer. That only helps our leaders bankrupt the nation. @EndtheFed&IMF, I like your style, but, I disagree with the former, of your 2 notions.
Police do protect the "God's complex," (self-proclaimed "gods" system) but, suing them, would only create a greater antithesis. Police are bound by a blood oath, hence - "Oath Keepers;" the reason they must enforce the dictatorship's rule-of-law, (aka: absolute nonsense). "Their lives outweigh public scrutiny," in other words...

As for: "Suing the City is suing the taxpayer. That only helps our [mis]leaders bankrupt the nation.".... Police work for the state, and, they are employed to do the state's bidding. presently, the objective for the dictatorship is, "bankrupting the nation." That doesn't suggest the police should be sued, it merely suggests that they are cowards.

The government looks at the common people of this land the same way it views dogs. They tell you to sit, stand, lie down, beg and roll over. If you're a slow learner or ask why they label you as non-compliant or resisting. The Pavlovian response of a well trained officer to such stimuli is initiate beat down, pepper spray, electrocution, or as in the case of our four legged friends, straight to street judge type execution. Main point. There are douche bag bus drivers and cops.
There is no ending to these kind of stories.
Next time they will shoot him cause they think he might be a terrorist for standing.
It's ridiculous.
Fuck Big brother and The Elite.
And everyone between. @h1976, I think both, dogs and people, should be free. I won't be learning fast-like, nor, will I be complying, but, I have always considered our four-legged-friends' well beings, when I think toward the future; (which is, more than can be said for the government.) What big, tough men! They showed Brad who's boss! Here's what their testimony will be at trial: "Based on my training and experience and for officer safety, it was necessary to utilize nonlethal force to subdue an aggressive and combative citizen who appeared highly intoxicated, was a threat to public safety, and refused to comply with lawful orders."

Translation: "The retard was getting mouthy so I shut his ass up! You should gave seen him flopping around and heard his little retard screams! Priceless!"

I feel so much safer knowing such big, tough men are protecting me and the American way of life!

@L.S. I'm looking forward to the day when people treat each other the way they want to be treated. Too many of these cops are out of control. I guess brutality and unquestioning obedience are preferred in law enforcement above compassion, empathy and amicable problem solving.
It would be such a crummy way to live, putting on the uniform with the belt and all the attached instruments of compliance and torture, planning on using them on for example; a handicapped man for not sitting down or shooting a couple of dogs hiding under the bed. I wonder how some of those guys sleep at night. @h1976, I truly do understand what you're saying, but, it's not the cops who are "out of control."

"problem solving." -h1976
A really smart-ass Brit. asked this of me once: "you are having a problem, so, why is it a problem?" He then, proceeded to call: "checkmate;" forcing me to... Well, I had apologized in advance, though, I haven't seen him in awhile. But, his comment, (a blatant ripoff), did remind me, of where my current place in time is; knowing, Absolutely, without a doubt, as follows...

"Laws" are enforced, regardless, of statutory law(-run-amuck), and, problems couldn't exist, unless, a solution was there prior to the problem.

I'd prefer, for both, people, and, cops, to exercise "freewill." However, I do understand that my own ideal isn't for everyone; the reason I haven't "brought down the house," so to speak.

I had a friend once. He was something else, perhaps, an "exception," in "philosophical-terms," but, he refused to see that "exceptions" don't apply to "real-life," as simply as, "real-life" applied to him. His philosophy was: "slap people into REAL 'reality,'" whereas mine is: "if you're sick of being slapped by fake-believe - this is reality; if neither agree with your mind-set - spirituality is up to you."

As for, "sleeping at night".... You'll note that Chris is still writing for "Info. Lib." In other words: "I respect the individual's choice."

Regards, Harry / Henry? (forgive my lack of tact - I can't recall your screen-name)

@dam 71163, I hate arrogant people, don't you? If I were reading the Bible script, perhaps, Matthew 12:42, I might start questioning... Who was the queen of the south, and why, is it, that she was she so humble, that her name wasn't capitalized in the kjv?

Your voice is deep, you smile a lot, you're insecure about your height, you're not as thin as you'd like to be, something... about your clothes - they're not suited to your ideal?
please, don't make me "bring you down to size." I'm autonomous, though, I CAN, "play-the-game" blindly. h1976, has your best interest at heart. Maybe, you should e-mail / talk w/ him, before taking on an "L. Silver."

@h1976, dogs are needy, that annoys me. Perhaps, you should throw 14/14 a bone...

U.S. Park Police Harass Journalist for Recording Cop Car Lights Before Calling his Job and Complaining

By Carlos Miller

A journalist was harassed by U.S. Park police for video recording police lights on top of a patrol car from a public sidewalk in Washington D.C. Friday.

Officer T.W. Twiname chased after Arash Arabasadi as he was walking into his girlfriend?s building, demanding to know his name.

Arabasadi, who works for Voice of America and teaches journalism at Howard University, provided his first name, but then had second thoughts when the cops started jotting his name down in a notepad.

?Can I ask why you?re taking this report?? Arabasadi asked.

?Once you give me this information, I will explain everything to you, ok,? Twiname responded.

?Am I under arrest?? Arabasadi asked.

?Nope.?

?Then I?m going back inside.?

And he did.

But he came back out to ask the cop for his name and badge number.

?Do you make it a habit to harass citizens who are just out here taking pictures and video?? Arabasadi asked.

Twiname told him to have a nice day and walked away.

Twiname then contacted the human resources department at Voice of America to complain about Arabasadi.

So if you want to complain about Twiname, call his lieutenant at (202) 426-7716.

Judge Refuses To Dismiss Suit Against Feds Who Arrested Former Marine For His Controversial Facebook Posts

by Tim Cushing

Almost exactly a year ago, former Marine Brandon Raub was taken from his home by federal agents and involuntarily committed to a psychiatric ward, all because of some controversial postings to his Facebook account, including some 9/11 conspiracy-related articles and violent song lyrics.

On August 16, 2012, Raub was visited by local police, FBI agents and Secret Service personnel who questioned him about his Facebook posts. Raub was cooperative and discussed his activity with the officers, despite their not having a warrant. At some point, one of the agents made a call to Michael Campbell, a psychotherapist retained by the county who decided, despite having never met or observed Raub, that the former Marine was "potentially dangerous" and should be detained.

At that point, the collected officers cuffed Raub and took him to the local jail before having him committed to the mental hospital. Government officials later claimed Raub wasn't arrested, but the video taken of his "not being arrested" looks for all the world to the un-government-trained eye like an arrest.

After being detained for four days, Raub appeared before another judge who ordered him to be held for 30 days for evaluation. A short while later, this was overruled by Circuit Court Judge Allan Sharrett, who ordered Raub released immediately, stating that the prosecution's case was ?so devoid of any factual allegations that it could not be reasonably expected to give rise to a case or controversy.? At this point, the Rutherford Institute, which had taken Raub's case after his "non-arrest," filed a lawsuit on his behalf against the officers and agents involved with his unlawful detainment.

Needless to say, the government has attempted to have this lawsuit dismissed. Fortunately for Raub (and the American public), the judge isn't willing to let the involved parties just walk away from their problem.

A federal judge in Richmond, Va., has refused to dismiss from a lawsuit several FBI and Secret Service agents as well as local police officers who arrested a military veteran based on an opinion from a counselor who had never met him that he might be a danger.

The decision came from U.S. District Judge Henry Hudson, who essentially said there is not enough information at this point in the case to dismiss the law enforcement defendants. He ordered limited discovery.

Hudson said the Rutherford Institute, which is representing Raub, had alleged sufficient facts to indicate that the involuntary commitment violated his rights under the U.S. Constitution?s First and Fourth Amendments.

The government agents named have claimed that officers only have to show "probable cause that the individual poses a danger to himself or others" in order to forcibly detain and commit civilians. Hudson has rebutted this claim, stating that these agents had no previous experience with Raub and were acting solely on the claims made by a third party, unless other facts indicating otherwise present themselves during the limited discovery. That handles the Fourth Amendment claims. The First Amendment claims brought by Raub also survived the motion to dismiss.
[T]here is no dispute over whether political speech is protected or whether an arrest for political speech would adversely affect one's ability to further engage in political expression. And the third element -- causation -- may be inferred from Raub's allegation that the only knowledge the County Defendants had at the time of arrest concerned his political views.
No one has a problem with law enforcement investigating threats, but all too often lately, these agencies have proven they are quick to act on very little information, much of it devoid of any context. Raub's case and other incidents involving social media all have one thing in common: the word "terrorist." The government's favorite witch hunt is hurting Americans, as zealous government entities are willing to see the implicit threat of terrorism everywhere someone tells them to look.

Washington Man Arrested for Video Recording SWAT Team from Public Sidewalk

by Carlos Miller

A Washington man was arrested for video recording police from a public sidewalk after they had raided his neighbor?s home Saturday.

He was charged with obstruction, although as you can see in the video below, all he was doing was interviewing his neighbor about having a gun pointed at her six-month-old daughter.

A militarized cop then walked up to him and told him he was not allowed to record him without his permission as you can see in the video above, which we all know is false ? especially considering the cop was the one who walked up to him (but that doesn?t even make a difference).

The man, who goes by 509rifas and lives in Yakima County, posted the videos and story and an open carry forum. Hopefully, we?ll get more details, including the police agency involved.

Here is his story:

So I heard a commotion outside, turns out SWAT was raiding my neighbors house again. Heard a flashbang then walked down to film it. I was there for a while, maybe 20 minutes with no problems.

Then I started talking to a young woman who asked me if I had it on camera when they pointed guns at her infant.

A sgt approached and told me not to film and whatnot, and I actually turned the camera off, turned it around to show him, and THEN he arrested me for obstruction.

He noticed my smaller camera and assumed it was on, and then arrested me. The arrest isn?t actually recorded, what let up to it up to the point I stopped recording is.

As they brought me over to the SWAT van he said something on the radio about ?grabbed this guy? recording? and I?m fairly certain I heard back ?stop him!.? I?ll find out for sure when I get the PRA records. But if that was what was said, that steps it up to another level.

As it stands right now, I am facing criminal charges of obstruction a law enforcement officer, and have court next week.

As for the preferred ratio of a higher CBD and lower THC cannabis strain, everyone fails to recognize how industrial hemp (another strain of cannabis) contains the highest percentage of CBD - and without the psychoactive properties of cannabis used for recreational smoking.

Unfortunately, the DEA refuses to allow cultivation of hemp in the USA.

Man Photographing Phoenix Courthouse Gets Swarmed by Police Helicopter and "15+ Officers"

Chris | InformationLiberation

Another man who went out to "test" whether or not the local police would uphold his right to film got his answer swiftly after photographing a federal courthouse in Phoenix, Arizona.

A police helicopter shined a floodlight on him from the sky and he was summarily swarmed by a gang of armed officers threatening him, demanding he ID himself, and forcibly searching him for weapons, despite the fact he was legally open carrying in accordance with Phoenix law.

Despite their thuggish intimidation tactics, he boldly asserted his rights and refused to ID. The cops, at least one of whom could clearly tell he was just testing their response, whined at him for trying to "provoke an incident."

He astutely pointed out he was merely photographing a public government building, and it was they, the costumed criminals with the multi-million dollar taxpayer-financed helicopter flying overhead, that were creating an incident, not him.

Eventually the cops give up on harassing him and let him go, probably because he actually knew the law, and they clearly didn't, which was making them look stupid.

Jordan McManus, the man seen in the film, emailed Carlos Miller of 'Photography is Not a Crime' to give his side of the story:

My name is Jordan McManus, and I live in Chandler, AZ a suburb of Phoenix. I have been a fan of PINAC for quite a while and appreciate everything you do! Some time ago a story was posted about a man named Raymond Michael who was unlawfully detained and searched by Phoenix PD for taking pictures of the Sandra Day O?Connor Federal Courthouse in downtown Phoenix, and I?ve been a resident of the phoenix valley for over 12 years and I was having a hard time believing that PPD would respond in such a manner as AZ has some of the most respectable cops in the nation (in my opinion) compared to the rest of the country.

So tonight I set out to test them with a 1st and 4th Amendment test. I arrived at the Courthouse around 11pm. I parked my truck on Jefferson St and proceeded to walk the courthouse?s perimeter and towards the PPD HQ all while taking pictures. I had circled the PPD HQ and was on my way back to my truck when I saw two officers ahead of me about a block away, which is when I activated my camera. Just then, I was suddenly illuminated by a spotlight from a low flying Police Helicopter. That?s when I turned around to see what was going on (I had headphones in and was listening to music and didn?t realize the impending detainment) and I was being swarmed from every angle by PPD officers.

The PPD officer who initiated the contact tried to disarm me right off the bat. (I was open carrying my 1911 in a holster on my right hip). He was unsuccessful as I stood my ground and stated that I do not consent in seizures. Now I know I could have just kept my mouth shut and not played along with their game and not answered any of their questions, but I guess I have to admit it was kind of fun, as you can tell from some of my answers to the PPD questions.

Nothing dramatic ever really happened but I must say they sure did have one hell of a show of force with 15+ officers and an Air unit. I will admit, as my first time attempting to ?cop block? I was a little flustered at first, and totally forgot to get officers names and badge numbers, but hey it was my first time of many I?m sure. In the video you?ll hear me make a comment about how ?the only thing in my backpack is not a pressure cooker?, I said this because I overheard one of the officers behind me state that ?we need to search his backpack?, I felt like responding with a smart ass answer.

Below is the link to the video, and I apologize ahead of time for it being vertical and a little shaky it was clipped onto my backpack. Feel free to contact with any questions, and you have my permission to post any or all of this description, my name, and the video to your website if you desire, just please omit my contact information.

..."I felt like responding with a smart ass answer."

The last paragraph indicates that he didn't respond with a "smart-ass" remark, instead, he opted for the lame-aSS answer, likely, something along the lines of: "I'll comply."

I would give out my contact info. but, the noncompliant get their accounts deleted, (at SState's discretion, of course).

End of story. There is no American dream. Just a nightmare. Probable cause: A set of facts, circumstances, or reliable information that would lead a reasonable, prudent, and cautious police officer to believe that a crime has been committed and that a certain person committed the crime. Neccessary for search, seizure, or arrest.

Reasonable suspicion: Less than probable cause but more than a hunch that a crime is about to be committed, is being committed, or has been committed. Neccessary to stop and temporarily detain someone. A pat down may be conducted on an individual that the officer believes may be armed or who may pose a threat under certain circumstances. Very subjective and different for individual officers.

Contact: Any contact with an individual for official police related matters where the individual is free go without being detained or answering questions. Neccessary for the police to talk to you.

The police may observe and contact any person at any time and are well within the law, however, when they surround someone it has been determined that a stop is implied and the individual is not free to leave. The police must be able to articulate what their reasonable suspicion is. Unfortunately as a society we have lost the ability as a whole to be reasonable and to reason. Those who understand the big picture are not really prepared to do what has to be done to stop what is coming before it comes.

Good on you man, you did more then most. You handled the ignorant public servants with enough respect. I think its good that they showed up in great force...for all they knew, you could have been plotting a terrorist attack in the heart of downtown Phoenix. You call this little joke if yours a "test"? Real idiotic if you ask me.

Judge Scolds Jury for Getting the Verdict "Wrong"

ABC News:

COLUMBUS (Carol Luper/Ken Hines) -- A Franklin County judge may be subjected to disciplinary measures after chastising a jury for reaching a not guilty verdict in an assault trial.

Judge Amy Salerno expressed her dissatisfaction with a jury's verdict in open court at the conclusion of a recent trial, according to four jurors, who complained about the incident to Franklin County Administrative Judge James Green.

"The judge came off the bench, and she indicated she thought they had gotten the verdict wrong," Judge Green said.

"They were further told, 99 percent of the time, the jury gets it right. It's now 98 percent. They brought that percentage down by getting it wrong."

One of the jurors who spoke to Judge Green was visibly upset while describing the actions of Salerno, who also stated that she was not done with the defendant that had been acquitted.

"They reported to me [that] she made a comment to them, it was okay because she would have another chance to get this defendant because he had other charges pending," he said.
