Does Politeness Constitute Probable Cause?

In our supposedly free country, a police officer on patrol can stop and question a driver for practically any reason he can devise. Police officers, eager to find evidence of narcotics offenses or other illegal activity, are taught to ?build every stop? by looking for a pretext to search the vehicle. This can include what is described as suspicious body language ? which, according to some cops, includes excessive politeness.

About a year ago, Ohio Highway Patrolman Jared Haslar stopped a motorist named Joshua Fontane for supposedly driving 45 miles per hour in a 35 MPH zone. Fontane readily provided his license and other information. Haslar found Fontane?s ?body language and behavior? to be ?a little bit unusual? because it was ?overly polite.? On this basis, he called for backup from an officer with a drug-detecting dog. He then detained Fontane in his patrol car while the citizen?s vehicle was searched. A handgun and a small amount of marijuana were found in the car.

A trial court granted Fontane?s motion to suppress the evidence as the product of an invalid search. The Ohio Court of Appeals has upheld that ruling, but this probably won?t be enough to stop police from treating citizen courtesy as if it were suspicious.

An NYPD lieutenant shamed a detective in front of the entire squad, branding him a ?rat? for reporting misconduct to the Internal Affairs Bureau, two of his former colleagues confirmed.

The two detectives detailed the humiliation in sworn statements filed in connection with former Detective James Griffin?s federal lawsuit, which contends he retired after being publicly disgraced by his supervisor. Griffin had previously been threatened by fellow detectives, ostracized, and found the word ?rat? scrawled on his locker and a hole punched through his desk.

Griffin had refused to take the fall for a Brooklyn detective who bungled a homicide investigation by failing to interview the victim before he died.

LA County Sheriff's Department Hired Officers With Histories Of Misconduct

Despite background investigations that revealed wrongdoing, incompetence, or poor performance, the department still hired dozens of problem applicants in 2010, internal records show.

The Los Angeles County Sheriff's Department hired dozens of officers even though background investigators found they had committed serious misconduct on or off duty, sheriff's files show.

The department made the hires in 2010 after taking over patrols of parks and government buildings from a little-known L.A. County police force. Officers from that agency were given first shot at new jobs with the Sheriff's Department. Investigators gave them lie detector tests and delved into their employment records and personal lives.

The Times reviewed the officers' internal hiring files, which also contained recorded interviews of the applicants by sheriff's investigators.

Ultimately, about 280 county officers were given jobs, including applicants who had accidentally fired their weapons, had sex at work and solicited prostitutes, the records show.

For nearly 100 hires, investigators discovered evidence of dishonesty, such as making untrue statements or falsifying police records. At least 15 were caught cheating on the department's own polygraph exams.

Twenty-nine of those given jobs had previously had been fired or pressured to resign from other law enforcement agencies over concerns about misconduct or workplace performance problems. Nearly 200 had been rejected from other agencies because of past misdeeds, failed entrance exams or other issues.

Several of those with past misconduct have been accused of wrongdoing since joining the department, including one deputy who was terminated after firing his service weapon during a dispute outside a fast-food restaurant.

David McDonald was hired despite admitting to sheriff's investigators he had a relationship with a 14-year-old girl whom he kissed and groped. He was 28 at the time.

"I was in love," he said in an interview with The Times. "I wasn't being a bad guy."

McDonald had been fired from the Santa Clara County Sheriff's Department amid allegations he used excessive force on prisoners. A fellow deputy told a supervisor that he didn't want to work with McDonald because he harassed inmates.

L.A. County sheriff's officials made him a jail guard, a decision that surprised even McDonald.

"How can you put me back in the jails when I already had a problem there?" McDonald told the newspaper.

'It's Kidnapping': Hospital Takes Custody of Teen Because Her Parents Were 'Too Active in Pursuing' Her Care

A 15-year-old is stuck in a Boston hospital after the medical facility took custody of her when her parents argued against her diagnosis.

For the last nine months,?Justina Pelletier has been sneaking messages to her parents in Connecticut through folded origami notes.

"It is kidnapping," Lou Pelletier, the girl's father, told WTIC-TV.

The local news station?investigated the case, for which a judge later issued a gag order,?and has the background leading up to the ongoing custody battle:

Justina was diagnosed with mitochondrial disease a few years ago. It's a genetic disorder that can cause loss of muscle coordination and weakness.

Despite that diagnosis she lived a normal life.

But last February, she also got the flu and was admitted to Boston Children's Hospital to see her specialist.

Almost immediately, a different team of doctors delivered a different diagnosis, questioning the original diagnosis of mitochondrial disease.

"They came in, and they said we cannot take Justina out of the hospital. They called DCF," says Linda Pelletier, Justina's mother.

They said Justina had "somatoform disorder."

In short, they were saying she suffered from a mental illness, not mitochondrial disease.

Her parents, Lou and Linda Pelletier, were escorted out of the hospital by security, and within four days, they lost custody of Justina.

The parents have been fighting the system ever since.

"They were actually being accused of being too active in pursuing health care matters for their child," West Hartford psychologist Dean Hokanson, who has worked with Justina for five years, told WTIC.

"If We Have To Get A Warrant... We're Gonna Shoot & Kill Your Dogs... Ransack Your House"

A Kansas lawyer says cops told him if he doesn't let them search his home despite not having a warrant they would come back with one and bust into his home with a battering ram, kill his dogs, and then ransack his house.

The cops were searching for two suspects believed to be violating their parole, evidently they felt the men were hiding in this stranger's home. When Eric Crinnian refused to let the cops search his house, he says one officer threatened him saying, ?If we have to get a warrant, we?re going to come back when you?re not expecting it, we?re going to park in front of your house, where all your neighbors can see, we?re gonna bust in your door with a battering ram, we?re gonna shoot and kill your dogs, who are my family, and then we?re going to ransack your house looking for these people.?

Crinnian still refused despite their intimidation and filed a complaint with the police. The police department said they won't comment on an ongoing investigation.

Drunk Cop Who Pulled Gun On Bartender Gets Community Service, Keeps Job & Pension

A drunk police officer who plead guilty to menacing for pulling a gun on a bartender will be allowed to keep his job and retire with a pension thanks to a favorable ruling by a Nassau County, Long Island judge.

District Court Judge Rhonda Fischer sentenced Richard Hefferon, a 20-year veteran police officer, to only 150 hours of community service and a $500 fine.

From CBS New York:

?That night, he made a mistake. He made a profoundly bad mistake ? ,? defense attorney Robert McDonald told CBS 2's Jennifer McLogan. ?The court and the DA?s office have both realized that the measure of this man is more than just that one mistake.?

2014 will mark Hefferon?s 20th year as a cop, making him eligible to retire with half pay and full benefits.

?And now he?s going to get out with a pension, and we?re all going to pay for this,? Ball [the victim] said. ?If it was anybody else, they?d throw the book at him.?

Because it's a police officer entrusted to uphold the law the charges should be even more severe, instead he gets off easy because his fellow parasite in the ruling class gave him a second chance. Sadly, many officers just like this one given "second chances" end up murdering someone.

This Week's Corrupt Cops Stories

Cops in the drug war this week are accused of stealing snitch money, lying to get search warrants, growing and peddling pot, and engaging in a little coke-smuggling. Let's get to it:

In Miami, a former TSA supervisor was indicted last Wednesday for helping to smuggle at least 11 pounds of cocaine through the Virgin Islands. Dwight Durant, 44, is accused of conspiring with another Virgin Islands resident to traffic cocaine during the first eight months of 2012. He is charged with participating in a trafficking conspiracy and is looking at 10 years to life in prison if convicted.

In Buffalo, New York, a Buffalo police officer was arrested last Wednesday on charges he was growing and selling marijuana. James Hamilton, Jr., went down after he sold $1,100 worth of weed to a snitch. He was then arrested, and a subsequent search of his home revealed a grow op with 82 plants and four pounds of processed weed. He is charged with possession with intent to distribute and distribution of marijuana; manufacturing and possession with intent to distribute 50 or more marijuana plants; maintaining a premises for the purpose of manufacturing and distributing marijuana; and possession of a firearm in furtherance of a drug trafficking crime. He's looking at between five years and life in prison.

In New Orleans, two New Orleans police detectives were indicted last Friday on charges they conspired to steal thousands of dollars in funds that were earmarked for paying confidential informants. Rafael Dobard, 39, and Quincy Jones, 33, had been assigned to the Fourth District Narcotics Unit. They also got nailed for falsifying time sheets, and Dobard is also charged with paying bribes to other detectives in the unit. They are both on emergency suspension.

In Baltimore, a Baltimore police officer was arrested last Friday for lying to obtain a search warrant in a drugs and guns case. Thomas Wilson III, a 19-year veteran, is accused of lying when he said he saw a suspect leaving a home carrying a black bag. Wilson also had earlier problems with truthfulness; in 2003, a federal judge said an affidavit he filed in a case was packed with "knowing lies" and threw the case out. Then, he got a short suspension; now, he is charged with perjury and official misconduct.
