'It's Kidnapping': Hospital Takes Custody of Teen Because Her Parents Were 'Too Active in Pursuing' Her Care

A 15-year-old is stuck in a Boston hospital after the medical facility took custody of her when her parents argued against her diagnosis.

For the last nine months,?Justina Pelletier has been sneaking messages to her parents in Connecticut through folded origami notes.

"It is kidnapping," Lou Pelletier, the girl's father, told WTIC-TV.

The local news station?investigated the case, for which a judge later issued a gag order,?and has the background leading up to the ongoing custody battle:

Justina was diagnosed with mitochondrial disease a few years ago. It's a genetic disorder that can cause loss of muscle coordination and weakness.

Despite that diagnosis she lived a normal life.

But last February, she also got the flu and was admitted to Boston Children's Hospital to see her specialist.

Almost immediately, a different team of doctors delivered a different diagnosis, questioning the original diagnosis of mitochondrial disease.

"They came in, and they said we cannot take Justina out of the hospital. They called DCF," says Linda Pelletier, Justina's mother.

They said Justina had "somatoform disorder."

In short, they were saying she suffered from a mental illness, not mitochondrial disease.

Her parents, Lou and Linda Pelletier, were escorted out of the hospital by security, and within four days, they lost custody of Justina.

The parents have been fighting the system ever since.

"They were actually being accused of being too active in pursuing health care matters for their child," West Hartford psychologist Dean Hokanson, who has worked with Justina for five years, told WTIC.

Copyright Monopoly Disintegration Inevitable As It Only Takes A Single Country

The emergence of experimental legally autonomous startup zones in Honduras and other places is one of the most exciting developments in a long time, and forebodes the collapse of the copyright industry?s tyranny over culture and knowledge.

I believe in competition. I believe in experimentation to see what works best and what can be predictably repeated ? call it the scientific method applied to society, if you like. This has been a problem geopolitically, as the United States has guaranteed its global rent-seeking by bullying other countries into so-called ?free trade? agreements that are, in the best kind of newspeak, the exact opposite: they are agreements to prevent free trade in favor of incumbent monopoly holders.

But a monopoly only lasts as long as all involved countries respect it. In particular, a monopoly that touches the Internet ? one such as the copyright monopoly ? requires the cooperation of every single country connected to the Internet to live yet another day. The first country to defect from this oppressive monopoly construct will cause the floodgates of culture and knowledge to open ? imagine The Pirate Bay located in a country where it is declared 100% legal, and where it is rightly illegal to harass its enormous library.

Three geopolitical zones stand to threaten the US dominance on this rent-seeking and the monopolies we know as the copyright and patent monopolies:

We have Europe, which has strength in its civil liberties tradition and its sheer economic strength ? it is the world?s largest economic power, and so, any monopoly Europe doesn?t like just ceases to exist for all intents and purposes. Regrettably, European political leaders are perennially starstruck by anything the United States does, and won?t be challenging them any time soon, unless challenged in turn on the matter by something like the Pirate Party. (When it happens anyway, like with the ACTA defeat last year, it is due to citizen outrage ? not because of any kind of political will.)

We have China, which has a different cultural and idealistic tradition than Europe and the Americas ? Asia works on a timescale of generations and centuries, rather than one of weeks and months. There is patience to a degree unheard of in the West. The Chinese have economic clout comparable to the US and Europe, and are anything but stupid. They are copying the Intellectual Protectionism (IP) regimes of the United States, seeing how they can benefit the Chinese once China has taken the lead: protectionism works to preserve incumbence, and the Chinese understand this perfectly. So while the mechanisms may be preserved, their initial purpose may be subverted to a new geopolitical power than the one they were constructed to maintain.

Lastly, there is Latin America, which holds no love for the United States on any level after the interventionism of the past 50 years. Economically, they have half the GDP of the US or Europe, and so, they can?t compete on brute strength. However, they can compete with raw competition of the framework, and this appears to be one of the most exciting geopolitical developments in a long time.

Yesterday, it became clear that legally autonomous startup zones (plural) will be established in Honduras and other locations, with Panama and Guatemala watching the developments with great interest. A legally autonomous zone is a small location that gets to write its own experimental laws, in order to compete on a small-scale with country-level laws to find out at a laboratory scale if something works immensely better.

As many of these are planned in Latin America, and Latin America is rightly and royally sick of the copyright monopoly, I?m hopeful that one, just one, of them will ditch that monopoly concept in favor of real free trade and actual ownership rights. On an international network, it only takes one single country to declare the copyright monopoly obsolete for the entire planet to lose any and all copyright monopoly function. Now, we?ve arrived at the point where it only takes a single autonomous Internet-friendly startup zone to do so.

To illustrate, the book 1984 by George Orwell is still under copyright monopoly in the United States and Europe, but not in Australia, where it is published as public domain. This is something that is thoroughly illegal to distribute in Europe and the United States, but you can access it from there just fine, because it is legal to distribute in Australia, and Australia is connected to this thing we know as the Internet.

Now, imagine if one country ? or one autonomous zone ? desired to do this for all of humanity?s knowledge and culture, as part of free trade and free judicial competition.

The future looks immensely bright, and there is no copyright monopoly there at all. It only takes one single jurisdiction to topple the entire oppressive construct worldwide.

Hero Cop Takes On 2-Yr-Old In His Care

Here's another one of those "heroes in uniform" that keeps us so safe.

AL.com reports:

MOBILE, Alabama -- The Prichard police officer arrested Friday and charged with aggravated child abuse is believed to have attacked a 2-year-old girl multiple times while she stayed with him over the summer, according to the Mobile County Sheriff's Office.

Bryan Aadam Pearman, 24, has been charged with one count of aggravated child abuse in the case, a felony with a maximum sentence of 20 years.

Investigators say the 2-year-old victim sustained multiple injuries, including reported head injuries and bruising, while she was staying with Pearman over the summer, said Sgt. Joe Mahoney of MCSO.

"The injuries were consistent with really going above and beyond, you know, like a pat on the butt," Mahoney said. "I mean, what can a 2-year-old do to deserve that?"

Pearman joined the Prichard Police Department in October 2011. He graduated from the police academy in July 2012, according to posts to his social media page.

One year later, on July 30, a woman called the Child Advocacy Center to report Pearman had abused her 2-year-old daughter. The child's mother reported the suspected abuse after she and her daughter were reunited, Mahoney said.

"The investigation took a while, but the child was placed back with her mother and that gave us time to really strengthen our case," Mahoney said.

AL.com reports the officer had previously faced charges for shooting his neighbors dog with a .22 rifle as it was returning to its home after playing with some neighborhood children. AL.com notes Pearman "was set to go before a jury on March 22, 2010; however, the charge was instead dismissed with conditions."

Hero Cop Takes On 15-Yr-Old Strapped To Gurney

DENVER ? A former Adams County Sheriff?s Deputy was sentenced Monday to five years in prison for punching a teenager in the face while the teen was strapped to a gurney, District Attorney Dave Young?s office announced.

[...]Morrow had responded to a disturbance call at 8790 Welby Road in Adams County. According to court records and evidence presented during the trial, the 15-year-old boy, who appeared highly intoxicated, was taken into custody and transported by ambulance to the hospital because parent contact information could not be obtained from him.

The ambulance attendant had restrained the juvenile?s hands and feet because of his verbally combative behavior. Morrow struck the juvenile on the face with a closed fist while the teen was restrained on the ambulance gurney.

How heroic. Be sure to thank the officer for his "service."

CPS Takes Baby After Mom Asks For Second Opinion From Doctor


SACRAMENTO, CA - A Sacramento family was torn apart after a 5-month-old baby boy was taken from his parents following a visit to the doctor.

The young couple thought their problems were behind them after their son had a scare at the hospital, but once they got home their problems got even worse.

It all began nearly two weeks ago, when Anna Nikolayev and her husband Alex took their 5-month-old boy Sammy to Sutter Memorial Hospital to be treated for flu symptoms, but they didn't like the care Sammy was getting.

Cop Detains Woman, Allegedly Takes Her To Dark Alley & Asks To See Her Breasts

Juan Senabre, a six-year veteran police officer with the Homestead police in Florida, allegedly has a unique way of getting his jollies. After arresting a woman for having a suspended licence, he allegedly drove her to a dark alley, turned his lights off and allegedly told her, ?I?m going to help you so you don?t go to jail," ?Have you ever been with a crazy policeman??

Here?s what happened, according to city documents:

Zenaida Figueroa-Ortiz and her boyfriend parked on the side of Krome Terrace to eat some food they had just bought. While they were parked, Senabre drove by twice in his police car.

The couple decided to drive a short distance to a friend?s house, where Senabre stopped Figueroa-Ortiz as she stepped out of her car, telling her she had a suspended license.

Figueroa-Ortiz later told internal affairs investigators that Senabre told her she would be arrested, and put her in his police car. But he didn?t take her to the police station.

Instead, Figueroa-Ortiz claimed Senabre drove around the corner to a dark apartment complex, and turned off the car?s headlights.

?I?m going to help you so you don?t go to jail,? Senabre said, according to Figueroa-Ortiz?s statement.

Then, she told investigators, he asked, ?Have you ever been with a crazy policeman??

Figueroa-Ortiz told investigators she told Senabre she?s ?not that type of girl,? and asked to be taken to jail. Senabre then asked to see the woman?s breasts, according to the internal affairs report.

When she refused, Senabre allegedly asked to see Figueroa-Ortiz?s bra. She still refused, and a car started coming toward where they were parked.

Senabre turned on his headlights and took Figueroa-Ortiz back to her friend?s home, telling Figueroa-Ortiz to meet him at court the next day to take care of her suspended license.

Although the cop was fired over this incident, he is taking his case to so-called "arbitration." Chances are he will be reinstated, with full back pay, and this whole incident will end up being nothing more than a paid vacation.

U.S. media takes the lead on Iran

Many have compared the coordinated propaganda campaign now being disseminated about The Iranian Threat to that which preceded the Iraq War, but there is one notable difference. Whereas the American media in 2002 followed the lead of the U.S. government in beating the war drums against Saddam, they now seem even more eager for war against Iran than the U.S. government itself, which actually appears somewhat reluctant. Consider this highly illustrative, one-minute report yesterday?from the nightly broadcast of?NBC News with Brian Williams, by the network?s Chief Pentagon Correspondent Jim ?Mik? Miklaszewski,?which packs multiple misleading narratives into one short package:

We?re told that if the U.S. ends up in a war with Iran, then ?the U.S. Navy?s Fifth Fleet would be the world?s first line of defense?: because Iran is threatening the entire world, and the U.S. would be defending ?the world? from this grave Persian menace. Then there?s the ominous claim that ?Iranian leaders have threatened all-out war?: but that?s ?if Israel launches air strikes against Iran?s nuclear program,? which would already itself be ?all-out war.? The NBC?story ? which begins with video shots of Iranians in lab coats lurking around complex, James-Bond-villain-like nuclear-ish machines ? ends with twenty seconds of scary video footage of Iranian missiles being launched, accompanied with this narration: ?U.S. officials warn that Iran?s massive stockpile of ballistic missiles is the more serious threat?; after all, ?within just the past few days, Iranian leaders [cue video of a scary, ranting Ahmedinijad] have threatened that if attacked, they would launch those missiles at U.S. targets.?

Senator Leahy Praises US Gov't Censorship Of Websites As ICE Takes Another Victory Lap

It really would be kind of funny to watch the US government congratulate itself for censorship of websites if it wasn't just kind of sad. At a Senate Judiciary committee hearing on intellectual property issues, Senator Patrick Leahy (top 3 campaign contribution sources: lawyers, entertainment industry, lobbyists -- you can't make this stuff up) praised administration officials for censoring websites based on questionable accusations from an entertainment industry who seems to think that their own content creators are running "pirate" websites.

Of course, Leahy apparently doesn't recognize the irony of condemning internet censorship in other countries while praising it at home when it benefits his biggest campaign contributors.

The same hearing gave ICE assistant director Erik Barnett one more chance to declare victory, though I note with some amusement that the text of Barnett's speech this time leaves out the bogus claim that no sites are challenging the seizures. Apparently he's realized that some people might call him on it when he blatantly misrepresents reality.

Either way, none of this dog and pony show is much of a surprise. You certainly wouldn't expect Senator Leahy to call one of the people who had their sites illegally seized to hear their side of the story. I mean, that might be embarrassing to actually hear that there's more than one side to this. He might have to hear about how the content creators themselves sent the content in question to these sites, and how the ICE affidavit to seize them misstated the facts of whether or not the content was infringing. He might have to hear how ICE didn't even ask the actual copyright holders, in most cases. He might have to hear how ICE doesn't seem to understand the technology, and doesn't seem to understand the difference between linking and distribution. He doesn't have to hear about how hardworking people who helped promote new artists and build their careers now live in fear of their own government. He doesn't have to hear about how these people are afraid to speak out, because the Justice Department has told them that if they do, they may face criminal charges.

No, it's easier to put on a show and pat yourself on the back for censoring those people and pretend that you've done something productive.
