Video Shows Cops Slam Man's Head Into Wall, Mace Him After He Stumbles To Ground, Laugh About It

Disturbing video has surfaced of police officers throwing a man into a wall, then macing him after the stumbles to the ground in a disorientated stupor. The cop who maced the man gets a big smile on his face, then the cops together are seen laughing as the man is lying on the ground maced with his face and head smashed up. The victim said he had brain injuries, chipped teeth, and was left with a permanent lump on the back of his head from the assault. Nothing happened to the police involved as the man says he couldn't find his lawyer who had the video for two years.

After posting the video to YouTube the officers involved were just put on paid leave. The police chief said they were not aware of the incident until the video was posted to YouTube, but they're conducting an "investigation."

Here's the victim, Michael Bergeron, Jr.'s account of what happened as posted to YouTube:

"charged with a dwi and tried explaining that I wasn't drunk and they could be out catching actual criminals. then after being in the cell for a while waiing for a bail bonds man I was taken out and brought in the booking room to call for a ride. after calling a ride I was told I could take my phone that I called from and my wallet. as soon as I greabbed my wallet from the table he officer with the glasses came at me saying he never told me I could take my stuff and choked me against the wall then tried to grab the wallet from my pocket. once he got the wallet and my phone this is what happened. there was no lawsuit made due to the fact I found a lawyer and the lawyer took the tapes and disappeared for 2 years until I finally tracked him down and go it back but now I think its to late to do anything with it even though I have a permanent lump on the back of my head chipped teeth and brain injuries but talking to a lawyer soon well see what happens."

Liberals And Conservatives Switch Positions On NSA Surveillance Depending On If 'Their Guy' Is In Power

Orin Kerr has pointed out that people who self-identify themselves as "liberals" or "conservatives" seem to shift their opinion on NSA surveillance depending on whether or not it's "their guy" in the White House. That is, back when George W. Bush was President, "Democrats" disapproved of the NSA's surveillance activities, with only 27% approving it. "Republicans" on the other hand, had a 75% approval of the NSA's activities, which were known to include warrantless wiretapping. Fast forward to today, and we have "liberals" being split down the middle between being concerned and not concerned, but conservatives having 77% either "very concerned" or "somewhat concerned" about the surveillance (48% falling into the "very concerned") category. Kerr notes that the two surveys may not be completely comparable -- the questions were not identical, and one study was based on political party, while the other was based on ideology (which might not match up). But, at the very least, it does suggest a general sense that people are much more comfortable with surveillance when "their guy" is in power, and against it when they dislike the President.

That's troubling on any number of levels, but hopefully it serves as a point to a useful tool in convincing those who trust "their guy" not to abuse the system: just ask them how comfortable they'll be when "the other guy" is in power after the next election?

Police Shoot Man Assembling Toy Gun While Sitting In His Own Car

Department spokesman Capt. Rod Light said Casey Gilette, 29, was on a routine patrol about 3 a.m. when he noticed a vehicle had been parked at Classic Auto Wash, 907 E. Nob Hill Blvd., for more than an hour. Light said that based on a preliminary investigation, Gilette approached the vehicle and opened the passenger-side door. He saw a man in the driver?s seat with what appeared to be a handgun and his finger on the trigger. He then fired, Light said.

?Once investigators got on the scene, it was later determined that the handgun was a replica of an actual firearm,? Light said. ?It?s what I would refer to as an Airsoft gun, but they appear very real.?

Airsoft is a trademark name for replica firearms that fire plastic pellets. They are designed to be nonlethal and often come in realistic replicas. Such devices typically have an orange tip at the end of the barrel intended to indicate it is not a real firearm.

?I believe this particular handgun had an orange tip. But based on our investigation I don?t want to go into particulars and details of the position of the gun and where the officer was. It was 3 a.m., it was dark and again we haven?t interviewed this officer yet and we don?t want to speculate,? Light said.

Gilette had another person with him while on patrol, Chief Dominic Rizzi Jr. said Monday afternoon.

?Yes, he did have a ride-along with him, and there?s nothing inappropriate about that,? said Rizzi, who declined to identify the person.

Police have yet to interview Gilette. Under the police union contract with the city, an officer involved in a shooting is not required to give a statement until 48 hours after the incident, although officers may waive that waiting period if they choose to.

Although the investigation is in the preliminary stages, Rizzi said Monday morning that he believes that Gilette acted appropriately.

?Based on the preliminary investigation, I absolutely stand behind the officer and his actions in the shooting that occurred,? Rizzi said.

Light said the investigators believe that Arias was attempting to assemble pieces of the pellet gun, because they found discarded packaging for accessories in the vehicle.

Having a real gun in Washington is not a crime, nor is it grounds for summary execution. This was a toy gun, which the man was said to be assembling within his own car. The officer approached him, opened his door, then executed him. No doubt he'll claim "self-defense" and say he "feared for his life."

Opening the car door is a violation of this man's rights. Hopefully the family will sue for a couple million. Summary execution sums it up well. Police are being "knighted" via FPO/FFO malingering every cop that does this knowing full well they are backed to kill whom ever they like w/o accountability to the victim. Mirrors Inquisition. It's a mistake to let him get away w/this, but people are in some kind of a ha-ha-hapee-ness stupor and just are NOT getting the big picture, my opinion. The fact that someone removes comments no matter what they are is unamerican. Do not suppress or you are part of the problem.

Get Ready to Pay More Online: Supremes Refuse to Hear Internet Tax Case

In another blow to the Constitution, the Supreme Court on Monday declined to hear a case by Amazon and Overstock.com challenging a law that requires online retailers to collect sales tax in states where they have no physical presence. The Supreme Court refusal to hear the case will allow state governments to tax online retailers and turn online retailers into de facto tax collection agencies.

The Court had previously held that under the Commerce Clause (Article I, Section 8, Clause 3) and the Due Process Clause of the Fourteenth Amendment states may not impose tax responsibility on out of state sellers that do not have a physical presence in the state.

"Some say that it is a legitimate exercise of Congress's Commerce Clause power to give state governments the authority to force out-of-state businesses to collect sales taxes," Ron Paul wrote in September. "But if that were the case, why shouldn't state governments be able to force you to pay sales taxes where you physically cross state lines to make a purchase? The Commerce Clause was intended to facilitate the free flow of goods and services across state lines, not to help states impose new burdens on out of state businesses."

Now that the Supremes have declined the Amazon case, Congress will be free to impose burdensome taxation and other regulations on the internet. Earlier this year, the Senate passed the Marketplace Fairness Act, legislation widely dubbed a national internet sales tax. The law requires 10,000 jurisdictions -- including 46 states, six territories, and over 500 Native American tribal nations -- to collect sales tax for government.

"By giving state governments the power to tax Internet retailers, the Marketplace Fairness Act further undermines our already moribund system of federalism," explains Glenn Jacobs. "One of the key components of federalism is competition between the states. The idea is that the better the state, the more attractive it will be to individuals and businesses."

Internet sales taxes are especially appealing to state governments looking to impose new taxation on citizens to address budget shortfalls. According to projections by Forrester Research, internet retailers may eventually fork out more than $3 billion annually for cash-hungry states.

"Advocating higher taxes, even on your competition, ends up hurting everyone," writes Jacobs. "But the people that are hurt the most are consumers, everyday working families. The Marketplace Fairness Act will end up forcing consumers to pay higher prices for the goods they desire. It will limit consumer choice. As with all tax programs, it will transfer resources from the productive sector of the economy to the parasitic sector, thereby inhibiting capital formation and investment. It will put shackles on one of the economy?s fastest growing sectors, Internet commerce."

NYPD Cop Arrested For Extorting Restaurant Owner


A NYPD cop and two fellow thugs ? including a reputed gangster who was involved in a fatal stabbing of a groom-to-be ? were arrested Tuesday for extorting monthly "protection" payments from an Albanian restaurant in Queens, federal authorities said.

The cop, Besnik Llakatura, conspired to shake down the restaurant owner with Llakatura playing the role of the good cop with the victim who was his friend, authorities said.

The restaurant owner went to Llakatura, a friend, and asked what he should do. Lakatura advised the restaurant owner from reporting the extortion telling him he had no choice but to make the payments, authorities said.

The victim shelled out $24,000 over five months for the phony protection.

In a phone call intercepted by the feds, Llakatura jokingly referred to how he "taxes" local businesses, according to court papers filed in Brooklyn Federal Court.

Also charged were Redinel Dervishaj ? who allegedly warned the victim that he had to pay up because he had opened the restaurant in "our neighborhood" ? and Denis Nikolla who allegedly menaced the victim at gunpoint when he initially refused their threats.

"The defendants told their victims they offered 'protection' but in reality they peddled fear and intimidation through the Albanian community," said Brooklyn U.S. Attorney Loretta Lynch.

Debunking the Myth of the Hero Cop

In a recent article?at The Independent Political Report, James Gray perpetuates the fairy-tale of the police as heroes?to be looked up to. He writes, ?One of the most noble public servant positions in our society is a police officer. These men and women often have difficult jobs, and frequently do not get the credit and appreciation they deserve.? If police were these heroes, then stories of botched drug raids would not be a standard news story. People would be outraged every time they heard about an officer killing a family pet, or an innocent human being, because it would be so unusual. Instead, these stories are routine, because the image of police as heroic public servants is a myth.

I would like to first state that Judge Gray does give one good piece of advice for anyone who is ever stopped by police, "keep your hands in plain sight." This should be done for your own safety, because the police often overreact when they are startled. I have first-hand experience in this. The only time I have ever had a gun drawn on me, it was from a police officer who was responding to a suspected robbery, but he was at the wrong house. If I had made any sudden movements I would likely have lost my life. On another occasion an officer stopped me for a seat belt violation, and when he?approached my vehicle he had his hand on his weapon. I put my hands on the wheel for my own safety, because you never know what behavior to expect, although police tend to be on their best behavior when they know they?re being filmed.

It was recently reported that police have killed over 5,000 Americans?since September 11, 2001, almost as many US soldiers that have been killed occupying Iraq. According to the CATO Institute's National Police Misconduct Reporting Project, in 2010 there were 4,861 unique reports of police misconduct involving 6,613 sworn officers and 6,826 alleged victims.

In a rare case of officer accountability, Charlotte-Mecklenburg Police Officer Randall Kerrick was charged with voluntary manslaughter after firing his weapon "several times" at Jonathan Ferrell, who was running to the police for help after wrecking his vehicle. The Ferrell family may find justice, but the majority of aggrieved families aren?t so lucky. In May 2010, seven year old?Aiyana Jones was killed by a SWAT team as she slept on her couch at 3am.?Her killers burst into the wrong apartment, but no charges were filed.?Indianapolis Police Officer David Bisard was on duty, driving a Metro Police cruiser when he plowed into a group of four riders on three motorcycles stopped at a red light -- one rider was killed & two others critically injured. Bisard was found to be intoxicated, though no charges were filed because "the blood test had been mishandled and no other evidence supported the DUI charge." There are also countless stories of women being sexually assaulted by police officers, and countless other stories of sexual assault that are never reported. Do these sound like the actions of noble heroes?

People will often claim "those are just a few bad apples." If that were the case, then why don?t the "good cops" who are supposedly the super-majority, ever do anything about these "bad apples"?

there are no good cops thats why. Society has unfortunately accepted that police can do ANYTHING if they feel "threatened", including kill. As has been pointed out here, police work, while somewhat dangerous, doesn't even make the top ten list. Convenience store workers are more in danger. What if they just started shooting anyone in the stop n go that made abrupt movements? The no knock raids of course should be used judiciously (literally...) and an end to blunt violence as the go method for cops. How about using smarts instead of force? I've had guns pointed at my face by police officers on two occasions. On neither occasion were they either subjectively or objectively justified in doing so. For whatever reason, they just wanted to point their guns directly in my face.

These incidents have led me to believe that most cops are really just waiting for the opportunity to shoot somebody.

every dept posing as public safety is in fact the same as blackwater, a private for profit enterprise. they conduct commerce , ie you and yours as goods, ie human trafficking. You are no safer conducting business with these companies than they were 2,000 years ago when they called themselves romans, the state commerce, ie slavery was king and they clung to their symbol of an axe wrapped with 13 rods called the fasces which is proudly served to you today in the shield of the national sheriffs assn. the depraved masses glorify cannibals clothed in costumes, the swashbuckler pirates seeking booty for the charter called the marque granted by the kings of the time. Not all cops are bad. Their problem, like the rest of society, is if they speak up they get their ass handed to them. Making blanket statements just makes you look like an ass. All cops are derilics and useless. They are a criminal gang that violates peoples rights. The cops that are allegedly good and don't abort this gang called police are cowards. Good article. Good point.

I think the good cops are now out numbered....
and that can only happen if nothing is done about the
bad...

Unfortunately, finding good people in high places these days
is extremely rare.

It will continue to get worse until "we the people"
(who out number them by the thousands) do something to
put an end to the crooks in charge.

Power in numbers.
Too many couch potatos.
