Fraternal Order Of Police Lobbies For New Federal Hate Crime Law

Nation's biggest police union boasts that it has spent years lobbying for more federalization of crime and punishment.

The 300,000-member Fraternal Order of Police (FOP) is demanding that the U.S. Congress and President Barack Obama ?act now? to expand the federal hate crimes statute and add police officers as a protected class.

In a recent press release, the police union boasts that it has spent years lobbying for more federalization of crime and punishment. The presser cites a handful of recent incidents, nationally, in which police officers were attacked while on the job.

?Enough is enough! It's time for Congress to do something to protect the men and women who protect us,? said union president Chuck Canterbury.

The federal government?s 1969 hate crime law has been expanded several times and already criminalizes [attempted] bodily injury against anyone based on race, religion, ethnicity, nationality, gender, sexual orientation, gender identity, and disability. Penalties for committing a ?hate crime? extend to up to 10 years in federal prison.

The FOP proposal would add the basis of ?uniform? to the current list.

There are two main principled reasons to oppose all federal hate crime legislation. First, is the basic legal tenet that all people should be treated equally in the eyes of the law. The judicial process should not be dependent upon the demographics of the victim or defendant. This is the reason that ?Lady Justice? wears a blindfold while holding the Scales of Justice. Violence against anyone ? regardless of the identities or beliefs of those involved ? should be prohibited equally and impartially in a fair and just system.

Secondly, the federal government has no legitimate authority to create such laws. The U.S. Constitution ? specifically Article 1, Section 8 ? offers no mention of the federal government having the ability to prohibit crimes of violence between citizens for any reason. Crimes such as assault and murder are properly prohibited at the state-level and are enforced by state or local agencies ? not the FBI. To broaden the scope of federal law enforcers is a mistake and a move toward more centralized authoritarianism.

Readers are advised to oppose the Fraternal Order of Police?s agenda to nationalize crime statutes and create legally protected classes of citizens.

North Carolina: Driving While Nervous is Not a Crime

The second-highest court in North Carolina last week ruled police had no business stopping a car because its occupants appeared to be driving while nervous. On April 15, 2011, a pair of Sampson County sheriff's deputies were running a speed trap on Interstate 40 when they noticed a green minivan. Corporal Bass and Pope each testified the vehicle slowed from 73 MPH to 65 MPH in the 70 MPH zone and that the driver and passenger stared straight ahead and "appeared nervous" as they passed.

The officers pulled out and caught up to the minivan. When the patrol car pulled along side, the minivan occupants did not make eye contact. The deputies claimed they saw the vehicle cross the fog line and was driving slowly, so they pulled it over for "unsafe movement." A dashcam video of the incident shows no crossing of the fog line or other evidence of unsafe driving.

Gina Canty, the driver, was given a warning. She also consented to a search that uncovered a revolver and a rifle in a suitcase belonging to the passenger, her ex-husband Nathaniel Canty. A Sampson County Superior Court judge found Nathaniel Canty guilty of being a felon in possession of a firearm. On appeal, a three-judge panel began poking holes in the police account of events.

"We find it hard to believe that these officers could tell Ms. Canty and defendant were 'nervous' as they passed by the officers on the highway and as the officers momentarily rode alongside them," Judge Cheri Beasley wrote for the court.

The judges also dismissed the idea that the minivan's slowing after seeing a patrol car running a speed trap.

"The reduction in speed standing alone could be explained a number of different ways, including normal apprehension many people feel when approaching a law enforcement officer," Judge Beasley wrote. "Nervousness, failure to make eye contact with law enforcement, and a relatively small reduction in speed is 'conduct falling within the broad range of what can be described as normal driving behavior... Based on the totality of the circumstances, these officers lacked reasonable suspicion to initiate the traffic stop that resulted in the search and seizure of the weapons in this case."

The judges declared the lawyer in this case should have filed a motion to suppress the evidence gathered during the traffic stop. Because the defense counsel was "ineffective," the three-judge panel ordered a new trial in which the motion to suppress would likely succeed.

Apparently, 99% of Mr. Sherlock Holmes' findings would also be ruled "insufficient". If police officers was able to _correctly_ detect the crime just by momentarily looking at the passing vehicle, they only can be commended for their skill.

Why would someone consent to the search of the vehicle, is totally different question. Especially knowing that illegal items will be found. First they allow search, then they scramble to suppress what was found. Wouldn't it be easier to simply say "No, I don't consent"?

A State-Sponsored Anti-Sikh 'Hate Crime' the Media Ignores

Deranged ex-federal employee Michael Page, a former Army psy-ops specialist, committed what has been variously described as a "hate crime" and an act of "domestic terrorism" by murdering six people gathered for worship at a Sikh Temple in Oak Creek, Wisconsin. Since the alleged murderer is dead, we can only speculate as to his motives (and those of his reported accomplices, as well).

There is little room for speculation, however, regarding to attitudes and motives of a uniformed assailant who severely beat an innocent and helpless Sikh in an incident that took place five years ago about 112 miles south of Oak Creek. The perpetrator's motive was to steal the victim's property, and it there was no ambiguity about the fact that he despised the victim on the basis of his perceived ethnicity.

Thankfully, the victim -- Joliet, Illinois resident Kuldip Singh Nag -- wasn't shot. However, he was pepper-sprayed and severely beaten on the morning of March 11, 2007 by a police officer named Ben Grant, who materialized on his doorstep to announce that he was going to tow away a van that was sitting immobile in Nag's driveway because the vehicle had an expired license tag.

When Nag objected to the impending auto theft, Grant attacked him, threw him to the ground, and beat him mercilessly in front of his horrified wife and children while befouling the air with obscene -- and ignorant -- racial invective: "You f*****g Arab! You f*****g immigrant, go back to your country before I kill you!"

Nag, a Navy veteran who received the Bronze Star for his service in the first Gulf War, was already residing in "his" country. Granted, he had difficulty recognizing it after being assaulted on his own property by an armed, tax-devouring bully. As is often the case in acts of state-sponsored terrorism of this kind, the victim was eventually convicted of "aggravated assault" for the supposed crime of trying to cover his head for protection against repeated baton strikes inflicted by the government-licensed thug.

"I was just trying to cover up with my arms," Nag testified during his trial two years later. "He kept telling me `Go home' and `f****g Arab.' I'm not Muslim, but if I was, is that a crime in America?"

Prior to being assaulted and abducted by Grant, Nag had seen his home defaced with graffiti conveying essentially the same message that had dribbled down Grant's tax-fattened chin. On two other occasions vandals had shot at the family's house with a BB gun.

Officer Grant was ostensibly enforcing a municipal "quality of life" ordinance of a kind routinely employed to extort revenue on behalf of the ruling criminal clique. That ordinance permits police of ticket and tow away "inoperable vehicles" from private property. However, as Rajpir Singh of the Sikh-American Legal Defense and Education Fund told me in an interview several years ago, Grant's actions were not in compliance with established policies.

"This was the first instance, the first notice of any kind Nag received that his van was in violation of the local ordinance," Singh explained. "Since the van had never been ticketed before, the appropriate action would have been to leave a windshield advisory warning that it would be towed within a certain time." Mr. Nap and his family never received the proper notice.

Furthermore, the license decal was too small to be seen from the street -- even by an officer trolling for revenue-generating code violations. How did that van come to Grant's attention?

"The police apparently received a telephone complaint from a neighbor," Nag's attorney Paul Chawla points out. Chawla, who resides in Chicago area, describes the particular section of Joliet where Nag and his family had lived for about three years as? "not all that receptive to immigrants."

It's entirely possible that the beating Nag suffered, and the spurious criminal conviction inflicted on him, resulted from an anonymous tip phone in by someone residing nearby (the word "neighbor" wouldn't apply here) who resented the presence of a turban-wearing man he considered a "f*****g Arab."

In any case, this racially charged crime was an act of state terrorism by a local police officer that was ratified by the "justice" system. Predictably, the police state profiteers at the SPLC didn't consider it worthy of their attention.

DOJ: Lying on Match.com needs to be a crime

The U.S. Department of Justice is defending computer hacking laws that make it a crime to use a fake name on Facebook or lie about your weight in an online dating profile at a site like Match.com.

In a statement obtained by CNET that's scheduled to be delivered tomorrow, the Justice Department argues that it must be able to prosecute violations of Web sites' often-ignored, always-unintelligible "terms of service" policies.

The law must allow "prosecutions based upon a violation of terms of service or similar contractual agreement with an employer or provider," Richard Downing, the Justice Department's deputy computer crime chief, will tell the U.S. Congress tomorrow.

Scaling back that law "would make it difficult or impossible to deter and address serious insider threats through prosecution," and jeopardize prosecutions involving identity theft, misuse of government databases, and privacy invasions, according to Downing.

City to pay $1.25 million to man jailed 12 years for a crime he did not commit

Chicago taxpayers will spend $1.25 million to compensate a man who spent 12 years in prison for a rape and murder he did not commit after allegedly being beaten and coerced into a false confession by detectives working under Jon Burge.

The body of 39-year-old Kathy Morgan was discovered in an abandoned and torched South Side building in October, 1990. The victim had been raped, beaten and strangled.

Eighteen months later, Harold Hill was questioned about Morgan?s murder after being arrested on an unrelated charge. A teenager at the time, Hill claims that he confessed only after being hit, threatened and force-fed a false version of events by Belmont Area detectives.

Study: Crime in surrounding area increased after closure of LA medical marijuana dispensaries

LOS ANGELES ? A new study released Tuesday showed that when hundreds of medical marijuana dispensaries were closed last year in Los Angeles crime rates rose in surrounding neighborhoods, challenging claims made by law enforcement agencies that the storefronts are magnets for crime.

The report by the nonprofit RAND Corp. reviewed crime reports for the 10 days prior to and the 10 days after city officials shuttered the clinics last summer after a new ordinance went into effect. The analysis revealed that crime increased about 60 percent within three blocks of a closed dispensary compared to the same parameters for those that remained open.

?If medical marijuana dispensaries are causing crime, then there should be a drop in crime when they close,? said Mireille Jacobson, a RAND senior economist and the study?s lead author. ?Individual dispensaries may attract crime or create a neighborhood nuisance, but we found no evidence that medical marijuana dispensaries in general cause crime to rise.?
